NRS 304.010 Nomination and election. At the primary and general election next preceding the expiration of the time for which any United States Senator was elected or appointed to represent the State of Nevada in the United States Senate, candidates for United States Senator may be nominated and elected in the same manner as provided by law for the nomination and election of state officers.

NRS 304.030 Governor to appoint qualified person upon vacancy in office. In case of a vacancy in the office of United States Senator caused by death, resignation or otherwise, the Governor may appoint some qualified person to fill the vacancy who is a member of the same political party as the former Senator and was a member of that party for at least 90 days immediately preceding the creation of the vacancy, who shall hold office until the next general election and until his or her successor shall be elected and seated.

Nomination and Election

NRS 304.040 Nomination of candidates; exception. Except as otherwise provided in NRS 304.230 and 304.240, party candidates for Representative in Congress shall be nominated in the same manner as state officers are nominated.

NRS 304.050 Election.

1. At the general election in each even-numbered year, there shall be elected the number of Representatives in the Congress of the United States to which the State of Nevada is entitled.

2. Representatives in Congress shall be elected by the registered voters of their respective districts.

Districts Based on 2020 Census

NRS 304.060 Definitions. As used in NRS 304.060 to 304.095, inclusive, unless the context otherwise requires:

1. “Block” means the smallest geographical unit whose boundaries were designated by the Bureau of the Census of the United States Department of Commerce in its topographically integrated geographic encoding and referencing system.

2. “Block group” means a combination of blocks whose numbers begin with the same digit.

3. “Census tract” means a combination of block groups.

4. “State Demographer” means the demographer employed by the Department of Taxation pursuant to NRS 360.283.

NRS 304.065 Certain population counts involving state inmates must be used for apportionment of congressional districts. The population counts for every block, block group and census tract as revised by the State Demographer pursuant to NRS 360.288 must be used for the apportionment of congressional districts.

NRS 304.070 Copies of maps of congressional districts: Duties of Director of Legislative Counsel Bureau. The Director of the Legislative Counsel Bureau shall:

1. File a copy of the shapefile adopted by NRS 304.095 with the Secretary of State.

2. Retain in an office of the Legislative Counsel Bureau, copies of maps of the congressional districts described in the shapefile adopted by NRS 304.095.

3. Make available copies of the maps to any interested person for a reasonable fee, not to exceed the actual costs of producing copies of the maps.

4. File a copy of the maps with the Secretary of State.

NRS 304.080 Copies of shapefile and maps of congressional districts: Duties of Secretary of State. The Secretary of State shall:

1. Provide to the clerk of each county and the clerk of Carson City, copies of the shapefile filed pursuant to subsection 1 of NRS 304.070 and maps filed pursuant to subsection 4 of NRS 304.070.

2. Make available copies of the shapefile and maps to any interested person for a reasonable fee, not to exceed the actual costs of producing copies of the shapefile or maps.

NRS 304.090 Omitted area: Attachment to appropriate congressional district.

1. If any area of this State is omitted from the shapefile adopted by NRS 304.095 inadvertently or by virtue of the complexities of the information supplied to the Legislature, the county clerk, the Carson City clerk or the Director of the Legislative Counsel Bureau, upon discovery of the omission, shall notify the Secretary of State of the omission. The Secretary of State shall attach that area to the appropriate congressional district as follows:

(a) If the area is surrounded by a congressional district, the area must be attached to that district.

(b) If the area is contiguous to two or more congressional districts, the area must be attached to the district that has the least population.

2. Any attachments made pursuant to the provisions of this section must be certified in writing and filed with the Director of the Legislative Counsel Bureau and with the Secretary of State. No change may be made in any attachments until the districts are again reapportioned.

NRS 304.095 Adoption of congressional districts.

1. The shapefile identified as “2021Congressional_Final_SB1_Amd2,” filed with the Secretary of State pursuant to NRS 304.070, is hereby adopted to describe the congressional districts in this State.

2. The congressional districts described in the shapefile adopted by subsection 1 are hereby created.

Special Election to Fill Vacancy

NRS 304.230 Governor to issue election proclamation; when special elections are to be conducted; consolidation with other elections; cost of special elections if not consolidated.

1. In the event of a vacancy in the office of Representative in Congress, the Governor shall, within 7 days after the event giving rise to the vacancy, issue an election proclamation calling for:

(a) A special primary election to be held for selecting the nominee of each major political party for the office of Representative in Congress; and

(b) A special general election to fill the vacancy in the office of Representative in Congress.

2. The Governor shall specify the dates of the special primary election and the special general election in the proclamation. The special primary election must be held not less than 60 days before the date of the special general election.

3. A special primary election and a special general election must be conducted:

(a) As soon as practicable after the issuance of the proclamation but with sufficient time to comply with the provisions of chapter 293D of NRS and the Uniformed and Overseas Citizens Absentee Voting Act, 52 U.S.C. §§ 20301 et seq.;

(b) On a Tuesday; and

4. A special primary election or special general election required pursuant to subsection 1 may be consolidated with a statewide election or local election scheduled to be conducted within 90 days after the issuance of the proclamation. The special primary election or special general election may be consolidated with a local election occurring wholly or partially within the same territory in which the vacancy exists only if the voters eligible to vote in the local election comprise at least 50 percent of all voters eligible to vote on the vacancy. If a special primary election or a special general election is not consolidated with a statewide election or local election, the cost of the special primary election or special general election is a charge against the State and must be paid from the Reserve for Statutory Contingency Account upon recommendation by the Secretary of State and approval of the State Board of Examiners.

1. A person who wants to be a candidate at a special primary election called pursuant to NRS 304.230 must file a declaration of candidacy with the appropriate filing officer and pay the filing fee required by NRS 293.193 within the time prescribed by the Secretary of State pursuant to NRS 293.204, which must be established to allow a sufficient amount of time to comply with the provisions of chapter 293D of NRS and the Uniformed and Overseas Citizens Absentee Voting Act, 52 U.S.C. §§ 20301 et seq.

2. A candidate of a major political party is nominated at the special primary election.

3. A minor political party that wishes to place its candidates on the ballot at the special general election must file a list of its candidates with the Secretary of State not later than the day following the special primary election.

4. To have his or her name appear on the ballot at the special general election, an independent candidate must file a petition of candidacy with the appropriate filing officer not later than the day following the special primary election.

5. Except as otherwise provided in this section and NRS 304.230:

(a) The special primary election and special general election must be conducted pursuant to the provisions of chapter 293 of NRS.

(b) The general election laws of this State apply to the special primary election and the special general election.

NRS 304.250 Regulations. The Secretary of State shall adopt such regulations as are necessary for conducting special elections pursuant to the provisions of NRS 304.230 and 304.240.
