AN ACT relating to the State Arts Council; authorizing the Council to solicit and accept gifts, grants and donations to promote the creation of artistic works to decorate walls constructed to function as sound barriers along the highways of this state; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. NRS 233C.095 is hereby amended to read as

1-2  follows:

1-3  233C.095  1.  The Nevada Cultural Fund is hereby created as a

1-4  special revenue fund. The purposes of the Fund are to:

1-5  (a) Ensure a stable and healthy cultural climate in this state;


2-1  (b) Advance and promote a meaningful role of the arts and

2-2  humanities in the lives of individual persons, families and

2-3  communities throughout this state; and

2-4  (c) Stimulate the provision of additional funding from private

2-5  sources to carry out the provisions of paragraphs (a) and (b).

2-6  The money in the Fund must be used to augment and must not be

2-7  used to replace or supplant any legislative appropriations to the

2-8  Council.

2-9  2.  The Highway Sound Wall Mural Account is hereby created

2-10  in the Fund. The purpose of the Account is to promote the

2-11  creation of artistic works to decorate walls constructed to function

2-12  as sound barriers along the highways of this state.

2-13      3.  Except as otherwise provided in subsection [4,] 5, the Fund

2-14  is a continuing fund without reversion. The money in the Fund must

2-15  be invested as the money in other state funds is invested. The

2-16  interest and income earned on the money in the Fund, after

2-17  deducting any applicable charges, must be credited to the Fund.

2-18  Claims against the Fund must be paid as other claims against the

2-19  State are paid.

2-20      [3.] 4.  The Council may accept gifts, grants and donations

2-21  from any source for deposit in [the Fund.

2-22      4.] :

2-23      (a) The Fund; and

2-24      (b) The Highway Sound Wall Mural Account in the Fund.

2-25      5. The State Board of Examiners may, upon making a

2-26  determination that any portion of any amount appropriated by the

2-27  Legislature for deposit in the Fund is necessary to meet existing or

2-28  future obligations of the State, recommend to the Interim Finance

2-29  Committee that the amount so needed be transferred from the Fund

2-30  to the State General Fund. Upon approval of the Interim Finance

2-31  Committee, the money may be so transferred.

2-32      Sec. 2.  NRS 233C.096 is hereby amended to read as follows:

2-33      233C.096  1.  The Council shall administer the Nevada

2-34  Cultural Fund and , except as otherwise provided in subsection 2,

2-35  may expend only the amount of any gifts, grants, donations, interest

2-36  and income credited to the Fund to:

2-37      [1.] (a) Provide resources for developing the artistic,

2-38  administrative and financial stability of cultural organizations that

2-39  serve and enrich communities throughout this state regarding the

2-40  arts and humanities;

2-41      [2.] (b) Support programs and projects that provide residents of

2-42  and visitors to this state with access to a broad range of activities

2-43  regarding the arts and humanities;


3-1  [3.] (c) Encourage cultural organizations to reduce their deficits,

3-2  to establish cash reserves and endowments and to engage in capital

3-3  projects that will aid in their stabilization; and

3-4  [4.] (d) Support initiatives and organizations that encourage

3-5  access to, the awareness of and education in the arts.

3-6  2.  The Council may expend only the amount of any gifts,

3-7  grants, donations, interest and income credited to the Highway

3-8  Sound Wall Mural Account to provide grants for the creation of

3-9  artistic works to decorate walls constructed to function as sound

3-10  barriers along the highways of this state, including, without

3-11  limitation, the creation of murals.

3-12      Sec. 3.  This act becomes effective on July 1, 2003.
