AN ACT relating to taxation; authorizing certain counties to use the proceeds from the county motor vehicle fuel tax for the maintenance and repair of streets, highways and various other projects; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. NRS 373.028 is hereby amended to read as follows:

1-2  373.028  “Project” means:

1-3  1.  In a county whose population is [50,000] 100,000 or more,

1-4  street and highway construction, including, without limitation, the

1-5  acquisition and improvement of any street, avenue, boulevard, alley,

1-6  highway or other public right-of-way used for any vehicular traffic,

1-7  and including a sidewalk designed primarily for use by pedestrians,

1-8  and also, including, without limitation, grades, regrades, gravel,

1-9  oiling, surfacing, macadamizing, paving, crosswalks, sidewalks,

1-10  pedestrian rights-of-way, driveway approaches, curb cuts, curbs,

1-11  gutters, culverts, catch basins, drains, sewers, manholes, inlets,

1-12  outlets, retaining walls, bridges, overpasses, tunnels, underpasses,

1-13  approaches, sprinkling facilities, artificial lights and lighting


2-1  equipment, parkways, grade separators, traffic separators, and traffic

2-2  control equipment, and all appurtenances and incidentals, or any

2-3  combination thereof, including, without limitation, the acquisition

2-4  and improvement of all types of property therefor.

2-5  2.  In a county whose population is less than [50,000,] 100,000,

2-6  street and highway construction, maintenance or repair, or any

2-7  combination thereof, including, without limitation, the acquisition,

2-8  maintenance, repair and improvement of any street, avenue,

2-9  boulevard, alley, highway or other public right-of-way used for any

2-10  vehicular traffic, and including a sidewalk designed primarily for

2-11  use by pedestrians, and also, including, without limitation, grades,

2-12  regrades, gravel, oiling, surfacing, macadamizing, paving,

2-13  crosswalks, sidewalks, pedestrian rights-of-way, driveway

2-14  approaches, curb cuts, curbs, gutters, culverts, catch basins, drains,

2-15  sewers, manholes, inlets, outlets, retaining walls, bridges,

2-16  overpasses, tunnels, underpasses, approaches, sprinkling facilities,

2-17  artificial lights and lighting equipment, parkways, grade separators,

2-18  traffic separators, and traffic control equipment, and all

2-19  appurtenances and incidentals, or any combination thereof,

2-20  including, without limitation, the acquisition, maintenance, repair

2-21  and improvement of all types of property therefor.

2-22      Sec. 2.  This act becomes effective upon passage and approval.
