AN ACT relating to county government; revising the term of office of members of a town advisory board in certain counties; removing the prohibition on consecutive terms of office of members of such a board; providing for the election of a chairman of such a board; revising the requirements regarding the notice of a vacancy on such a board; requiring the provision of notice of the expiration of the term of a member of such a board; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. NRS 269.576 is hereby amended to read as follows:
1-2 269.576 1. Except as appointment may be deferred pursuant
1-3 to NRS 269.563, the board of county commissioners of any county
1-4 whose population is 400,000 or more shall, in each ordinance which
1-5 establishes an unincorporated town pursuant to NRS 269.500 to
1-6 269.625, inclusive, provide for:
1-7 (a) Appointment by the board of county commissioners or the
1-8 election by the registered voters of the unincorporated town of three
1-9 or five qualified electors who are residents of the unincorporated
1-10 town to serve as the town advisory board. If the ordinance provides
1-11 for appointment by the board of county commissioners, in making
2-1 such appointments, the board of county commissioners shall
2-2 consider:
2-3 (1) The results of any poll conducted by the town advisory
2-4 board; and
2-5 (2) Any application submitted to the board of county
2-6 commissioners by persons who desire to be appointed to the town
2-7 advisory board in response to an announcement made by the town
2-8 advisory board.
2-9 (b) A term of [4] 2 years for members of the town advisory
2-10 board . [, which must be staggered and must expire on the first
2-11 Monday in January of an odd-numbered year. No person who has
2-12 served for a term as a member of a town advisory board is eligible
2-13 for reappointment until 2 years after the expiration of his term.
2-14 (c) Removal of a member of the town advisory board if the
2-15 board of county commissioners finds that his removal is in the best
2-16 interest of the residents of the unincorporated town, and for
2-17 appointment of a member to serve the unexpired term of the
2-18 member so removed.]
2-19 (c) Election of a chairman from among the members of the
2-20 town advisory board for a term of 2 years, and, if a vacancy occurs
2-21 in the chairmanship, for the election of a chairman from among
2-22 the members for the remainder of the unexpired term. The
2-23 ordinance must also provide that a chairman is not eligible to
2-24 succeed himself for a term of office as chairman.
2-25 2. The members of a town advisory board serve at the
2-26 pleasure of the board of county commissioners. If a member is
2-27 removed, the board of county commissioners shall appoint a new
2-28 member to serve out the remainder of the unexpired term of the
2-29 member who was removed.
2-30 3. The board of county commissioners shall provide notice of
2-31 the expiration of the term of a member of and any vacancy on a
2-32 town advisory board to the residents of the unincorporated town by
2-33 mail, newsletter or newspaper at least [90] 30 days before the
2-34 expiration of the term or filling the vacancy.
2-35 [3.] 4. The duties of the town advisory board are to:
2-36 (a) Assist the board of county commissioners in governing the
2-37 unincorporated town by acting as liaison between the residents of
2-38 the town and the board of county commissioners; and
2-39 (b) Advise the board of county commissioners on matters of
2-40 importance to the unincorporated town and its residents.
2-41 [4.] 5. The board of county commissioners may provide by
2-42 ordinance for compensation for the members of the town advisory
2-43 board.
2-44 Sec. 2. 1. Notwithstanding the amendatory provisions of
2-45 paragraph (b) of subsection 1 of NRS 269.576, a member of a town
3-1 advisory board who was elected or appointed on or before
3-2 October 1, 2003, shall serve out the term to which he was elected or
3-3 appointed.
3-4 2. For the purposes of paragraph (c) of subsection 1 of NRS
3-5 269.576, as amended by section 1 of this act, any person who is
3-6 serving in the capacity of a chairman on a town advisory board on
3-7 October 1, 2003, is not eligible to serve a consecutive term of office
3-8 as chairman.
3-9 3. If the provisions of an ordinance adopted before October 1,
3-10 2003, that establishes an unincorporated town pursuant to NRS
3-11 269.500 to 269.625, inclusive, do not comply with NRS 269.576, as
3-12 amended by section 1 of this act, that ordinance must be amended
3-13 on or before January 1, 2004, to comply with section 1 of this act.
