Employee Misclassification (S.C.R. 26)
Summary
The Legislative Commission's Subcommittee to Study Employee Misclassification will evaluate the issue of workers who are improperly classified as independent contractors rather than as employees. Such workers may not receive protections and benefits to which they would otherwise be entitled as employees, and employers may fail to pay taxes they would otherwise be required to pay. The Subcommittee will evaluate the economic impact of employee misclassification, methods of identifying misclassification, potential penalties to employers, and legal recourse for employees. The Subcommittee is comprised of five members: two legislators and three representatives of the construction industry, labor, and the general public.
