AN ACT relating to elections; creating the Election Fund in the State Treasury to receive money pursuant to the Help America Vote Act of 2002; prescribing conditions for the receipt and use of money in the Fund; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 293 of NRS is hereby amended by adding
1-2 thereto a new section to read as follows:
1-3 1. As used in this section, “Act” means the Help America
1-4 Vote Act of 2002, Public Law 107-252.
1-5 2. The Election Fund is hereby created as a special revenue
1-6 fund in the State Treasury, to be administered by the Secretary of
1-7 State. The Secretary of State shall deposit all money received
1-8 pursuant to the Act and any state appropriation of matching
1-9 money pursuant to the Act in the Election Fund. All money which
1-10 is deposited or paid into this Fund is hereby appropriated to the
1-11 Secretary of State.
1-12 3. The interest and income earned on money in the Election
1-13 Fund must be credited to the Fund. Any balance of the money that
1-14 was received pursuant to the Act remaining in the Election Fund
1-15 at the end of a fiscal year does not revert and must be carried
2-1 forward to the next fiscal year and is continuously available to the
2-2 Secretary of State for expenditure consistent with this section.
2-3 4. The Secretary of State may:
2-4 (a) Expend or disburse money in the Election Fund in
2-5 accordance with the provisions of the Act.
2-6 (b) Receive and disburse money in the Election Fund by
2-7 electronic transfer.
2-8 5. Claims against the Election Fund must be paid as other
2-9 claims against the State are paid.
2-10 Sec. 2. This act becomes effective upon passage and approval.
