AN ACT relating to professions; declaring the practice of counseling problem gamblers to be a learned profession; changing the name of the Board of Examiners for Alcohol and Drug Abuse Counselors to the Board of Examiners for Alcohol, Drug and Gambling Counselors; increasing the number of members on the Board; requiring persons who counsel problem gamblers to be certified by the Board; imposing certain fees; authorizing the Board to adopt certain regulations; providing a penalty; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. NRS 622.010 is hereby amended to read as follows:

1-2  622.010  As used in this chapter, unless the context otherwise

2-38      Sec. 2.  NRS 641.029 is hereby amended to read as follows:

2-39      641.029  The provisions of this chapter do not apply to:

2-40      1.  A physician who is licensed to practice in this state;

2-41      2.  A person who is licensed to practice dentistry in this state;

2-42      3.  A person who is licensed as a marriage and family therapist

2-43  pursuant to chapter 641A of NRS;

2-44      4.  A person who is licensed to engage in social work pursuant

2-45  to chapter 641B of NRS;


3-1  5.  A person who is licensed as an occupational therapist or

3-2  occupational therapy assistant pursuant to NRS 640A.010 to

3-3  640A.230, inclusive;

3-4  6.  A person who is licensed or certified as an alcohol and drug

3-5  abuse counselor or certified as an alcohol and drug abuse counselor

3-6  intern , a problem gambling counselor or a problem gambling

3-7  counselor intern pursuant to chapter 641C of NRS; or

3-8  7.  Any clergyman,

3-9  if such a person does not commit an act described in NRS 641.440

3-10  or represent himself as a psychologist.

3-11      Sec. 3.  NRS 641B.040 is hereby amended to read as follows:

3-12      641B.040  The provisions of this chapter do not apply to:

3-13      1.  A physician who is licensed to practice in this state;

3-14      2.  A nurse who is licensed to practice in this state;

3-15      3.  A person who is licensed as a psychologist pursuant to

3-16  chapter 641 of NRS;

3-17      4.  A person who is licensed as a marriage and family therapist

3-18  pursuant to chapter 641A of NRS;

3-19      5.  A person who is licensed as an occupational therapist or

3-20  occupational therapy assistant pursuant to NRS 640A.010 to

3-21  640A.230, inclusive;

3-22      6.  A person who is licensed or certified as an alcohol and drug

3-23  abuse counselor or certified as an alcohol and drug abuse counselor

3-24  intern , a problem gambling counselor or a problem gambling

3-25  counselor intern pursuant to chapter 641C of NRS;

3-26      7.  Any clergyman;

3-27      8.  A county welfare director;

3-28      9.  Any person who may engage in social work or clinical social

3-29  work in his regular governmental employment but does not hold

3-30  himself out to the public as a social worker; or

3-31      10.  A student of social work and any other person preparing for

3-32  the profession of social work under the supervision of a qualified

3-33  social worker in a training institution or facility recognized by the

3-34  Board, unless the student or other person has been issued a

3-35  provisional license pursuant to paragraph (b) of subsection 1 of NRS

3-36  641B.275. Such a student must be designated by the title “student of

3-37  social work” or “trainee in social work,” or any other title which

3-38  clearly indicates his training status.

3-39      Sec. 4. Chapter 641C of NRS is hereby amended by adding

3-40  thereto the provisions set forth as sections 5 to 9, inclusive, of this

3-41  act.

3-42      Sec. 5.  “Practice of counseling problem gamblers” means

3-43  the application of counseling to reduce or eliminate problem

3-44  gambling.


4-1  Sec. 6.  “Problem gambling” means persistent and recurrent

4-2  maladaptive behavior relating to gambling that causes disruptions

4-3  in any major area of life, including, without limitation, the

4-4  psychological, social or vocational areas of life.

4-5  Sec. 7.  The Board may issue a certificate as a problem

4-6  gambling counselor to:

4-7  1.  A person who:

4-8  (a) Is not less than 21 years of age;

4-9  (b) Is a citizen of the United States or is lawfully entitled to

4-10  remain and work in the United States;

4-11      (c) Has received a bachelor’s degree, master’s degree or a

4-12  doctoral degree from an accredited college or university in a field

4-13  of social science approved by the Board;

4-14      (d) Has completed not less than 60 hours of training specific to

4-15  problem gambling approved by the Board;

4-16      (e) Has completed at least 2,000 hours of supervised

4-17  counseling of problem gamblers in a setting approved by the

4-18  Board;

4-19      (f) Passes the written examination prescribed by the Board

4-20  pursuant to NRS 641C.290;

4-21      (g) Presents himself when scheduled for an interview at a

4-22  meeting of the Board;

4-23      (h) Pays the fees required pursuant to NRS 641C.470; and

4-24      (i) Submits the statement required pursuant to NRS 641C.280.

4-25      2.  A person who:

4-26      (a) Is not less than 21 years of age;

4-27      (b) Is a citizen of the United States or is lawfully entitled to

4-28  remain and work in the United States;

4-29      (c) Is licensed as:

4-30          (1) A clinical social worker pursuant to chapter 641B of

4-31  NRS;

4-32          (2) A marriage and family therapist pursuant to chapter

4-33  641A of NRS;

4-34          (3) A physician pursuant to chapter 630 of NRS;

4-35          (4) A nurse pursuant to chapter 632 of NRS and has

4-36  received a master’s degree or a doctoral degree from an accredited

4-37  college or university;

4-38          (5) A psychologist pursuant to chapter 641 of NRS; or

4-39          (6) An alcohol and drug abuse counselor pursuant to this

4-40  chapter;

4-41      (d) Has completed not less than 60 hours of training specific to

4-42  problem gambling approved by the Board;

4-43      (e) Has completed at least 1,000 hours of supervised

4-44  counseling of problem gamblers in a setting approved by the

4-45  Board;


5-1  (f) Passes the written examination prescribed by the Board

5-2  pursuant to NRS 641C.290;

5-3  (g) Pays the fees required pursuant to NRS 641C.470; and

5-4  (h) Submits the statement required pursuant to NRS 641C.280.

5-5  Sec. 8. 1.  A certificate as a problem gambling counselor is

5-6  valid for 2 years and may be renewed.

5-7  2.  A certified problem gambling counselor may:

5-8  (a) Engage in the practice of counseling problem gamblers;

5-9  (b) Assess and evaluate a person as a problem gambler; and

5-10      (c) If approved by the Board, supervise certified problem

5-11  gambling counseling interns.

5-12      Sec. 9.  1.  The Board may issue a certificate as a problem

5-13  gambling counselor intern to a person who:

5-14      (a) Is not less than 21 years of age;

5-15      (b) Is a citizen of the United States or is lawfully entitled to

5-16  remain and work in the United States;

5-17      (c) Submits proof to the Board that he:

5-18          (1) Has received a bachelor’s degree, master’s degree or a

5-19  doctoral degree from an accredited college or university in a field

5-20  of social science approved by the Board; or

5-21          (2) Is enrolled in a program at an accredited college or

5-22  university from which he will receive a bachelor’s degree, master’s

5-23  degree or a doctoral degree in a field of social science approved by

5-24  the Board;

5-25      (d) Has completed not less than 30 hours of training specific to

5-26  problem gambling approved by the Board;

5-27      (e) Demonstrates that a certified problem gambling counselor

5-28  approved by the Board has agreed to supervise him in a setting

5-29  approved by the Board;

5-30      (f) Pays the fees required pursuant to NRS 641C.470; and

5-31      (g) Submits the statement required pursuant to NRS 641C.280.

5-32      2.  A certificate as a problem gambling counselor intern is

5-33  valid for 1 year and, except as otherwise provided in subsection 3,

5-34  may be renewed.

5-35      3.  A certificate as a problem gambling counselor intern

5-36  issued to a person on the basis that he is enrolled in a program at

5-37  an accredited college or university from which he will receive a

5-38  bachelor’s degree, master’s degree or a doctoral degree in a field

5-39  of social science approved by the Board may be renewed not more

5-40  than nine times.

5-41      4.  A certified problem gambling counselor intern may, under

5-42  the supervision of a certified problem gambling counselor:

5-43      (a) Engage in the practice of counseling problem gamblers;

5-44  and

5-45      (b) Assess and evaluate a person as a problem gambler.


6-1  Sec. 10.  NRS 641C.010 is hereby amended to read as follows:

6-2  641C.010  The practice of counseling alcohol and drug abusers

6-3  [is] and the practice of counseling problem gamblers are hereby

6-4  declared to be [a learned profession,] learned professions affecting

6-5  public health, safety and welfare and [is] are subject to regulation to

6-6  protect the public from the practice of counseling alcohol and drug

6-7  abusers and the practice of counseling problem gamblers by

6-8  unqualified persons and from unprofessional conduct by persons

6-9  who are licensed or certified to engage in the practice of counseling

6-10  alcohol and drug abusers[.] or certified to engage in the practice of

6-11  counseling problem gamblers.

6-12      Sec. 11.  NRS 641C.020 is hereby amended to read as follows:

6-13      641C.020  As used in this chapter, unless the context otherwise

6-14  requires, the words and terms defined in NRS 641C.030 to

6-15  641C.100, inclusive, and sections 5 and 6 of this act have the

6-16  meanings ascribed to them in those sections.

6-17      Sec. 12.  NRS 641C.030 is hereby amended to read as follows:

6-18      641C.030  “Board” means the Board of Examiners for Alcohol

6-19  [and Drug Abuse] , Drug and Gambling Counselors.

6-20      Sec. 13.  NRS 641C.040 is hereby amended to read as follows:

6-21      641C.040  “Certificate” means a certificate issued to a person

6-22  who is certified as an alcohol and drug abuse counselor , [or] an

6-23  alcohol and drug abuse counselor intern[.] , a problem gambling

6-24  counselor or a problem gambling counselor intern.

6-25      Sec. 14.  NRS 641C.050 is hereby amended to read as follows:

6-26      641C.050  “Certified counselor” means a person who is

6-27  certified as an alcohol and drug abuse counselor or a problem

6-28  gambling counselor pursuant to the provisions of this chapter.

6-29      Sec. 15.  NRS 641C.060 is hereby amended to read as follows:

6-30      641C.060  “Certified intern” means a person who is certified as

6-31  an alcohol and drug abuse counselor intern or a problem gambling

6-32  counselor intern pursuant to the provisions of this chapter.

6-33      Sec. 16.  NRS 641C.130 is hereby amended to read as follows:

6-34      641C.130  The provisions of this chapter do not apply to:

6-35      1.  A physician who is licensed pursuant to the provisions of

6-36  chapter 630 of NRS;

6-37      2.  A nurse who is licensed pursuant to the provisions of chapter

6-38  632 of NRS and is authorized by the State Board of Nursing to

6-39  engage in the practice of counseling alcohol and drug abusers[;] or

6-40  the practice of counseling problem gamblers;

6-41      3.  A psychologist who is licensed pursuant to the provisions of

6-42  chapter 641 of NRS;

6-43      4.  A marriage and family therapist who is licensed pursuant to

6-44  the provisions of chapter 641A of NRS and is authorized by the

6-45  Board of Examiners for Marriage and Family Therapists to engage


7-1  in the practice of counseling alcohol and drug abusers[;] or the

7-2  practice of counseling problem gamblers; or

7-3  5.  A person who is licensed as a clinical social worker pursuant

7-4  to the provisions of chapter 641B of NRS and is authorized by the

7-5  Board of Examiners for Social Workers to engage in the practice of

7-6  counseling alcohol and drug abusers[.] or the practice of

7-7  counseling problem gamblers.

7-8  Sec. 17.  NRS 641C.150 is hereby amended to read as follows:

7-9  641C.150  1.  The Board of Examiners for Alcohol [and Drug

7-10  Abuse] , Drug and Gambling Counselors, consisting of [five] seven

7-11  members appointed by the Governor, is hereby created.

7-12      2.  The Board must consist of:

7-13      (a) Three members who are licensed as alcohol and drug abuse

7-14  counselors pursuant to the provisions of this chapter;

7-15      (b) One member who is certified as an alcohol and drug abuse

7-16  counselor pursuant to the provisions of this chapter; [and]

7-17      (c) Two members who are licensed pursuant to chapter 630,

7-18  632, 641, 641A or 641B of NRS and certified as problem gambling

7-19  counselors pursuant to the provisions of this chapter; and

7-20      (d) One member who is a representative of the general public.

7-21      3.  A person may not be appointed to the Board unless he is:

7-22      (a) A citizen of the United States or is lawfully entitled to

7-23  remain and work in the United States; and

7-24      (b) A resident of this state.

7-25      4.  No member of the Board may be held liable in a civil action

7-26  for any act that he performs in good faith in the execution of his

7-27  duties pursuant to the provisions of this chapter.

7-28      Sec. 18.  NRS 641C.200 is hereby amended to read as follows:

7-29      641C.200  1.  The Board shall adopt such regulations as are

7-30  necessary to carry out the provisions of this chapter, including,

7-31  without limitation, regulations that prescribe:

7-32      [1.] (a) The ethical standards for licensed and certified

7-33  counselors and certified interns; and

7-34      [2.] (b) The requirements for continuing education for the

7-35  renewal, restoration or reinstatement of a license or certificate.

7-36      2.  The Board may adopt regulations that prescribe:

7-37      (a) The contents of a written examination concerning the

7-38  practice of counseling problem gamblers;

7-39      (b) The grounds for initiating disciplinary action against a

7-40  certified problem gambling counselor or certified problem

7-41  gambling counselor intern; and

7-42      (c) Disciplinary procedures for certified problem gambling

7-43  counselors and certified problem gambling counselor interns,

7-44  including the suspension, revocation and reinstatement of a


8-1  certificate as a problem gambling counselor or problem gambling

8-2  counselor intern.

8-3  Sec. 19.  NRS 641C.290 is hereby amended to read as follows:

8-4  641C.290  1.  Each applicant for a license or certificate as an

8-5  alcohol and drug abuse counselor must pass a written and oral

8-6  examination concerning his knowledge of the practice of counseling

8-7  alcohol and drug abusers, the applicable provisions of this chapter

8-8  and any applicable regulations adopted by the Board pursuant to the

8-9  provisions of this chapter.

8-10      2.  Each applicant for a certificate as a problem gambling

8-11  counselor must pass a written examination concerning his

8-12  knowledge of the practice of counseling problem gamblers, the

8-13  applicable provisions of this chapter and any applicable

8-14  regulations adopted by the Board pursuant to the provisions of this

8-15  chapter.

8-16      3.  The Board shall:

8-17      (a) Examine applicants at least two times each year.

8-18      (b) Establish the time and place for the examinations.

8-19      (c) Provide such books and forms as may be necessary to

8-20  conduct the examinations.

8-21      (d) Establish, by regulation, the requirements for passing the

8-22  examination.

8-23      [3.] 4. The Board may employ other persons to conduct the

8-24  examinations.

8-25      Sec. 20.  NRS 641C.450 is hereby amended to read as follows:

8-26      641C.450  Except as otherwise provided in NRS 641C.320[,]

8-27  and section 9 of this act, a person may renew his license or

8-28  certificate by submitting to the Board:

8-29      1.  An application for the renewal of his license or certificate;

8-30      2.  The fee for the renewal of a license or certificate prescribed

8-31  in NRS 641C.470;

8-32      3.  Evidence of his completion of the continuing education

8-33  required by the Board;

8-34      4.  If the applicant is a certified intern, the name of the licensed

8-35  or certified counselor who supervises him; and

8-36      5.  The statement required pursuant to NRS 641C.280.

8-37      Sec. 21.  NRS 641C.470 is hereby amended to read as follows:

8-38      641C.470  1.  The Board shall charge and collect not more

8-39  than the following fees:

 

8-40  For the initial application for a license or certificate  $150

8-41  For the issuance of a provisional license or certificate  125

8-42  For the issuance of an initial license or certificate  60


9-1  For the renewal of a license or certificate as an

9-2  alcohol and drug abuse counselor or a certificate as a

9-3  problem gambling counselor.......... $300

9-14      2.  The fees charged and collected pursuant to this section are

9-15  not refundable.

9-16      Sec. 22.  NRS 641C.900 is hereby amended to read as follows:

9-17      641C.900  1.  Except as otherwise provided in subsection 2, a

9-18  person shall not engage in the practice of counseling alcohol and

9-19  drug abusers or the practice of counseling problem gamblers

9-20  unless he is a licensed counselor, certified counselor or certified

9-21  intern.

9-22      2.  A person may engage in the practice of counseling alcohol

9-23  and drug abusers under the supervision of a licensed counselor or

9-24  the practice of counseling problem gamblers under the supervision

9-25  of a certified counselor for not more than 30 days if that person:

9-26      (a) Is qualified to be licensed or certified [as an alcohol and drug

9-27  abuse counselor or certified as an alcohol and drug abuse counselor

9-28  intern] pursuant to the provisions of this chapter; and

9-29      (b) Submits an application to the Board for a license or

9-30  certificate [as an alcohol and drug abuse counselor or a certificate as

9-31  an alcohol and drug abuse counselor intern] pursuant to the

9-32  provisions of this chapter.

9-33      Sec. 23.  NRS 641C.910 is hereby amended to read as follows:

9-34      641C.910  1.  A person shall not:

9-35      (a) Hold himself out to [the] a member of the general public as

9-36  an alcohol and drug abuse counselor , [or] alcohol and drug abuse

9-37  counselor intern[;] , problem gambling counselor or problem

9-38  gambling counselor intern;

9-39      (b) Use the title “alcohol and drug abuse counselor,” “alcohol

9-40  and drug abuse counselor intern,” “drug abuse counselor,”

9-41  “substance abuse counselor [] ,” “problem gambling counselor,”

9-42  “problem gambling counselor intern,” “gambling counselor” or

9-43  any similar title in connection with his work; or


10-1      (c) Imply in any way that he is licensed or certified by the

10-2  Board,

10-3  unless he is licensed or certified by the Board pursuant to the

10-4  provisions of this chapter.

10-5      2.  If the Board believes that any person has violated or is about

10-6  to violate the provisions of subsection 1, it may bring an action in a

10-7  court of competent jurisdiction to enjoin that person from engaging

10-8  in or continuing the violation. An injunction:

10-9      (a) May be issued without proof of actual damage sustained by

10-10  any person.

10-11     (b) Does not prevent the criminal prosecution and punishment of

10-12  a person who violates the provisions of subsection 1.

10-13     Sec. 24.  Section 7 of this act is hereby amended to read as

10-14  follows:

10-15     Sec. 7. The Board may issue a certificate as a problem

10-16  gambling counselor to:

10-17     1.  A person who:

10-18     (a) Is not less than 21 years of age;

10-19     (b) Is a citizen of the United States or is lawfully entitled

10-20  to remain and work in the United States;

10-21     (c) Has received a bachelor’s degree, master’s degree or a

10-22  doctoral degree from an accredited college or university in a

10-23  field of social science approved by the Board;

10-24     (d) Has completed not less than 60 hours of training

10-25  specific to problem gambling approved by the Board;

10-26     (e) Has completed at least 2,000 hours of supervised

10-27  counseling of problem gamblers in a setting approved by the

10-28  Board;

10-29     (f) Passes the written examination prescribed by the

10-30  Board pursuant to NRS 641C.290;

10-31     (g) Presents himself when scheduled for an interview at a

10-32  meeting of the Board; and

10-33     (h) Pays the fees required pursuant to NRS 641C.470 . [;

10-34  and

10-35     (i) Submits the statement required pursuant to

10-36  NRS 641C.280.]

10-37     2.  A person who:

10-38     (a) Is not less than 21 years of age;

10-39     (b) Is a citizen of the United States or is lawfully entitled

10-40  to remain and work in the United States;

10-41     (c) Is licensed as:

10-42         (1) A clinical social worker pursuant to chapter 641B

10-43  of NRS;

10-44         (2) A marriage and family therapist pursuant to

10-45  chapter 641A of NRS;


11-1          (3) A physician pursuant to chapter 630 of NRS;

11-2          (4) A nurse pursuant to chapter 632 of NRS and has

11-3  received a master’s degree or a doctoral degree from an

11-4  accredited college or university;

11-5          (5) A psychologist pursuant to chapter 641 of NRS; or

11-6          (6) An alcohol and drug abuse counselor pursuant to

11-7  this chapter;

11-8      (d) Has completed not less than 60 hours of training

11-9  specific to problem gambling approved by the Board;

11-10     (e) Has completed at least 1,000 hours of supervised

11-11  counseling of problem gamblers in a setting approved by the

11-12  Board;

11-13     (f) Passes the written examination prescribed by the

11-14  Board pursuant to NRS 641C.290; and

11-15     (g) Pays the fees required pursuant to NRS 641C.470 . [;

11-16  and

11-17     (h) Submits the statement required pursuant to

11-18  NRS 641C.280.]

11-19     Sec. 25.  Section 9 of this act is hereby amended to read as

11-20  follows:

11-21     Sec. 9. 1.  The Board may issue a certificate as a

11-22  problem gambling counselor intern to a person who:

11-23     (a) Is not less than 21 years of age;

11-24     (b) Is a citizen of the United States or is lawfully entitled

11-25  to remain and work in the United States;

11-26     (c) Submits proof to the Board that he:

11-27         (1) Has received a bachelor’s degree, master’s degree

11-28  or a doctoral degree from an accredited college or university

11-29  in a field of social science approved by the Board; or

11-30         (2) Is enrolled in a program at an accredited college or

11-31  university from which he will receive a bachelor’s degree,

11-32  master’s degree or a doctoral degree in a field of social

11-33  science approved by the Board;

11-34     (d) Has completed not less than 30 hours of training

11-35  specific to problem gambling approved by the Board;

11-36     (e) Demonstrates that a certified problem gambling

11-37  counselor approved by the Board has agreed to supervise him

11-38  in a setting approved by the Board; and

11-39     (f) Pays the fees required pursuant to NRS 641C.470 . [;

11-40  and

11-41     (g) Submits the statement required pursuant to

11-42  NRS 641C.280.]

11-43     2.  A certificate as a problem gambling counselor intern

11-44  is valid for 1 year and, except as otherwise provided in

11-45  subsection 3, may be renewed.


12-1      3.  A certificate as a problem gambling counselor intern

12-2  issued to a person on the basis that he is enrolled in a program

12-3  at an accredited college or university from which he will

12-4  receive a bachelor’s degree, master’s degree or a doctoral

12-5  degree in a field of social science approved by the Board may

12-6  be renewed not more than nine times.

12-7      4.  A certified problem gambling counselor intern may,

12-8  under the supervision of a certified problem gambling

12-9  counselor:

12-10     (a) Engage in the practice of counseling problem

12-11  gamblers; and

12-12     (b) Assess and evaluate a person as a problem gambler.

12-13     Sec. 26.  Notwithstanding the provisions of section 17 of this

12-14  act, each problem gambling counselor who is appointed to the Board

12-15  of Examiners for Alcohol, Drug and Gambling Counselors to an

12-16  initial term must be eligible for a certificate as a problem gambling

12-17  counselor but need not be certified pursuant to this chapter at the

12-18  time he is appointed to the Board.

12-19     Sec. 27.  As soon as practicable after January 1, 2004, the

12-20  Governor shall appoint to the Board of Examiners for Alcohol, Drug

12-21  and Gambling Counselors pursuant to paragraph (c) of subsection 2

12-22  of NRS 641C.150:

12-23     1.  One member whose term expires on September 30, 2005.

12-24     2.  One member whose term expires on September 30, 2007.

12-25     Sec. 28.  1.  This section becomes effective upon passage and

12-26  approval.

12-27     2.  Sections 18 and 19 of this act become effective upon

12-28  passage and approval for the purpose of adopting regulations and on

12-29  January 1, 2004, for all other purposes.

12-30     3.  Sections 1 to 17, inclusive, 20 to 23, inclusive, 26 and 27 of

12-31  this at become effective on January 1, 2004.

12-32     4.  Sections 24 and 25 of this act become effective on the date

12-33  on which the provisions of 42 U.S.C. § 666 requiring each state to

12-34  establish procedures under which the state has authority to withhold

12-35  or suspend, or to restrict the use of professional, occupational and

12-36  recreational licenses of persons who:

12-37     (a) Have failed to comply with a subpoena or warrant relating to

12-38  a procedure to determine the paternity of a child or to establish or

12-39  enforce an obligation for the support of a child; or

12-40     (b) Are in arrears in the payment for the support of one or more

12-41  children,

12-42  are repealed by the Congress of the United States.

12-43     5.  Sections 7, 9 and 20 of this act expire by limitation on the

12-44  date on which the provisions of 42 U.S.C. § 666 requiring each state

12-45  to establish procedures under which the state has authority to


13-1  withhold or suspend, or to restrict the use of professional,

13-2  occupational and recreational licenses of persons who:

13-3      (a) Have failed to comply with a subpoena or warrant relating to

13-4  a procedure to determine the paternity of a child or to establish or

13-5  enforce an obligation for the support of a child; or

13-6      (b) Are in arrears in the payment for the support of one or more

13-7  children,

13-8  are repealed by the Congress of the United States.
