AN ACT relating to the Nevada Highway Patrol; requiring the Director of the Department of Personnel to calculate the average salaries of certain law enforcement personnel; requiring the proposed budget of the Department of Public Safety to include salaries for officers of the Nevada Highway Patrol which are based on those calculations; making appropriations to increase the salaries of the officers of the Nevada Highway Patrol; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. Chapter 284 of NRS is hereby amended by adding

1-2  thereto a new section to read as follows:

1-3  1.  The Director shall calculate the respective average salaries

1-4  as of July 1 of each even-numbered year of all police officers of

1-5  equivalent rank employed by:

1-6  (a) Law enforcement agencies of cities whose population is

1-7  60,000 or more;

1-8  (b) Law enforcement agencies of counties whose population is

1-9  100,000 or more; and

1-10      (c) Metropolitan police departments formed pursuant to

1-11  chapter 280 of NRS in counties whose population is 100,000 or

1-12  more.


2-1  2.  The Director shall forward the figures of the average

2-2  salaries calculated pursuant to this section to the Chief of the

2-3  Budget Division of the Department of Administration and the

2-4  Director of the Department of Public Safety not later than July 15

2-5  of each even-numbered year.

2-6  Sec.  2.  Chapter 353 of NRS is hereby amended by adding

2-7  thereto a new section to read as follows:

2-8  1.  In preparing the proposed biennial budget for the

2-9  Department of Public Safety, the Director of the Department shall

2-10  set the respective salaries of the officers of the Nevada Highway

2-11  Patrol at amounts which:

2-12      (a) For the first year of the biennium, are equal to or greater

2-13  than the average salary of police officers of equivalent rank as

2-14  calculated by the Director of the Department of Personnel

2-15  pursuant to section 1 of this act; and

2-16      (b) For the second year of the biennium, are equal to the

2-17  respective amounts proposed pursuant to paragraph (a), plus an

2-18  adjustment for inflation, if any. The amounts of the adjustments

2-19  must be determined by multiplying the respective amounts

2-20  established pursuant to paragraph (a) by the percentage of

2-21  increase, if any. The Consumer Price Index published by the

2-22  United States Department of Labor for July preceding each

2-23  biennium must be used to determine the percentage of inflation.

2-24      2.  In preparing the proposed executive budget, the Chief shall

2-25  ensure that the salaries of the officers of the Nevada Highway

2-26  Patrol, as included in the proposed budget of the Department of

2-27  Public Safety, are established in accordance with the provisions of

2-28  subsection 1.

2-29      Sec.  3.  NRS 353.150 is hereby amended to read as follows:

2-30      353.150  NRS 353.150 to 353.246, inclusive, and section 2 of

2-31  this act, may be cited as the State Budget Act.

2-32      Sec.  4.  1.  The Department of Personnel shall increase the

2-33  level of compensation of all uniformed positions in the Nevada

2-34  Highway Patrol to that of similar positions of the Las Vegas

2-35  Metropolitan Police Department.

2-36      2.  There is hereby appropriated from the State Highway Fund

2-37  to the State Board of Examiners to increase the level of

2-38  compensation of all uniformed positions in the Nevada Highway

2-39  Patrol pursuant to subsection 1:

2-40  For the Fiscal Year 2003-2004$6,079,736

2-41  For the Fiscal Year 2004-2005$6,192,195

2-42      3.  There is hereby appropriated from the State General Fund to

2-43  the State Board of Examiners to increase the level of compensation

2-44  of all uniformed positions in the Nevada Highway Patrol pursuant to

2-45  subsection 1:


3-1  For the Fiscal Year 2003-2004$107,710

3-2  For the Fiscal Year 2004-2005$110,112

3-3  4.  Any balance of the money appropriated by subsections 2 and

3-4  3 for the Fiscal Year 2003-2004 does not revert to the fund from

3-5  which it was appropriated, but must be carried forward to the next

3-6  fiscal year.

3-7  5.  Any balance of the money appropriated by subsections 2 and

3-8  3 must not be committed for expenditure after June 30, 2005, and

3-9  reverts to the fund from which it was appropriated as soon as all

3-10  payments of money committed have been made.

3-11      Sec.  5.  This act becomes effective on July 1, 2003.
