AN ACT relating to county government; authorizing the board of county commissioners of a county, under certain circumstances, to adopt an ordinance providing that the office of county recorder of the county will be filled and its duties performed ex officio by another elected officer of the county; setting forth certain requirements pertaining to an officer of a county who serves ex officio as the county recorder of the county; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. NRS 247.010 is hereby amended to read as follows:

1-2  247.010  1.  Except as otherwise provided in subsection 3,

1-3  county recorders must be elected by the qualified electors of their

1-4  respective counties.

1-5  2.  County recorders must be chosen by the electors of their

1-6  respective counties at the general election in 1922, and at the

1-7  general election every 4 years thereafter, and shall enter upon the

1-8  duties of their respective offices on the [1st] first Monday of

1-9  January subsequent to their election.


2-1  3.  [The clerk of Carson City] If the board of county

2-2  commissioners of a county determines that the functions of the

2-3  office of county recorder are likely to be performed more

2-4  efficiently by combining those functions with the functions of

2-5  another elective office and assigning the functions of the office of

2-6  county recorder to another elected officer of the county, the board

2-7  may adopt an ordinance providing that such other elected officer

2-8  is ex officio the county recorder of [Carson City.] the county.

2-9  4.  An elected officer of a county who is declared by ordinance

2-10  adopted pursuant to subsection 3 to be ex officio the county

2-11  recorder of the county:

2-12      (a) Is not entitled to receive additional compensation for acting

2-13  in the capacity of county recorder of the county; and

2-14      (b) Shall, when acting in the capacity of county recorder of the

2-15  county, comply with the provisions of this chapter and of all other

2-16  laws of this state relating to county recorders.

2-17      5.  An ordinance adopted pursuant to subsection 3 must not

2-18  take effect until the earlier of:

2-19      (a) The expiration of the current term of the person serving as

2-20  county recorder of the county; or

2-21      (b) A vacancy occurring in the office of county recorder of the

2-22  county.

2-23      Sec. 2.  NRS 281.010 is hereby amended to read as follows:

2-24      281.010  1.  The following officers must be elected:

2-25      (a) A Governor.

2-26      (b) A Lieutenant Governor.

2-27      (c) Two United States Senators.

2-28      (d) The number of members of the House of Representatives of

2-29  the United States to which this state may be entitled.

2-30      (e) The number of presidential electors to which this state may

2-31  be entitled.

2-32      (f) Justices of the Supreme Court.

2-33      (g) District judges.

2-34      (h) Senators and members of the Assembly.

2-35      (i) A Secretary of State.

2-36      (j) A State Treasurer.

2-37      (k) A State Controller.

2-38      (l) An Attorney General.

2-39      (m) Other officers whose elections are provided for by law.

2-40      (n) For each county, and the equivalent officers for Carson City:

2-41          (1) One county clerk, who is ex officio clerk of the board of

2-42  county commissioners and clerk of the district court of his county.

2-43          (2) One sheriff.

2-44          (3) One district attorney.


3-1       (4) One public administrator, except where otherwise

3-2  provided by law.

3-3       (5) One county assessor, except where otherwise provided by

3-4  law.

3-5       (6) One county treasurer, except where otherwise provided

3-6  by law.

3-7       (7) The number of county commissioners as provided by

3-8  law.

3-9       (8) One county recorder, except where otherwise provided

3-10  by law, who is ex officio county auditor of his county if a county

3-11  comptroller has not been appointed in his county.

3-12          (9) Justices of the peace.

3-13          (10) Constables, except where otherwise provided by law.

3-14      2.  All officers who are not elected must be appointed.

3-15      Sec. 3.  Unless and until the Board of Supervisors of Carson

3-16  City adopts an ordinance to the contrary, the Board shall be deemed

3-17  to have adopted an ordinance providing that the Clerk of Carson

3-18  City is ex officio the Recorder of Carson City.

3-19      Sec. 4.  This act becomes effective on July 1, 2003.
