GENERAL PROVISIONS

      NRS 385.005  Declaration of legislative intent; policies of integration or desegregation of public schools; recommendations to Legislature for equality of educational opportunity.

      1.  The Legislature reaffirms its intent that public education in the State of Nevada is essentially a matter for local control by local school districts. The provisions of this title are intended to reserve to the boards of trustees of local school districts within this state such rights and powers as are necessary to maintain control of the education of the children within their respective districts. These rights and powers may only be limited by other specific provisions of law.

      2.  The responsibility of establishing a statewide policy of integration or desegregation of public schools is reserved to the Legislature. The responsibility for establishing a local policy of integration or desegregation of public schools consistent with the statewide policy established by the Legislature is delegated to the respective boards of trustees of local school districts and to the governing body of each charter school.

      3.  The State Board shall, and the State Public Charter School Authority, each board of trustees of a local school district, the governing body of each charter school and any other school officer may, advise the Legislature at each regular session of any recommended legislative action to ensure high standards of equality of educational opportunity for all children in the State of Nevada.

      NRS 385.007  Definitions.  As used in this title, unless the context otherwise requires:

      1.  “Challenge school” has the meaning ascribed to it in NRS 388D.305.

      2.  “Charter school” means a public school that is formed pursuant to the provisions of chapter 388A of NRS.

      3.  “Department” means the Department of Education.

      4.  “English learner” has the meaning ascribed to it in 20 U.S.C. § 7801(20).

      5.  “Homeschooled child” means a child who receives instruction at home and who is exempt from compulsory enrollment and attendance pursuant to NRS 392.070.

      6.  “Local school precinct” has the meaning ascribed to it in NRS 388G.535.

      7.  “Public schools” means all kindergartens and elementary schools, junior high schools and middle schools, high schools, charter schools and any other schools, classes and educational programs which receive their support through public taxation and, except for charter schools, whose textbooks and courses of study are under the control of the State Board.

      8.  “School bus” has the meaning ascribed to it in NRS 484A.230.

      9.  “School counselor” or “counselor” means a person who holds a license issued pursuant to chapter 391 of NRS and an endorsement to serve as a school counselor issued pursuant to regulations adopted by the Commission on Professional Standards in Education or who is otherwise authorized by the Superintendent of Public Instruction to serve as a school counselor.

      10.  “School psychologist” or “psychologist” means a person who holds a license issued pursuant to chapter 391 of NRS and an endorsement to serve as a school psychologist issued pursuant to regulations adopted by the Commission on Professional Standards in Education or who is otherwise authorized by the Superintendent of Public Instruction to serve as a school psychologist.

      11.  “School social worker” or “social worker” means a social worker licensed pursuant to chapter 641B of NRS who holds a license issued pursuant to chapter 391 of NRS and an endorsement to serve as a school social worker issued pursuant to regulations adopted by the Commission on Professional Standards in Education or who is otherwise authorized by the Superintendent of Public Instruction to serve as a school social worker.

      12.  “State Board” means the State Board of Education.

      13.  “University school for profoundly gifted pupils” has the meaning ascribed to it in NRS 388C.040.

DEPARTMENT OF EDUCATION

      NRS 385.010  Creation; composition; executive head.

      1.  A Department of Education is hereby created.

      2.  The Department consists of the State Board of Education and the Superintendent of Public Instruction.

      3.  The Superintendent of Public Instruction is the executive head of the Department.

      NRS 385.014  Opinions of the Attorney General relating to powers and duties.  When required, the Attorney General shall give an opinion in writing and without fee to the State Board, the Superintendent of Public Instruction and the Commission on Professional Standards in Education on matters relating to the powers and duties of the Department.

STATE BOARD OF EDUCATION

Organization

      NRS 385.021  Composition; election and appointment of members; qualifications of members; terms of members; vacancies.

      1.  The State Board of Education is hereby created. The State Board consists of the following voting members:

      (a) One member elected by the registered voters of each congressional district described in the shapefile adopted by NRS 304.095;

      (b) One member appointed by the Governor;

      (c) One member appointed by the Governor, nominated by the Majority Leader of the Senate; and

      (d) One member appointed by the Governor, nominated by the Speaker of the Assembly.

      2.  In addition to the voting members described in subsection 1, the State Board consists of the following four nonvoting members:

      (a) One member appointed by the Governor who is a member of a board of trustees of a school district, nominated by the Nevada Association of School Boards;

      (b) One member appointed by the Governor who is the superintendent of schools of a school district, nominated by the Nevada Association of School Superintendents;

      (c) One member appointed by the Governor who represents the Nevada System of Higher Education, nominated by the Board of Regents of the University of Nevada; and

      (d) One member appointed by the Governor who is a pupil enrolled in a public school in this State, nominated by the Nevada Association of Student Councils or its successor organization and in consultation with the Nevada Youth Legislature. After the initial term, the term of the member appointed pursuant to this paragraph commences on June 1 and expires on May 31 of the following year.

      3.  Each member of the State Board elected pursuant to paragraph (a) of subsection 1 must be a qualified elector of the district from which that member is elected.

      4.  Each member appointed pursuant to paragraphs (b), (c) and (d) of subsection 1 and each member appointed pursuant to subsection 2 must be a resident of this State.

      5.  Except as otherwise provided in paragraphs (a) and (c) of subsection 2, a person who is elected to serve as an officer of this State or any political subdivision thereof or a person appointed to serve for the unexpired term of such an office may not serve or continue to serve on the State Board.

      6.  The Governor shall ensure that the members appointed pursuant to paragraphs (b), (c) and (d) of subsection 1 represent the geographic diversity of this State and that:

      (a) One member is a teacher at a public school selected from a list of three candidates provided by the Nevada State Education Association.

      (b) One member is the parent or legal guardian of a pupil enrolled in a public school.

      (c) One member is a person active in a private business or industry of this State.

      7.  After the initial terms, each member:

      (a) Elected pursuant to paragraph (a) of subsection 1 serves a term of 4 years. A member may be elected to serve not more than three terms but may be appointed to serve pursuant to paragraph (b), (c) or (d) of subsection 1 or subsection 2 after service as an elected member, notwithstanding the number of terms the member served as an elected member.

      (b) Appointed pursuant to paragraphs (b), (c) and (d) of subsection 1 serves a term of 2 years, except that each member continues to serve until a successor is appointed. A member may be reappointed for additional terms of 2 years in the same manner as the original appointment.

      (c) Appointed pursuant to subsection 2 serves a term of 1 year. A member may be reappointed for additional terms of 1 year in the same manner as the original appointment.

      8.  If a vacancy occurs during the term of:

      (a) A member who was elected pursuant to paragraph (a) of subsection 1, the Governor shall appoint a member to fill the vacancy until the next general election, at which election a member must be chosen for the balance of the unexpired term. The appointee must be a qualified elector of the district where the vacancy occurs.

      (b) A voting member appointed pursuant to paragraph (b), (c) or (d) of subsection 1 or a nonvoting member appointed pursuant to subsection 2, the vacancy must be filled in the same manner as the original appointment for the remainder of the unexpired term.

      NRS 385.030  Officers: President; Secretary.

      1.  At its first meeting after each election and qualification of newly elected members, the State Board of Education shall organize by electing one of its members as President, to serve at the pleasure of the Board.

      2.  The Superintendent of Public Instruction is the Secretary of the Board and shall serve without additional salary.

      NRS 385.040  Meetings and quorum.

      1.  The State Board shall hold at least 9 but not more than 12 regular meetings annually at the State Capital. The Secretary shall call all regular meetings.

      2.  At least one of the meetings of the State Board must include a discussion with the superintendents of the school districts, presidents of the boards of trustees of the school districts, representatives of the governing bodies of charter schools, representatives of the governing bodies of university schools for profoundly gifted pupils and the chairs of all boards, commissions and councils in the public education system in this State to discuss:

      (a) The goals and benchmarks of the State for improving the academic achievement of pupils enrolled in public schools;

      (b) The effects of those goals and benchmarks on the school districts and public schools;

      (c) The status of the school districts and public schools in achieving the goals and benchmarks; and

      (d) The status of any plan of corrective action requested by the Superintendent of Public Instruction and of any measures taken to ensure compliance with a plan of corrective action or an order of a hearing officer pursuant to NRS 388.4354.

      3.  The State Board may hold special meetings at such other times and places as the State Board may direct. The Secretary shall call special meetings upon the written request of the President or any three voting members of the State Board.

      4.  A majority of the voting members of the State Board constitutes a quorum for the transaction of business, and no action of the State Board is valid unless that action receives, at a legally called meeting, the approval of a majority of all voting members.

      NRS 385.050  Compensation of members; claims.

      1.  Each member of the State Board of Education is entitled to receive compensation of not more than $80 per day, as fixed by the State Board, for attending each meeting of the State Board, not to exceed 12 meetings in any calendar year.

      2.  While engaged in the business of the State Board, each member and employee of the State Board is entitled to receive the per diem allowance and travel expenses provided for state officers and employees generally.

      3.  Claims for compensation and expenses must be approved by the Superintendent of Public Instruction and the State Board of Examiners, and must be paid from money provided by direct legislative appropriation from the State General Fund as other claims against the State are paid.

      NRS 385.075  Establishment of administrative policies.  The State Board shall establish policies to govern the administration of all functions of the State relating to supervision, management and control of public schools not conferred by law on some other agency.

      NRS 385.080  Regulations.  The State Board may adopt regulations for its own government and as necessary for the execution of the powers and duties conferred upon it by law.

      NRS 385.083  Education Gift Fund: Restrictions on use of money in Fund; State Board required to record, review and report certain gifts deposited in Fund; use of form by donor; transmittal of reports to Legislature.  Except as otherwise provided in NRS 385.091:

      1.  All gifts of money which the State Board is authorized to accept must be deposited in a special revenue fund in the State Treasury designated as the Education Gift Fund and reported pursuant to subsection 4. The interest and income earned on the sum of the money in the Education Gift Fund must be credited to the Fund. Any money remaining in the Education Gift Fund at the end of the fiscal year must be carried forward to the next fiscal year.

      2.  The money available in the Education Gift Fund must be used only for the purpose specified by the donor, within the scope of the State Board’s powers and duties.

      3.  If all or part of the money accepted by the State Board from a donor is not expended before the end of any fiscal year, the remaining balance of the amount donated must remain in the Education Gift Fund until needed for the purpose specified by the donor.

      4.  Except as otherwise provided in subsection 5, the State Board shall record each gift of money deposited in the Education Gift Fund pursuant to this section and prepare a report which includes, for each such gift:

      (a) The amount of the gift;

      (b) Except as otherwise provided in subsection 6, the name of the donor of the gift;

      (c) Any instructions provided by the donor concerning the use of the gift; and

      (d) Information concerning any connection between the donor and the State Board or the administration of the system of public education in this State, including, without limitation:

             (1) Any contract between the donor and the State Board;

             (2) Any contract between the donor and the State Public Charter School Authority;

             (3) Any bid by the donor for a contract with the State Board;

             (4) Any bid by the donor for a contract with the State Public Charter School Authority;

             (5) If the donor is a lobbyist as defined in NRS 218H.080, a statement of whether the donor lobbies on issues of interest to the State Board or relating to the system of public education in this State; and

             (6) Any service by the donor on a committee to form a charter school created pursuant to NRS 388A.240.

      5.  This section does not apply to any gift of money:

      (a) In an amount less than $100,000, unless the cumulative total by the same donor within a 12-month period is equal to or more than $100,000; or

      (b) That is intended for a public broadcasting service.

      6.  A donor may remain anonymous for purposes of the report prepared pursuant to subsection 4, unless the donor is required to provide information pursuant to paragraph (d) of subsection 4.

      7.  The State Board may submit a form to each donor that requires the donor to provide the information required for inclusion in the report prepared pursuant to subsection 4. If the State Board uses such a form, the State Board may rely upon the information provided by the donor on the form for purposes of the report required of the State Board pursuant to subsection 4 and the State Board is not otherwise required to verify the contents of the information provided by the donor on the form.

      8.  The State Board shall include the report prepared pursuant to subsection 4 on the agenda of the next regular meeting of the State Board held pursuant to NRS 385.040 and review all transactions involving a gift listed on the report that have taken place since the previous meeting of the State Board.

      9.  On or before February 1 of each year, the State Board shall transmit each report prepared pursuant to subsection 4 in the immediately preceding year:

      (a) In odd-numbered years, to the Director of the Legislative Counsel Bureau for transmittal to the next regular session of the Legislature; and

      (b) In even-numbered years, to the Joint Interim Standing Committee on Education.

      NRS 385.085  Regulations: Conditions for acceptance of money, services, commodities or equipment for public schools from federal agencies; exceptions.

      1.  The State Board of Education shall prescribe regulations under which contracts, agreements or arrangements may be made with agencies of the Federal Government for money, services, commodities or equipment to be made available to the public schools, subject to the supervision and control of the Superintendent of Public Instruction.

      2.  All contracts, agreements or arrangements made by public schools in the State of Nevada involving money, services, commodities or equipment which may be provided by agencies of the Federal Government, must be entered into in accordance with the regulations prescribed by the State Board and in no other manner.

      3.  This section does not apply to any money received by any school district in the State of Nevada pursuant to the provisions of:

      (a) “An Act to provide financial assistance for local educational agencies in areas affected by federal activities, and for other purposes,” being Public Law 874-81st Congress; and

      (b) “An Act relating to the construction of school facilities in areas affected by federal activities, and for other purposes,” being Public Law 815-81st Congress,

Nonprofit Corporation for Educational Enhancement and Recognition

      NRS 385.091  Formation.  The State Board, in the name and on behalf of the system of public schools in this State, may:

      1.  Cause to be formed a nonprofit corporation pursuant to chapter 82 of NRS for the acquisition of money and personal property for awards in recognition of exceptional teachers, pupils and public schools and for special projects regarding educational enhancement, including, but not limited to, any unique educational activity which is conducted by officials of the public schools to improve the educational performance of or learning opportunities for pupils or teachers in the public schools.

      2.  Determine the name of the corporation.

      3.  Specify that the corporation is formed for charitable and educational purposes, subject to the basic purpose of the corporation as set forth in subsection 1.

      4.  Specify any incidental powers which the corporation may exercise, including:

      (a) The power to solicit and receive contributions, gifts, grants, devises and bequests of money and personal property, or any combination thereof;

      (b) Any of the powers enumerated in NRS 82.121 except that the corporation may not receive or hold real property; and

      (c) The power to do all acts as may be necessary, convenient or desirable to carry out the purposes for which the corporation is formed.

      5.  Provide for:

      (a) The location and relocation of the office of the corporation;

      (b) Upon the dissolution of the corporation and the liquidation of its obligations, the distribution of its assets to the system of public schools in this State;

      (c) The perpetual existence of the corporation;

      (d) The governing body of the corporation and the appointment and reappointment of members thereto; and

      (e) The adoption of the bylaws for the corporation and any amendments thereto.

      NRS 385.092  Nature.

      1.  The nonprofit corporation, upon its formation, is:

      (a) A body corporate and politic; and

      (b) A political subdivision of this state.

      2.  The activities of this corporation are hereby determined to be public in nature.

      NRS 385.093  Income not to inure to any person; exceptions.  Any income of the nonprofit corporation may not inure to any member thereof or to any other natural person or partnership or corporation, excluding any payment of the expenses of the corporation for its operation and maintenance and any other obligations based on contract or tort.

Higher Education Student Loan Program

      NRS 385.102  “Institution of higher education” defined.  As used in NRS 385.104, “institution of higher education” means an educational institution which:

      1.  Admits as regular students only persons having received a certificate of graduation from high school, or the recognized equivalent of such a certificate, or those approved by the Superintendent of Public Instruction for training at a vocational-technical level;

      2.  Is authorized to provide a program of education beyond high school;

      3.  Awards a bachelor’s degree or a 2-year degree or certificate of graduation or a certificate of completion of a program beyond high school;

      4.  Is an institution with full approval of the State of Nevada or the United States Department of Education; and

      5.  Has recognized accreditation.

      NRS 385.104  Establishment of Program; use of money; policies and regulations of State Board.

      1.  The Higher Education Student Loan Program is hereby established.

      2.  Money available for the Higher Education Student Loan Program must be used to provide loans to further the educational goals of Nevada residents who are admitted to and attending institutions of higher education.

      3.  The State Board shall establish policies and may adopt regulations for the administration of the Higher Education Student Loan Program.

      (Added to NRS by 1969, 1183; A 1977, 230; 1979, 1567)

      NRS 385.106  Administration of Program; powers of State Board.

      1.  The Superintendent of Public Instruction may administer the Higher Education Student Loan Program and may consult with any public officer or private person in the State who may have an interest in higher education or in the Program. The Superintendent of Public Instruction shall notify the State Board at least 30 days in advance if the Superintendent intends to stop administering the Program.

      2.  After receiving notice from the Superintendent of Public Instruction that he or she intends to stop administering the Program, but before the Superintendent actually stops administering it, the State Board, with the concurrence of the Governor, shall designate another public agency or private nonprofit organization to administer the Program in a manner which ensures continued access to the Program by postsecondary schools in this State, including all of the institutions of the Nevada System of Higher Education. The designation may authorize assumption of any reserves or liability accruing to an agency or organization engaged in administering the Program or the guarantee of student loans.

      3.  If the Superintendent of Public Instruction administers the Program, the State Board may:

      (a) Negotiate and accept federal and other money appropriated and available to insure loans for student educational purposes under the Program.

      (b) Negotiate and enter into such agreements with other agencies as it deems proper for the administration and conduct of the Program.

      (c) Accept gifts, grants and contributions from any source that will facilitate and assist the higher education of Nevada residents.

      NRS 385.107  Higher Education Student Loan Fund.  If the Superintendent of Public Instruction administers the Higher Education Student Loan Program:

      1.  The money available for the Program must be deposited in the State Treasury for credit to the Higher Education Student Loan Fund which is hereby created as a special revenue fund.

      2.  Each expenditure from this Fund must be paid as other claims against the State are paid.

      NRS 385.108  Duties of Superintendent of Public Instruction: Withdrawals; use of money; records.  If the Superintendent of Public Instruction administers the Higher Education Student Loan Program, the Superintendent shall:

      1.  Certify to the State Controller all withdrawals for purposes of the Program. The State Controller shall then issue a warrant to the State Treasurer in the amount of the certification. The State Treasurer shall disburse that amount in accordance with the warrant.

      2.  Use the money received for the Higher Education Student Loan Program for that Program.

      3.  Establish and maintain such records for the Program as are required by good accounting practices.

Plan to Improve Achievement of Pupils

      NRS 385.111  Preparation of plan; annual submission of plan.

      1.  The State Board shall prepare a plan to improve the achievement of pupils enrolled in the public schools in this State. The plan:

      (a) Must be prepared in consultation with:

             (1) Employees of the Department;

             (2) At least one employee of a school district in a county whose population is 100,000 or more, appointed by the Nevada Association of School Boards;

             (3) At least one employee of a school district in a county whose population is less than 100,000, appointed by the Nevada Association of School Boards; and

             (4) At least one representative of the Statewide Council for the Coordination of the Regional Training Programs created by NRS 391A.130, appointed by the Council; and

      (b) May be prepared in consultation with:

             (1) Representatives of institutions of higher education;

             (2) Representatives of regional educational laboratories;

             (3) Representatives of outside consultant groups;

             (4) Representatives of the regional training programs for the professional development of teachers and administrators created by NRS 391A.120;

             (5) The Legislative Bureau of Educational Accountability and Program Evaluation; and

             (6) Other persons who the State Board determines are appropriate.

      2.  On or before March 31 of each year, the State Board shall submit the plan or the revised plan, as applicable, to the:

      (a) Governor;

      (b) Joint Interim Standing Committee on Education;

      (c) Legislative Bureau of Educational Accountability and Program Evaluation;

      (d) Board of Regents of the University of Nevada;

      (e) Board of trustees of each school district; and

      (f) Governing body of each charter school.

      NRS 385.112  Contents of plan; inclusion of 5-year strategic plan.  A plan to improve the achievement of pupils enrolled in public schools in this State prepared pursuant to NRS 385.111 must include:

      1.  A review and analysis of the data upon which the report required pursuant to NRS 385A.400 is based and a review and analysis of any data that is more recent than the data upon which the report is based.

      2.  The identification of any problems or factors common among the school districts or charter schools in this State, as revealed by the review and analysis.

      3.  Strategies based upon evidence-based research, as defined in 20 U.S.C. § 7801(21), that will strengthen the core academic subjects, as set forth in NRS 389.018.

      4.  Strategies to improve the academic achievement of pupils enrolled in public schools in this State, including, without limitation, strategies to:

      (a) Instruct pupils who are not achieving to their fullest potential, including, without limitation:

             (1) The curriculum appropriate to improve achievement;

             (2) The manner by which the instruction will improve the achievement and proficiency of pupils on the examinations administered pursuant to NRS 390.105 and the college and career readiness assessment administered pursuant to NRS 390.610, including, without limitation, the manner in which remediation will be provided to pupils who require remediation based on the results of an examination administered pursuant to NRS 390.610; and

             (3) An identification of the instruction and curriculum that is specifically designed to improve the achievement and proficiency of pupils in each group identified in the statewide system of accountability for public schools;

      (b) Improve the literacy skills of pupils;

      (c) Improve the development of English language skills and academic achievement of pupils who are English learners;

      (d) Increase the rate of attendance of pupils and reduce the number of pupils who drop out of school;

      (e) Integrate technology into the instructional and administrative programs of the school districts;

      (f) Manage effectively the discipline of pupils; and

      (g) Enhance the professional development offered for the teachers and administrators employed at public schools in this State to include the activities set forth in 20 U.S.C. § 7801(42) and to address the specific needs of the pupils enrolled in public schools in this State, as deemed appropriate by the State Board.

      5.  Strategies designed to provide to the pupils enrolled in middle school, junior high school and high school, the teachers and counselors who provide instruction to those pupils, and the parents and guardians of those pupils information concerning:

      (a) The requirements for admission to an institution of higher education and the opportunities for financial aid;

      (b) The availability of Governor Guinn Millennium Scholarships pursuant to NRS 396.911 to 396.945, inclusive, and Nevada Promise Scholarships pursuant to NRS 396.961 to 396.9685, inclusive; and

      (c) The need for a pupil to make informed decisions about his or her curriculum in middle school, junior high school and high school in preparation for success after graduation.

      6.  An identification, by category, of the employees of the Department who are responsible for ensuring that each provision of the plan is carried out effectively.

      7.  A timeline for carrying out the plan, including, without limitation:

      (a) The rate of improvement and progress which must be attained annually in meeting the goals and benchmarks established by the State Board pursuant to NRS 385.113; and

      (b) For each provision of the plan, a timeline for carrying out that provision, including, without limitation, a timeline for monitoring whether the provision is carried out effectively.

      8.  For each provision of the plan, measurable criteria for determining whether the provision has contributed toward improving the academic achievement of pupils, increasing the rate of attendance of pupils and reducing the number of pupils who drop out of school.

      9.  Strategies to improve the allocation of resources from this State, by program and by school district, in a manner that will improve the academic achievement of pupils. If this State has a financial analysis program that is designed to track educational expenditures and revenues to individual schools, the State Board shall use that statewide program in complying with this subsection. If a statewide program is not available, the State Board shall use the Department’s own financial analysis program in complying with this subsection.

      10.  Based upon the reallocation of resources set forth in subsection 9, the resources available to the State Board and the Department to carry out the plan, including, without limitation, a budget for the overall cost of carrying out the plan.

      11.  A summary of the effectiveness of appropriations made by the Legislature to improve the academic achievement of pupils and programs approved by the Legislature to improve the academic achievement of pupils.

      12.  A 5-year strategic plan which identifies the recurring issues in improving the achievement and proficiency of pupils in this State and which establishes strategic goals to address those issues. The 5-year strategic plan must be:

      (a) Based upon the data from previous years which is collected by the Department for the plan developed pursuant to NRS 385.111; and

      (b) Designed to track the progress made in achieving the strategic goals established by the Department.

      13.  Any additional plans addressing the achievement and proficiency of pupils adopted by the Department.

      NRS 385.113  Duties of State Board: Establishment of goals and benchmarks; annual review; revisions.  The State Board shall:

      1.  In developing the plan to improve the achievement of pupils enrolled in public schools pursuant to NRS 385.111, establish clearly defined goals and benchmarks for improving the achievement of pupils, including, without limitation, goals for:

      (a) Improving proficiency results in core academic subjects;

      (b) Increasing the number of pupils enrolled in public middle schools and junior high schools, including, without limitation, charter schools, who enter public high schools with the skills necessary to succeed in high school;

      (c) Improving the percentage of pupils who enroll in grade 9 and who graduate from a public high school, including, without limitation, a charter school, with a standard or higher diploma upon completion;

      (d) Improving the performance of pupils on standardized college entrance examinations;

      (e) Increasing the percentage of pupils enrolled in high schools who enter postsecondary educational institutions or who are career and workforce ready; and

      (f) Reengaging disengaged youth who have dropped out of high school or who are at risk of dropping out of high school, including, without limitation, a mechanism for tracking and maintaining communication with those youth who have dropped out of school or who are at risk of doing so;

      2.  Review the plan annually to evaluate the effectiveness of the plan;

      3.  Examine the timeline for implementing the plan and each provision of the plan to determine whether the annual goals and benchmarks have been attained;

      4.  Based upon the evaluation of the plan, make revisions, as necessary, to ensure that:

      (a) The goals and benchmarks set forth in the plan are being attained in a timely manner; and

      (b) The plan is designed to improve the academic achievement of pupils enrolled in public schools in this State; and

      5.  Review the plans submitted pursuant to subsection 4 of NRS 385A.650 to:

      (a) Determine common problems identified by the principal of each school; and

      (b) Make recommendations to the Department concerning how the Department can best support the needs of schools.

Miscellaneous Provisions

      NRS 385.114  State Board to prescribe and cause enforcement of courses of study for public schools; exceptions.

      1.  Except as otherwise provided in subsections 2 and 3, the State Board shall prescribe and cause to be enforced the courses of study for the public schools of this State. The courses of study prescribed and enforced by the State Board must comply with the standards of content and performance established by the Council to Establish Academic Standards for Public Schools pursuant to NRS 389.520.

      2.  For those courses of study prescribed by the State Board:

      (a) High schools may have modified courses of study, subject to the approval of the State Board; and

      (b) Any high school offering courses normally accredited as being beyond the level of the 12th grade shall, before offering such courses, have them approved by the State Board.

      3.  A charter school is not required to offer the courses of study prescribed by the State Board except for those courses of study which are required for promotion to the next grade or graduation from high school.

      NRS 385.115  State Board to cooperate in establishment of programs of information about missing children; regulations.  The State Board shall cooperate with the Attorney General in the establishment in the schools, including, without limitation, charter schools, of programs of information about missing children and adopt regulations containing guidelines for such programs.

      NRS 385.125  Standard plans, designs and specifications for construction of school buildings: Adoption; approval by State Public Works Division of the Department of Administration prior to adoption; fee for costs of approval.

      1.  The State Board may adopt standard plans, designs and specifications for the construction of school buildings by the boards of trustees of the various school districts. If such plans, designs and specifications are adopted, provision must be made for the production and distribution of such plans, designs and specifications by appropriate rules and regulations. The board of trustees of a school district may use any such plans, designs and specifications if it determines that the plans, designs and specifications are in the best interests of the district.

      2.  Before the adoption of any such standard plans, designs and specifications, the State Board shall submit the plans, designs and specifications to the State Public Works Division of the Department of Administration, whose written approval thereof must be obtained before any further consideration by the State Board. The State Public Works Division shall verify that the plans, designs and specifications comply with all applicable requirements of the Americans with Disabilities Act of 1990, 42 U.S.C. §§ 12101 et seq., and the regulations adopted pursuant thereto, including, without limitation, the Americans with Disabilities Act Accessibility Guidelines for Buildings and Facilities set forth in Appendix A of Part 36 of Title 28 of the Code of Federal Regulations. The requirements of this subsection are not satisfied if the plans, designs and specifications comply solely with the Uniform Federal Accessibility Standards set forth in Appendix A of Part 101-19.6 of Title 41 of the Code of Federal Regulations.

      3.  The State Public Works Division of the Department of Administration may charge and collect and the State Board may pay a reasonable fee for the costs incurred by the State Public Works Division in approving the standard plans, designs and specifications submitted.

SUPERINTENDENT OF PUBLIC INSTRUCTION

      NRS 385.150  Appointment; unclassified service; position within Executive Department.  The Superintendent of Public Instruction:

      1.  Is appointed by the Governor from a list of three candidates submitted by the State Board and serves at the pleasure of the Governor.

      2.  Is in the unclassified service of the State.

      3.  Is in the Executive Department of State Government.

      2.  Possess the knowledge and ability to carry out the duties required by this title and all other statutes and regulations governing K-12 public education.

      NRS 385.175  Designation as educational leader for system of K-12 public education; general duties. [Effective through June 30, 2024.]  The Superintendent of Public Instruction is the educational leader for the system of K-12 public education in this State. The Superintendent of Public Instruction shall:

      1.  Execute, direct or supervise all administrative, technical and procedural activities of the Department in accordance with policies prescribed by the State Board.

      2.  Employ personnel for the positions approved by the State Board and necessary for the efficient operation of the Department.

      3.  Organize the Department in a manner which will assure efficient operation and service.

      4.  Maintain liaison and coordinate activities with other state agencies performing educational functions.

      5.  Enforce the observance of this title and all other statutes and regulations governing K-12 public education.

      6.  Request a plan of corrective action from the board of trustees of a school district or the governing body of a charter school if the Superintendent of Public Instruction determines that the school district or charter school, or any other entity which provides education to a pupil with a disability for a school district or charter school, has not complied with a requirement of this title or any other statute or regulation governing K-12 public education. The plan of corrective action must provide a timeline approved by the Superintendent of Public Instruction for compliance with the statute or regulation.

      7.  Report to the State Board on a regular basis the data on the discipline of pupils and trends in the data on the discipline of pupils collected pursuant to NRS 385A.840.

      8.  Perform such other duties as are prescribed by law.

      NRS 385.175  Designation as educational leader for system of K-12 public education; general duties. [Effective July 1, 2024.]  The Superintendent of Public Instruction is the educational leader for the system of K-12 public education in this State. The Superintendent of Public Instruction shall:

The plan of corrective action must provide a timeline approved by the Superintendent of Public Instruction for compliance with the statute or regulation.

      7.  Report to the State Board on a regular basis the data on the discipline of pupils and trends in the data on the discipline of pupils collected pursuant to NRS 385A.840.

      8.  Develop a strategic plan for the recruitment of teachers and other licensed educational personnel which includes, without limitation:

      (a) A strategy to decrease the processing times of applications for licensure pursuant to chapter 391 of NRS.

      (b) A plan to provide for the translation of academic transcripts which are in a language other than English of applicants for licensure pursuant to chapter 391 of NRS. The Department shall post the process for the translation of academic transcripts on its Internet website.

      9.  Perform such other duties as are prescribed by law.

      NRS 385.180  Visitation of schools; consultations with educators.  The Superintendent of Public Instruction or a staff member of the Department designated by the Superintendent shall:

      1.  Visit each county in the State at least once each school year, and shall conduct institutes, visit schools, consult with school officers, or address public assemblies on subjects pertaining to the schools.

      2.  Consult and study with school officers and educators of this and other states on topics of school administration, school methods and school law.

      NRS 385.190  Conferences of teachers and administrators.

      1.  The Superintendent of Public Instruction or a staff member designated by the Superintendent shall:

      (a) Convene teachers’ conferences in the various sections of the State in such places and at such times as he or she deems advisable.

      (b) Engage such conference lecturers and leaders as he or she deems advisable.

      (c) Preside over and regulate the programs of all teachers’ conferences.

      2.  No teachers’ conference may continue more than 5 days.

      3.  The Superintendent of Public Instruction or the designated staff member shall convene, in such places and at such times as he or she may designate, conferences of school administrators.

      NRS 385.200  Regulations: Reports to Department; proceedings.  The Superintendent of Public Instruction shall prescribe proper and necessary regulations for making reports to the Department and for conducting all necessary proceedings for which the Superintendent is responsible.

      NRS 385.215  Regulations: Policy for treatment of injuries to the head; requirements of policy; review of policy. [Effective July 1, 2024.]

      1.  The Superintendent of Public Instruction shall, in cooperation with the Nevada Interscholastic Activities Association and the Chief Medical Officer, adopt regulations prescribing a policy concerning the treatment of injuries to the head that affect the ability of a pupil to learn and otherwise engage with his or her course work at school, including, without limitation, a concussion of the brain.

      2.  The policy adopted pursuant to subsection 1 must require a school to authorize a pupil who has sustained or is suspected of sustaining an injury to the head to receive reasonable accommodations that are based on peer-reviewed evidence until the pupil is mentally and physically ready to return to full participation in his or her course work. Such accommodations may include, without limitation:

      (a) Rest;

      (b) A modified schedule or curriculum; or

      (c) Monitoring by a school nurse, athletic trainer or other person qualified to monitor the mental and physical health of the pupil.

      3.  The Superintendent of Public Instruction shall post the policy adopted pursuant to subsection 1 on an Internet website maintained by the Department.

      4.  At least once every 5 years, the Superintendent of Public Instruction shall:

      (a) Review the policy adopted pursuant to subsection 1; and

      (b) Update the policy to reflect current best practices in the prevention and treatment of injuries to head.

      NRS 385.220  Power to administer oaths.  The Superintendent of Public Instruction and members of the professional staff within the Department designated by the Superintendent may administer oaths relating to public schools.

      NRS 385.230  Annual report of the state of public education; contents of report; presentation and submission of report.

      1.  The Department shall, in conjunction with the State Board, prepare an annual report of the state of public education in this State. The report must include, without limitation:

      (a) An analysis of each annual report of accountability prepared by the State Board pursuant to NRS 385A.400;

      (b) An update on the status of K-12 public education in this State;

      (c) A description of the most recent vision and mission statements of the State Board and the Department, including, without limitation, the progress made by the State Board and Department in achieving those visions and missions;

      (d) A description of the goals and benchmarks for improving the academic achievement of pupils which are included in the plan to improve the achievement of pupils required by NRS 385.111;

      (e) A description of any policies, plans and programs for promoting, extending and improving career and technical education for pupils;

      (f) A description of any significant changes made to the collection, maintenance or transfer of data concerning pupils by the Department, a school district, a sponsor of a charter school or a university school for profoundly gifted pupils;

      (g) Any new data elements, including, without limitation, data about individual pupils and aggregated data about pupils within a defined group, proposed for inclusion in the automated system of accountability information for Nevada established pursuant to NRS 385A.800;

      (h) An analysis of the progress the public schools have made in the previous year toward achieving the goals and benchmarks for improving the academic achievement of pupils;

      (i) An analysis of whether the standards and examinations adopted by the State Board adequately prepare pupils for success in postsecondary educational institutions and in career and workforce readiness;

      (j) An analysis of the extent to which school districts and charter schools recruit and retain effective teachers and principals;

      (k) An analysis of the ability of the automated system of accountability information for Nevada established pursuant to NRS 385A.800 to link the achievement of pupils to the performance of the individual teachers assigned to those pupils and to the principals of the schools in which the pupils are enrolled;

      (l) An analysis of the extent to which the lowest performing public schools have improved the academic achievement of pupils enrolled in those schools;

      (m) A summary of the innovative educational programs implemented by public schools which have demonstrated the ability to improve the academic achievement of pupils, including, without limitation:

             (1) Pupils who are economically disadvantaged, as defined by the State Board;

             (2) Pupils from major racial and ethnic groups, as defined by the State Board;

             (3) Pupils with disabilities;

             (4) Pupils who are English learners; and

             (5) Pupils who are migratory children, as defined by the State Board;

      (n) A description of any plan of corrective action requested by the Superintendent of Public Instruction from the board of trustees of a school district or the governing body of a charter school and the status of that plan;

      (o) A summary of any measures taken by the Superintendent of Public Instruction pursuant to NRS 388.4354 to ensure compliance with a plan of corrective action or the order of a hearing officer; and

      (p) An analysis of data on the discipline of pupils collected pursuant to NRS 385A.840, including, without limitation:

             (1) Trends in the data measuring changes in the discipline of pupils; and

             (2) Areas identified by the Department where the Department will provide support to a public school to address trends in the data on the discipline of pupils.

      2.  In odd-numbered years, the Superintendent of Public Instruction shall present the report prepared pursuant to subsection 1 in person to the Governor and each standing committee of the Legislature with primary jurisdiction over matters relating to K-12 public education at the beginning of each regular session of the Legislature.

      3.  In even-numbered years, the Superintendent of Public Instruction shall, on or before January 31, submit a written copy of the report prepared pursuant to subsection 1 to the Governor and to the Joint Interim Standing Committee on Education.

      NRS 385.290  Superintendent of Public Instruction authorized to appoint deputy superintendents.  The Superintendent of Public Instruction may appoint such deputy superintendents as the execution of the Superintendent’s duties may require. A deputy superintendent may perform any duty required of the Superintendent of Public Instruction during the absence of the Superintendent and shall do such work as the Superintendent may direct under the laws of the State.

      NRS 385.320  Deputy superintendents in unclassified service; restriction on other employment.  Each deputy superintendent appointed by the Superintendent of Public Instruction pursuant to NRS 385.290:

      1.  Is in the unclassified service of the State.

      2.  Except as otherwise provided in NRS 284.143, shall each devote his or her entire time and attention to the business of his or her office and shall not pursue any other business or occupation or hold any other office of profit.

      NRS 385.330  Professional staff and other appointed personnel: Duties; location of offices.

      1.  Professional staff and other personnel appointed by the Superintendent of Public Instruction shall perform such duties as are assigned by the Superintendent.

      2.  The Superintendent of Public Instruction, under the policies of the State Board, shall locate the offices of professional staff and other personnel where the needs of the education program can best be served.

      NRS 385.340  Qualifications of professional staff and other appointed personnel not in unclassified service.  The qualifications for the professional staff and other personnel appointed by the Superintendent of Public Instruction who are not in the unclassified service must be fixed by the Division of Human Resource Management of the Department of Administration.

      NRS 385.345  Coordinator of the Use of Libraries and Related Technical Systems: Appointment; duties.

      1.  The position of Coordinator of the Use of Libraries and Related Technical Systems is hereby created. The Superintendent of Public Instruction may:

      (a) Assign the duties of the Coordinator to an employee of the Department of Education; or

      (b) Appoint a Coordinator.

      2.  The Coordinator of the Use of Libraries and Related Technical Systems shall:

      (a) Coordinate the use of public libraries by local school districts;

      (b) Coordinate services offered by the libraries in each school district;

      (c) Advise school districts on the proper use and management of libraries in the school districts and the services offered by those libraries;

      (d) In conjunction with the Division of State Library, Archives and Public Records of the Department of Administration, coordinate the loan of materials and supplies between libraries;

      (e) Offer libraries assistance in the automation of their access to and use of technical materials;

      (f) Develop a library of audiovisual software and software for computers for the use of school libraries; and

      (g) Offer technical expertise to school libraries regarding such subjects as the new methods of gathering and retaining information.

ADVISORY COUNCIL FOR FAMILY ENGAGEMENT; OFFICE OF PARENTAL INVOLVEMENT AND FAMILY ENGAGEMENT

General Provisions

      NRS 385.600  “Advisory Council” defined.  As used in NRS 385.600 to 385.635, inclusive, unless the context otherwise requires, “Advisory Council” means the Advisory Council for Family Engagement established pursuant to NRS 385.610.

Advisory Council for Family Engagement

      NRS 385.605  Superintendent of Public Instruction required to ensure Advisory Council carries out duties successfully.  The Superintendent of Public Instruction is responsible for ensuring that the duties and responsibilities of the Advisory Council set forth in NRS 385.605 to 385.625, inclusive, are carried out by the Advisory Council successfully.

      NRS 385.610  Establishment; appointment of members; election of officers; terms; submission of names of certain potential members; administrative support by Department; compensation of members; payment of certain costs by school district or charter school.

      1.  The Superintendent of Public Instruction shall establish an Advisory Council for Family Engagement. The Advisory Council is composed of 11 members.

      2.  The Superintendent of Public Instruction shall appoint the following members to the Advisory Council:

      (a) Two parents or legal guardians of pupils enrolled in public schools;

      (b) Two teachers in public schools;

      (c) One administrator of a public school;

      (d) One representative of a private business or industry;

      (e) One member of the board of trustees of a school district in a county whose population is 100,000 or more;

      (f) One member of the board of trustees of a school district in a county whose population is less than 100,000; and

      (g) One member who is the President of the Board of Managers of the Nevada Parent Teacher Association or its successor organization, or a designee nominated by the President.

Ê The Superintendent of Public Instruction shall, to the extent practicable, ensure that the members the Superintendent appoints to the Advisory Council reflect the ethnic, economic and geographic diversity of this State.

      3.  The Speaker of the Assembly shall appoint one member of the Assembly to the Advisory Council.

      4.  The Majority Leader of the Senate shall appoint one member of the Senate to the Advisory Council.

      5.  The Advisory Council shall elect a Chair and Vice Chair from among its members. The Chair and Vice Chair serve a term of 1 year.

      6.  After the initial terms:

      (a) The term of each member of the Advisory Council who is appointed by the Superintendent of Public Instruction is 3 years.

      (b) The term of each member of the Advisory Council who is appointed by the Speaker of the Assembly and the Majority Leader of the Senate is 2 years.

      7.  The Advisory Council shall, at least 30 days before the beginning of any member’s term, or within 30 days after a position on the Advisory Council becomes vacant, submit to the relevant appointing authority, as set forth in subsection 2, 3 or 4, as applicable, the names of at least three persons qualified for membership on the Advisory Council.

      8.  The Department shall provide:

      (a) Administrative support to the Advisory Council; and

      (b) All information that is necessary for the Advisory Council to carry out its duties.

      9.  For each day or portion of a day during which a member of the Advisory Council who is a Legislator attends a meeting of the Advisory Council or is otherwise engaged in the business of the Advisory Council, except during a regular or special session of the Legislature, the member is entitled to receive the:

      (a) Compensation provided for a majority of the members of the Legislature during the first 60 days of the preceding regular session;

      (b) Per diem allowance provided for state officers generally; and

      (c) Travel expenses provided pursuant to NRS 218A.655.

Ê The compensation, per diem allowances and travel expenses of the legislative members of the Advisory Council must be paid from the Legislative Fund.

      10.  A member of the Advisory Council who is not a Legislator is entitled to receive the per diem allowance and travel expenses provided for state officers and employees generally for each day or portion of a day during which the member attends a meeting of the Advisory Council or is otherwise engaged in the business of the Advisory Council. The per diem allowance and travel expenses for the members of the Advisory Council who are not Legislators must be paid by the Department.

      11.  Any costs associated with employing a substitute teacher while a member of the Advisory Council who is a teacher attends a meeting of the Advisory Council must be paid by the school district or charter school that employs the member.

      NRS 385.620  Duties; submission of reports.  The Advisory Council shall:

      1.  Review the policy of parental involvement adopted by the State Board and the policy of parental involvement and family engagement adopted by the board of trustees of each school district pursuant to NRS 392.457;

      2.  Review the information relating to communication with and participation, involvement and engagement of parents and families that is included in the annual report of accountability for each school district pursuant to NRS 385A.320 and similar information in the annual report of accountability prepared by the State Public Charter School Authority and a college or university within the Nevada System of Higher Education or city or county that sponsors a charter school pursuant to subsection 3 of NRS 385A.070;

      3.  Review any effective practices carried out in individual school districts to increase parental involvement and family engagement and determine the feasibility of carrying out those practices on a statewide basis;

      4.  Review any effective practices carried out in other states to increase parental involvement and family engagement and determine the feasibility of carrying out those practices in this State;

      5.  Identify methods to communicate effectively and provide outreach to parents, legal guardians and families of pupils who have limited time to become involved in the education of their children for various reasons, including, without limitation, work schedules, single-parent homes and other family obligations;

      6.  Identify the manner in which the level of parental involvement and family engagement affects the performance, attendance and discipline of pupils;

      7.  Identify methods to communicate effectively with and provide outreach to parents, legal guardians and families of pupils who are English learners;

      8.  Determine the necessity for the appointment of a statewide parental involvement and family engagement coordinator or a parental involvement and family engagement coordinator in each school district, or both;

      9.  Work in collaboration with the Office of Parental Involvement and Family Engagement created by NRS 385.630 to carry out the duties prescribed in NRS 385.635; and

      10.  On or before February 1 of each year, submit a report to the Director of the Legislative Counsel Bureau for transmission to the Legislature in odd-numbered years and to the Legislative Commission in even-numbered years, describing the activities of the Advisory Council and any recommendations for legislation.

      NRS 385.625  Board of trustees authorized to establish local advisory council on parental involvement and family engagement.  The board of trustees of a school district may establish an advisory council on parental involvement and family engagement to work in conjunction with the Advisory Council.

Office of Parental Involvement and Family Engagement

      NRS 385.630  Creation; duty of Superintendent of Public Instruction to appoint Director and to ensure sufficient number of personnel.

      1.  The Office of Parental Involvement and Family Engagement is hereby created within the Department.

      2.  The Superintendent of Public Instruction shall:

      (a) Appoint an employee of the Department to serve as the Director of the Office of Parental Involvement and Family Engagement; and

      (b) Ensure that the Office of Parental Involvement and Family Engagement has a sufficient number of personnel for the Office to carry out the duties prescribed in NRS 385.635.

      (Added to NRS by 2011, 1962)

      NRS 385.635  Duties; annual report; posting of certain information on Department’s website.

      1.  The Office of Parental Involvement and Family Engagement created by NRS 385.630 shall:

      (a) Review and evaluate the programs implemented by the school districts and public schools, including, without limitation, programs which are supported in part with money received from the Federal Government, for carrying out and increasing parental involvement and family engagement in the public schools. The review and evaluation must include an identification of current strategies and practices for effective parental involvement and family engagement.

      (b) Develop a list of practices which have been proven effective in increasing the involvement of parents and the engagement of families in the education of their children, including, without limitation, practices that increase the ability of school districts and public schools to effectively reengage parents and families and provide those parents and families with the skills and resources necessary to support the academic achievement of their children.

      (c) Work in cooperation with the Statewide Council for the Coordination of the Regional Training Programs in carrying out the duties of the Office, including, without limitation, the establishment of a statewide training program concerning parental involvement and family engagement required pursuant to NRS 391A.135.

      (d) Provide information to the school districts and public schools on the availability of competitive grants for programs which offer:

             (1) Professional development for educational personnel on practices to reengage disengaged parents and families in the education of their children;

             (2) Training for parents and families in skills of leadership and volunteerism;

             (3) Family literacy training;

             (4) Home visitation programs to encourage the involvement of parents and the engagement of families in the education of their children; and

             (5) Other innovative programs that are designed to increase the involvement of parents and the engagement of families in the academic achievement of their children.

      (e) Provide support to those school districts which have established an advisory council on parental involvement and family engagement pursuant to NRS 385.625 and encourage those school districts which have not established such an advisory council to consider creating an advisory council for the school district.

      (f) Build the capacity of public schools to work in collaboration with parents to establish policies for the involvement of parents and the engagement of families, including, without limitation, policies that focus on partnerships between public schools and the parents and families of children enrolled in public schools and the empowerment of parents and families in support of the education of their children.

      (g) Work in cooperation with the Commission on Professional Standards in Education in developing the regulations required by paragraph (g) of subsection 1 of NRS 391.019 and monitoring the implementation of those regulations.

      (h) Establish, in collaboration with the State Board, guidelines to assist parents and families in helping their children achieve the standards of content and performance adopted by the State Board pursuant to NRS 389.520.

      (i) Collaborate with the Nevada State Parent Information and Resource Center, the Parent Training and Information Centers, the Nevada Parent Teacher Association, the Advisory Council and the teachers who are trained to serve as liaisons to parents and legal guardians of pupils enrolled in public schools to plan and implement a statewide summit on parental involvement and family engagement, which must be held at least biennially. After each summit, the Office of Parental Involvement and Family Engagement shall evaluate the success of the summit in consultation with the entities identified in this paragraph.

      (j) Assist each school district and the public schools within the school district with incorporating strategies and practices for effective parental involvement and family engagement into the plans to improve the achievement of pupils prepared by the public schools pursuant to NRS 385A.650.

      (k) Work in partnership with the Advisory Council to:

             (1) Review and evaluate the annual reports of accountability prepared by the board of trustees of each school district pursuant to NRS 385A.070 relating to parental involvement and family engagement in the school districts and public schools;

             (2) Review and evaluate the plans to improve the achievement of pupils prepared by each public school pursuant to NRS 385A.650 relating to the strategies and practices for effective parental involvement and family engagement incorporated into the plans; and

             (3) Review the status of the implementation of the provisions of this section and the effectiveness of the Office in carrying out the duties prescribed in this section.

      2.  On or before August 1 of each year, the Office of Parental Involvement and Family Engagement shall prepare a report which includes a summary of the:

      (a) Status of the progress made by the school districts and public schools in effectively involving parents and engaging families in the education of their children and an identification of any areas where further improvement is needed; and

      (b) Activities of the Office during the immediately preceding school year, including the progress made by the Office, in consultation with the Advisory Council, in assisting the school districts and public schools with increasing the effectiveness of involving parents and engaging families in the education of their children.

      3.  The Department shall post on its Internet website:

      (a) The list of practices developed by the Office of Parental Involvement and Family Engagement pursuant to paragraph (b) of subsection 1;

      (b) The report prepared by the Office pursuant to subsection 2; and

      (c) Any other information that the Office finds useful for the school districts, public schools, parents, families and general public relating to effective parental involvement and family engagement.

NEVADA COMMISSION ON MENTORING

      NRS 385.750  “Commission” defined.  As used in NRS 385.750 to 385.780, inclusive, unless the context otherwise requires, “Commission” means the Nevada Commission on Mentoring created by NRS 385.760.

      NRS 385.760  Creation; appointment of members; terms; vacancies in membership; replacement of members; compensation; administrative support.

      1.  The Nevada Commission on Mentoring is hereby created. The Commission consists of the following 13 members:

      (a) One member appointed by the Governor who is a representative of business and industry with a vested interest in supporting mentorship programs in this State.

      (b) One member appointed by the Governor who represents an employment and training organization located in this State.

      (c) One member appointed by the Governor who is a resident of a county whose population is less than 100,000.

      (d) One member who is the superintendent of a school district in a county whose population is 700,000 or more.

      (e) One member who is the superintendent of a school district in a county whose population is 100,000 or more but less than 700,000.

      (f) One member, who is not a Legislator, appointed by the Majority Leader of the Senate.

      (g) One member, who is not a Legislator, appointed by the Speaker of the Assembly.

      (h) One member, who is not a Legislator, appointed by the Minority Leader of the Senate.

      (i) One member, who is not a Legislator, appointed by the Minority Leader of the Assembly.

      (j) Four members appointed to the Commission pursuant to subsection 2.

      2.  The members of the Commission appointed pursuant to paragraphs (a) to (i), inclusive, of subsection 1 shall, at the first meeting of the Commission, appoint to the Commission four additional voting members:

      (a) One of whom must be a member of the state advisory group appointed by the Governor pursuant to 34 U.S.C. § 11133 and operating in this State as the Juvenile Justice Commission under the Division of Child and Family Services of the Department of Health and Human Services;

      (b) One of whom must be a representative of business and industry with a vested interest in supporting mentorship programs in this State; and

      (c) Two members between the ages of 16 years and 24 years who have a vested interest in supporting mentorship programs in this State.

      3.  After the initial terms, each member of the Commission appointed pursuant to subsections 1 and 2 serves a term of 2 years. A member of the Commission may be reappointed, except that no member may serve more than two consecutive terms.

      4.  Any vacancy occurring in the membership of the Commission must be filled in the same manner as the original appointment not later than 30 days after the vacancy occurs. A member appointed to fill a vacancy shall serve as a member of the Commission for the remainder of the original term of appointment.

      5.  If a member of the Commission fails to attend two consecutive meetings of the Commission, the Commission shall, within 5 days after the second consecutive meeting that the member fails to attend, provide notice of that fact, in writing, to the appointing authority who appointed that member. Upon receipt of the notice, the appointing authority shall appoint a person to replace the member in the same manner as filling a vacancy on the Commission pursuant to subsection 4.

      6.  Each member of the Commission:

      (a) Serves without compensation; and

      (b) While engaged in the business of the Commission, is entitled to receive the per diem allowance and travel expenses provided for state officers and employees generally.

      7.  The Department shall provide the Commission with such administrative support as is necessary to assist the Commission in carrying out its duties pursuant to NRS 385.780.

      NRS 385.770  Election of officers; meetings; quorum; authorized actions; submission of annual report.

      1.  At the first meeting of each calendar year, the Commission shall elect from its members a Chair, a Vice Chair and a Secretary and shall adopt the rules and procedures of the Commission.

      2.  The Commission shall meet at least once each calendar quarter and at other times at the call of the Chair or a majority of its members.

      3.  A majority of the members of the Commission constitutes a quorum for the transaction of business, and a quorum may exercise any power or authority conferred on the Commission.

      4.  Except as otherwise provided in NRS 385.780, the Commission may, for the purpose of carrying out the duties of the Commission prescribed by that section:

      (a) Appoint committees from its members.

      (b) Engage the services of volunteer workers and consultants without compensation.

      (c) Enter into a public-private partnership with any business, for-profit organization or nonprofit organization.

      (d) Apply for and receive gifts, grants, donations, contributions or other money from any source.

      5.  The Commission shall, on or before February 1 of each year, prepare and submit a report outlining the activities and recommendations of the Commission to:

      (a) The Governor; and

      (b) The Director of the Legislative Counsel Bureau for transmittal to the Legislature or to the Legislative Commission if the Legislature is not in regular session.

      NRS 385.780  Duties of Commission.

      1.  The Commission shall, within the scope of its duties, support and facilitate mentorship programs in this State for the purpose of addressing issues relating to education, health, criminal justice and employment with respect to children who reside in this State. The Commission shall:

      (a) Establish model guidelines and parameters for existing mentorship programs, including, without limitation:

             (1) The development of a model management plan setting forth guidelines for the operation of mentorship programs and strategic goals and benchmarks to measure the success of a mentorship program.

             (2) The process for identifying children in need of mentorship and geographic areas of need within this State. Such a process must include, without limitation, consideration of children who:

                   (I) Are disproportionately at risk of being deprived of the opportunity to develop and maintain a competitive position in the economy.

                   (II) Are disproportionately at risk of failing to make adequate yearly progress in a school in this State.

                   (III) Have been involved with the system of juvenile justice in this State, either as a victim or as an offender.

                   (IV) Have been involved with the criminal justice system, either as a victim or as an offender.

                   (V) Are in the child welfare system.

      (b) Develop a model financial plan that provides for the sustainability and financial stability of mentorship programs, including, without limitation:

             (1) The development of a resource plan to provide for diversified fundraising.

             (2) The identification of potential sources of revenue to fund the hiring of the coordinator for mentorship programs in this State, as required by paragraph (e).

             (3) The identification of potential sources of revenue to fund the hiring of administrative support staff for mentorship programs in this State.

             (4) The development, in coordination with the Office of Grant Procurement, Coordination and Management of the Department of Administration of a plan for seeking gifts, grants, donations and contributions from any source for the purpose of carrying out a mentorship program.

             (5) The identification of potential strategic private partners to assist in the implementation and continuation of mentorship programs.

             (6) The development of public relations and marketing campaigns for the purpose of increasing public awareness regarding existing mentorship programs and the value of mentorship programs.

      (c) Develop model protocols for the recruitment, screening, training, matching, monitoring and support of mentors.

      (d) Develop model protocols for the effective management of mentors, mentees and matches under mentorship programs, including, without limitation, protocols for the introduction of a mentor to a mentee and closure of the relationship between a mentor and a mentee.

      (e) Within the limits of legislative appropriations, employ a coordinator for mentorship programs in this State. The Commission shall work in consultation with the Department of Education to provide direction and guidance for the coordinator.

      (f) Within the limits of legislative appropriations, develop a competitive grants program to award grants of money to mentorship programs in this State. In coordination with the Office of Grant Procurement, Coordination and Management of the Department of Administration, the Commission shall:

             (1) Administer the grants program;

             (2) Establish guidelines for the submission and review of applications to receive grants from the program; and

             (3) Consider and approve or disapprove applications for grants from the program.

      2.  As used in this section, “child” means a person 24 years of age or younger.

INTERNET ACCESS BY PUPILS AT HOME

      NRS 385.800  Duties of Office of Science, Innovation and Technology.

      1.  The Office of Science, Innovation and Technology established by NRS 223.600 shall:

      (a) In consultation with the board of trustees of each school district, develop a standardized, statewide system of gathering data from pupils and their families to assess the ability of pupils to access the Internet at their homes. The statewide system must:

             (1) Be able to be replicated each year;

             (2) Be developed with consideration of existing processes and systems for gathering data on pupils and their families and, to the greatest extent possible, use such processes and systems;

             (3) Provide data on access to the Internet at the permanent or temporary address of a pupil; and

             (4) To the extent authorized by the Family Educational Rights and Privacy Act of 1974, 20 U.S.C. § 1232g, and any regulations adopted pursuant thereto, be able to disaggregate data based on the name of the pupil, the name of the family of the pupil and other appropriate personally identifiable information.

      (b) Develop a method to share the data gathered pursuant to paragraph (a), to the extent authorized by the Family Educational Rights and Privacy Act of 1974, 20 U.S.C. § 1232g, and any regulations adopted pursuant thereto, with providers of telecommunications networks, services or equipment interested in providing access to the Internet to pupils who lack access to the Internet at their homes.

      (c) Develop recommendations for minimum standards for telecommunications technology owned by a school or school district that will best ensure the capability of the telecommunications technology to connect to the Internet. The recommendations must, without limitation:

             (1) Evaluate the connectivity capabilities of the telecommunications technology and not other features, including, without limitation, processing power and memory;

             (2) Require the telecommunications technology to connect to wireless fidelity, fixed wireless and mobile wireless Internet; and

             (3) Include a list of recommended telecommunications technology that meets the recommended standards.

      (d) Review each report submitted by the board of trustees of a school district and the State Public Charter School Authority pursuant to NRS 385.810 and, based on the review:

             (1) Conduct an analysis to identify any gaps in access to the Internet which must, without limitation:

                   (I) Disaggregate any data by school district, charter school, the number of pupils who lack access to the Internet and the number of pupils who lack access to telecommunications technology;

                   (II) Review data gathered in response to the public-health crisis caused by the COVID-19 pandemic; and

                   (III) To the greatest extent possible, use existing mechanisms for gathering data;

             (2) Develop a fiscal plan to close gaps in access to the Internet and gaps in access to telecommunications technology which may include, without limitation, use of the Lifeline program of the Federal Communications Commission, or its successor program, the Emergency Broadband Benefit program of the Federal Communications Commission, or its successor program, or the Schools and Libraries Universal Service Support program of the Federal Communications Commission, or its successor program; and

             (3) Develop a plan to assess the speed of uploads and downloads on telecommunications technology to determine the number of pupils who have access to the Internet but lack sufficient speeds to participate in remote learning.

      2.  In carrying out its duties pursuant to subsection 1, the Office shall work with:

      (a) Private sector providers of telecommunications networks, services or equipment to understand the data and guarantees of payment that may be required to connect to the Internet pupils who lack access to the Internet at their homes;

      (b) Persons and entities who can inform the Office on current and future standards for wireless fidelity, fixed wireless and mobile wireless Internet and spectrum availability and provide recommendations on the features a telecommunications technology must have to connect with existing and future broadband networks;

      (c) Persons and entities who can provide information on delivery of access to the Internet that, to the greatest extent possible, will use existing firewall and filter services provided by a school district or charter school;

      (d) Persons and entities who can provide information on gathering data, data privacy and laws and regulations on data-sharing that could affect the efforts of the Office to identify and provide access to the Internet to pupils who lack access to the Internet at their homes; and

      (e) Persons and entities, including, without limitation, the Department of Health and Human Services, who can provide information on programs that may be used to provide access to the Internet to pupils who lack access to the Internet at their homes.

      3.  The Department and the Office may adopt any regulations necessary to carry out the provisions of this section.

      4.  As used in this section, “telecommunications technology” includes, without limitation, a laptop computer or tablet device.

      NRS 385.810  Submission of reports by boards of trustees of school districts and State Public Charter School Authority.

      1.  On or before November 1 of each year, the board of trustees of each school district and the State Public Charter School Authority shall submit a report to the Office of Science, Technology and Innovation in a manner prescribed by the Office. The report must include:

      (a) The number of pupils who lack access to the Internet at their homes and, to the extent authorized by the Family Educational Rights and Privacy Act of 1974, 20 U.S.C. § 1232g, and any regulations adopted pursuant thereto, the addresses of such pupils;

      (b) The number of pupils who use a hotspot provided by the school district or charter school to access the Internet;

      (c) The number of pupils who lack access to telecommunications technology that is capable of facilitating remote learning;

      (d) The number of pupils who lack both access to the Internet and access to telecommunications technology; and

      (e) The current requirements of the board of trustees of the school district or the State Public Charter School Authority for telecommunications technology owned by the school district, a school within the school district, the State Public Charter School Authority or a charter school sponsored by the State Public Charter School Authority.

      2.  As used in this section, “telecommunications technology” includes, without limitation, a laptop computer or tablet device.

      NRS 385.820  Annual report of Office of Science, Innovation and Technology.

      1.  On or before February 1 of each year, the Office of Science, Innovation and Technology shall prepare an annual report concerning the status of the Office in carrying out its duties prescribed by NRS 385.800 and submit the report to the Governor, the State Board and:

      (a) In odd-numbered years, to the Director of the Legislative Counsel Bureau for transmittal to the Senate and Assembly Standing Committees on Education.

      (b) In even-numbered years, to the Joint Interim Standing Committee on Education.

      2.  The Office shall post a copy of the report prepared pursuant to subsection 1 on the Internet website maintained by the Office.

COMMISSION ON INNOVATION AND EXCELLENCE IN EDUCATION

      NRS 385.900  “Commission” defined.  As used in this section and NRS 385.910 and 385.920, unless the context otherwise requires, “Commission” means the Commission on Innovation and Excellence in Education created by NRS 385.910.

      (Added to NRS by 2023, 2445)

      NRS 385.910  Creation; appointment of members; terms; required meetings; appointment of subcommittees; administrative support.

      1.  The Commission on Innovation and Excellence in Education is hereby created. The Commission consists of:

      (a) Three members who are Senators, two of whom are appointed by the Majority Leader of the Senate and one of whom is appointed by the Minority Leader of the Senate;

      (b) Three members who are members of the Assembly, two of whom are appointed by the Speaker of the Assembly and one of whom is appointed by the Minority Leader of the Assembly;

      (c) The Superintendent of Public Instruction;

      (d) The Director of the Office of Finance;

      (e) The Chancellor of the Nevada System of Higher Education;

      (f) One member who is a representative of the State Board of Education, appointed by the President of the State Board;

      (g) One member who is a teacher and member of the Nevada State Education Association, appointed by the President of that Association;

      (h) One member who is a teacher and member of the Clark County Education Association, appointed by the President of that Association;

      (i) One member appointed by the Nevada Association of School Administrators;

      (j) One member who is a member of the board of trustees of a school district, appointed by the Nevada Association of School Boards;

      (k) One member who is a superintendent of schools of a school district, appointed by the Nevada Association of School Superintendents;

      (l) One member who is the chief financial officer of a school district, appointed by the Association of School Business Officials International;

      (m) One member appointed by the Nevada Association of Counties;

      (n) One member appointed by the Nevada League of Cities;

      (o) One member who is the representative of an organization that advocates for public education, appointed by the Superintendent of Public Instruction;

      (p) One member who is the parent or guardian of a pupil who is enrolled in a public school in this State, appointed by the Nevada Parent Teacher Association;

      (q) One member who is a representative of the public at large, appointed by the Governor;

      (r) Two members who own or manage a business located in this State, appointed by the Governor; and

      (s) One member who serves on the Commission on School Funding created by NRS 387.1246.

      2.  In appointing the members of the Commission described in paragraphs (g) and (h) of subsection 1, the appointing authorities shall coordinate the appointments so that:

      (a) One member is a teacher in an elementary school and one member is a teacher in a secondary school, respectively; and

      (b) One member is a teacher in a public school in an urban setting and one member is a teacher in a public school in a rural setting, respectively.

Ê The appointing authorities shall, in appointing a member at the beginning of each term, alternate the characteristics described in paragraphs (a) and (b) so that each member appointed to the Commission does not possess the same characteristic in consecutive terms.

      3.  If any organization listed in subsection 1 ceases to exist, the appointment required pursuant to that subsection must be made by the organization’s successor in interest or, if there is no successor in interest, by the Governor.

      4.  In appointing the members of the Commission described in subsection 1, the appointing authorities shall coordinate the appointments when practicable so that the members of the Commission represent the diversity of this State, including, without limitation, regional, ethnic, economic and gender diversity.

      5.  Each member of the Commission:

      (a) Serves without compensation; and

      (b) While engaged in the business of the Commission, is entitled to receive the travel expenses provided for state officers and employees generally.

      6.  Each appointed member of the Commission serves a term of 2 years and may be reappointed for additional terms of 2 years in the same manner as the original appointment. Any vacancy occurring in the membership of the Commission must be filled in the same manner as the original appointment not later than 30 days after the vacancy occurs.

      7.  The Superintendent of Public Instruction shall call the first meeting of the Commission. At its first meeting and annually thereafter, the members of the Commission shall elect a Chair and a Vice Chair from among the members of the Commission.

      8.  The Commission shall meet at least once each calendar quarter and as needed at the call of the Chair.

      9.  The Commission may appoint subcommittees to address designated projects or consider specific problems or other matters that are related to and within the scope of the functions of the Commission, as the Commission determines necessary to carry out the duties of the Commission.

      10.  The Department shall provide any administrative support necessary for the Commission to carry out its duties.

      NRS 385.920  Duties.

      1.  The Commission shall develop a statewide vision and implementation plan to improve the public education system in this State. The Commission shall:

      (a) Conduct a benchmarking or gap analysis study comparing the education policies of this State to the education policies of high-performing international and domestic education systems.

      (b) Make recommendations on how to adapt the appropriate education policies of high-performing international and domestic education systems into the public education system in this State.

      (c) Identify objectives to put the education performance of pupils in this State in parity with that of pupils in high-performing international and domestic education systems and make recommendations on how to meet the identified objectives.

      (d) Review the findings of any previous or ongoing studies related to the funding of education and incorporate any relevant findings.

      (e) Develop an implementation plan for the recommendations made pursuant to this section which includes an analysis of the costs of the plan.

      2.  The Commission may employ and contract with the National Center on Education and the Economy or an organization with similar expertise and qualifications to carry out any of its functions pursuant to this section.

      3.  The Commission may coordinate with educational entities and business entities for information and expertise as necessary to carry out any of its functions pursuant to this section.

      4.  On or before June 30 of each year, the Commission shall submit a written report of its findings to the Governor, the Superintendent of Public Instruction, the Legislative Commission and the Joint Interim Standing Committee on Education.
