AN ACT relating to the Nevada National Guard; revising the provisions governing the educational benefits provided to members of the Nevada National Guard; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. NRS 412.143 is hereby amended to read as follows:
1-2 412.143 1. The Adjutant General may authorize the payment
1-3 of [no more than] up to 100 percent of the [consolidated fee]
1-4 registration fees and laboratory fees each semester [for] on behalf
1-5 of each member of the active Nevada National Guard , including,
1-6 without limitation, a recruit, who attends [one of the universities] a
1-7 school within the University and Community College System of
1-8 Nevada as a full-time or part-time student from money appropriated
1-9 for [this purpose.
1-10 2. The Adjutant General may authorize the payment of no more
1-11 than 100 percent of the credit-hour cost each semester for each
1-12 member of the active Nevada National Guard who attends one of the
1-13 community colleges within the University and Community College
1-14 System of Nevada as a full-time or part-time student from money
1-15 appropriated for this purpose.

2-1 2. The payments authorized by subsection 1 must not be made
2-2 on behalf of any person for more than 36 months.
2-3 3. To be eligible [to receive benefits,] for the payments
2-4 authorized by subsection 1, a person must [be] :
2-5 (a) Be a member in good standing of the active Nevada National
2-6 Guard , including, without limitation, a recruit, at the beginning of
2-7 and throughout the entire semester for which [benefits are received.]

2-9 (b) Maintain at least a 2.0 grade-point average, on a 4.0
2-10 grading scale, each semester, or the equivalent of a 2.0 grade-
2-11 point average if a different grading scale is used.
2-12 4. If the payments authorized by subsection 1 are made on
2-13 behalf of a recruit and the recruit does not enter full-time
2-14 National Guard duty within 1 year after enlisting, the recruit must
2-15 reimburse the Adjutant General for all such payments made on
2-16 behalf of the recruit if his failure to enter full-time National
2-17 Guard duty is attributable to his own conduct.
2-18 5. As used in this section:
2-19 (a) “Full-time National Guard duty” has the meaning ascribed
2-20 to it in 32 U.S.C § 101(19).
2-21 (b) “Recruit” means a person who has enlisted in the Nevada
2-22 National Guard but has not begun his required military training.
2-23 Sec. 2. This act becomes effective on July 1, 2003.
