AN ACT relating to the Nevada National Guard; revising the provisions governing the educational benefits provided to members of the Nevada National Guard; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. Chapter 396 of NRS is hereby amended by adding

1-2  thereto a new section to read as follows:

1-3  1.  The Board of Regents may grant a waiver of tuition,

1-4  registration fees and laboratory fees for any member of the active

1-5  Nevada National Guard, including, without limitation, a recruit,

1-6  who attends a school within the System as a full-time or part-time

1-7  student.

1-8  2.  To be eligible for a waiver pursuant to subsection 1, a

1-9  person must:

1-10      (a) Be a resident of the State of Nevada at the beginning of

1-11  and throughout the entire semester for which the waiver is

1-12  granted;

1-13      (b) Be a member in good standing of the active Nevada

1-14  National Guard, including, without limitation, a recruit, at the

1-15  beginning of and throughout the entire semester for which the

1-16  waiver is granted; and

2-1  (c) Maintain at least a 2.0 grade-point average, on a 4.0

2-2  grading scale, each semester, or the equivalent of a 2.0 grade-

2-3  point average if a different grading scale is used.

2-4  3.  The Board of Regents may request the Adjutant General to

2-5  verify the membership in the active Nevada National Guard of a

2-6  person who is seeking or has been granted a waiver of tuition,

2-7  registration fees and laboratory fees pursuant to subsection 1. The

2-8  Adjutant General shall, upon receiving such a request, notify the

2-9  Board of Regents in writing concerning the status and dates of

2-10  membership of that person in the active Nevada National Guard.

2-11      4.  If a waiver is granted pursuant to subsection 1 for a recruit

2-12  and the recruit does not enter full-time National Guard duty

2-13  within 1 year after enlisting, the recruit shall reimburse the Board

2-14  of Regents for all tuition, registration fees and laboratory fees

2-15  waived on behalf of the recruit if his failure to enter full-time

2-16  National Guard duty is attributable to his own conduct.

2-17      5.  As used in this section:

2-18      (a) “Full-time National Guard duty” has the meaning ascribed

2-19  to it in 32 U.S.C § 101(19).

2-20      (b) “Recruit” means a person who has enlisted in the Nevada

2-21  National Guard but has not begun his required military duty.

2-22      Sec. 2. NRS 412.143 is hereby repealed.

2-23      Sec. 3. This act becomes effective on July 1, 2003.

2-25      412.143  Educational benefits.

2-26      1.  The Adjutant General may authorize the payment of no more

2-27  than 100 percent of the consolidated fee each semester for each

2-28  member of the active Nevada National Guard who attends one of the

2-29  universities within the University and Community College System

2-30  of Nevada as a full-time or part-time student from money

2-31  appropriated for this purpose.

2-32      2.  The Adjutant General may authorize the payment of no more

2-33  than 100 percent of the credit-hour cost each semester for each

2-34  member of the active Nevada National Guard who attends one of the

2-35  community colleges within the University and Community College

2-36  System of Nevada as a full-time or part-time student from money

2-37  appropriated for this purpose.

2-38      3.  To be eligible to receive benefits, a person must be a

2-39  member in good standing of the active Nevada National Guard at

3-1  the beginning of and throughout the entire semester for which

3-2  benefits are received.
