Assembly Joint RESOLUTION—Proposing to amend the Nevada Constitution to remove the requirement that the Legislature fix the compensation of certain county officers and to require each board of county commissioners to determine the salaries of certain
county officers in its respective county.

 

1-1  Resolved by the Assembly and Senate of the State of Nevada, Jointly, That Section 20 of Article 4 of the Nevada

1-2  Constitution be amended to read as follows:

1-3  [Section]Sec. 20.  The legislature shall not pass local

1-4  or special laws in any of the following enumerated cases—

1-5  that is to say:

1-6  Regulating the jurisdiction and duties of justices of the

1-7  peace and of constables, and fixing their compensation;

1-8  For the punishment of crimes and misdemeanors;

1-9  Regulating the practice of courts of justice;

1-10      Providing for changing the venue in civil and criminal

1-11  cases;

1-12      Granting divorces;

1-13      Changing the names of persons;

1-14      Vacating roads, town plots, streets, alleys, and public

1-15  squares;


2-1  Summoning and impaneling grand and petit juries, and

2-2  providing for their compensation;

2-3  Regulating county and township business;

2-4  Regulating the election of county and township officers;

2-5  For the assessment and collection of taxes for state,

2-6  county, and township purposes;

2-7  Providing for opening and conducting elections of state,

2-8  county, or township officers, and designating the places of

2-9  voting;

2-10      Providing for the sale of real estate belonging to minors or

2-11  other persons laboring under legal disabilities;

2-12      Giving effect to invalid deeds, wills, or other instruments;

2-13      Refunding money paid into the state treasury, or into the

2-14  treasury of any county;

2-15      Releasing the indebtedness, liability, or obligation of any

2-16  corporation, association, or person to the state, or to any

2-17  county, town, or city of this state; but nothing in this section

2-18  shall be construed to deny or restrict the power of the

2-19  legislature to establish and regulate the [compensation and]

2-20  fees of county officers, to authorize and empower the boards

2-21  of county commissioners of the various counties of the state

2-22  to establish and regulate the compensation of county officers

2-23  and the compensation and fees of township officers in their

2-24  respective counties, to establish and regulate the rates of

2-25  freight, passage, toll, and charges of railroads, tollroads,

2-26  ditch, flume, and tunnel companies incorporated under the

2-27  laws of this state or doing business therein.

2-28  And be it further

2-29      Resolved, That Section 26 of Article 4 of the Nevada

2-30  Constitution be amended to read as follows:

2-31      [Sec:] Sec. 26.  The Legislature shall provide by

2-32  law, for the election of a Board of County

2-33  Commissioners in each County, and such County

2-34  Commissioners shall jointly and individually perform

2-35  such duties as may be prescribed by law. The

2-36  compensation of the members of the Board of County

2-37  Commissioners in each County must be fixed by the Board

2-38  of County Commissioners in each respective

2-39  County.

2-40  And be it further

2-41      Resolved, That Section 32 of Article 4 of the Nevada

2-42  Constitution be amended to read as follows:

2-43      Sec. 32.  The Legislature shall have power to increase,

2-44  diminish, consolidate or abolish the following county

2-45  officers: County Clerks, County Recorders, Auditors,


3-1  Sheriffs, District Attorneys and Public Administrators. The

3-2  Legislature shall provide for their election by the people, and

3-3  fix by law their duties . [and compensation.] The Board of

3-4  County Commissioners of each county shall determine the

3-5  compensation of those county officers in its respective

3-6  county. County Clerks shall be ex-officio Clerks of the

3-7  Courts of Record and of the Boards of County

3-8  Commissioners in and for their respective counties.
