Assembly Concurrent RESOLUTION—Directing the Legislative Commission to conduct an interim study of all election, ethics and campaign laws in this state.

 

1-1  Whereas, Participation in the election process is an important

1-2  right for residents of Nevada; and

1-3  Whereas, The State of Nevada, through the Nevada

1-4  Legislature, the Secretary of State, and various local clerk and

1-5  registrar offices, has the duty to ensure that all Nevadans have

1-6  access to participation in the election process, whether that

1-7  participation is as a candidate for office or as an elector; and

1-8  Whereas, Well-organized and comprehensible statutes are key

1-9  to providing Nevadans with such access; now, therefore, be it

1-10      Resolved by the Assembly of the State of Nevada, the

1-11  Senate Concurring, That the Legislative Commission is hereby

1-12  directed to appoint a committee to conduct an interim study of the

1-13  election, ethics and campaign laws of this state composed of:

1-14      1.  One member from the Assembly who serves on the

1-15  Committee on Elections, Procedures, and Ethics;

1-16      2.  One member from the Senate who serves on the Committee

1-17  on Government Affairs; and

1-18      3.  Four county clerks or registrars of voters, or their designees,

1-19  one from the most populous county in this state, one from the next

1-20  most populous county in this state, and two from rural counties in

1-21  this state; and be it further

1-22      Resolved, That the Secretary of State, or his designee, and the

1-23  Chairman of the Commission on Ethics, or his designee, are hereby


2-1  appointed as nonvoting members of the interim committee; and be it

2-2  further

2-3  Resolved, That the study must include, without limitation:

2-4  1.  A review of all current election-related statutes of this state,

2-5  including, without limitation, campaign practices, campaign finance,

2-6  initiative and referendum, recall of public officers and voting

2-7  systems;

2-8  2.  An examination of these statutes to identify inconsistencies,

2-9  duplications, omissions, and obsolete or illogical language; and

2-10      3.  An analysis to determine whether the needs of the public

2-11  would be better met if these statutes were reorganized and

2-12  consolidated within the Nevada Revised Statutes; and be it further

2-13      Resolved, That any recommended legislation proposed by the

2-14  interim committee must be approved by both legislative members

2-15  appointed to the committee; and be it further

2-16      Resolved, That the Legislative Commission shall submit a

2-17  report of the results of the study and any recommendations for

2-18  legislation to the 73rd Session of the Nevada Legislature.
