AN ACT relating to administration of public personnel; requiring complaints alleging misconduct of certain public officers and employees to be in writing and verified; repealing the provision that makes it a crime to file a false complaint concerning a peace officer; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. Chapter 281 of NRS is hereby amended by adding

1-2  thereto a new section to read as follows:

1-3  A complaint alleging misconduct of an appointed public officer

1-4  or a public employee must be submitted to the appointing authority

1-5  of the public officer or the employer of the employee, as

1-6  applicable, in writing and must be verified in the manner provided

1-7  for the verification of pleadings in civil actions as set forth in

1-8  NRS 15.010.

1-9  Sec.  2.  NRS 199.325 is hereby repealed.

1-10      Sec.  3.  This act becomes effective on July 1, 2003.


 

 

2-1  TEXT OF REPEALED SECTION

 

 

2-2  199.325  Filing false or fraudulent complaint or allegation of

2-3   misconduct against peace officer.

2-4  1.  A person who knowingly files a false or fraudulent written

2-5   complaint or allegation of misconduct against a peace officer for

2-6   conduct in the course and scope of his employment is guilty of a

2-7   misdemeanor.

2-8  2.  As used in this section, “peace officer” has the meaning

2-9   ascribed to it in NRS 289.010.
