AN ACT relating to elections; creating the Election Fund in the State Treasury to receive money pursuant to the Help America Vote Act of 2002; prescribing conditions for the receipt and use of money in the Fund; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. Chapter 293 of NRS is hereby amended by adding

1-2  thereto a new section to read as follows:

1-3  1.  As used in this section, “Act” means the Help America

1-4  Vote Act of 2002, Public Law 107-252.

1-5  2.  The Election Fund is hereby created as a special revenue

1-6  fund in the State Treasury, to be administered by the Secretary of

1-7  State. The Secretary of State shall deposit all money received

1-8  pursuant to the Act and any state appropriation of matching

1-9  money pursuant to the Act in the Election Fund.

1-10      3.  The interest and income earned on money in the Election

1-11  Fund must be credited to the Fund. Any balance of the money that

1-12  was received pursuant to the Act remaining in the Election Fund

1-13  at the end of a fiscal year does not revert and must be carried

1-14  forward to the next fiscal year and is continuously available to the

1-15  Secretary of State for expenditure consistent with this section.


2-1  4.  The Secretary of State may:

2-2  (a) Only expend or disburse money in the Election Fund in

2-3  accordance with the provisions of the Act.

2-4  (b) Receive and disburse money in the Election Fund by

2-5  electronic transfer.

2-6  5.  Claims against the Election Fund must be paid as other

2-7  claims against the State are paid.

2-8  Sec. 2.  1.  The Secretary of State is hereby authorized to

2-9  expend not more than $5,000,000 from the Election Fund created by

2-10  section 1 of this act for the purposes of implementing Title 1 of the

2-11  Help America Vote Act of 2002 (42 U.S.C. §§ 15301 to 15306).

2-12      2.  Upon expenditure of the money authorized by subsection 1,

2-13  the Secretary of State shall provide a report to the Interim Finance

2-14  Committee that provides a detailed accounting of the manner in

2-15  which the money was expended.

2-16      Sec. 3.  This act becomes effective upon passage and approval.
