AN ACT relating to fuels; revising the findings of the Legislature concerning the feasibility of the conversion to cleaner-burning alternative fuels by certain fleets of motor vehicles; revising the definitions of “alternative fuel” and “dedicated alternative fuel motor vehicle”; requiring the State Environmental Commission to adopt regulations relating to dedicated alternative fuel motor vehicles; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
2-1 Section 1. Chapter 486A of NRS is hereby amended by
2-2 adding thereto a new section to read as follows:
2-3 “Ultra low-sulfur diesel fuel” means diesel fuel having a
2-4 maximum sulfur content of 15 parts per million by weight.
2-5 Sec. 2. NRS 486A.010 is hereby amended to read as follows:
2-6 486A.010 The Legislature finds that:
2-7 1. Protection of the State’s environment, particularly the
2-8 quality of its air, requires a reduction, especially in metropolitan
2-9 areas, of the contaminants resulting from the combustion of
2-10 conventional fuels in motor vehicles.
2-11 2. A very large proportion of these contaminants results from
2-12 the burning of liquid and gaseous fuels to operate trucks and buses,
2-13 many of which are operated in fleets. Each fuel can be evaluated as
2-14 to the air pollution it causes when burned in motor vehicles.
2-15 3. Conversion of these fleets to use cleaner-burning alternative
2-16 fuels can reduce contaminants sufficiently to permit the continued
2-17 use of conventional fuels in individually owned motor vehicles. [,
2-18 but such conversion is feasible only if sufficient financial assistance
2-19 is provided to the owners of fleets.]
2-20 Sec. 3. NRS 486A.020 is hereby amended to read as follows:
2-21 486A.020 As used in NRS 486A.010 to 486A.180, inclusive,
2-22 and section 1 of this act,unless the context otherwise requires, the
2-23 words and terms defined in NRS 486A.030 to 486A.130, inclusive,
2-24 and section 1 of this act have the meanings ascribed to them in
2-25 those sections.
2-26 Sec. 4. NRS 486A.030 is hereby amended to read as follows:
2-27 486A.030 “Alternative fuel” means any fuel which complies
2-28 with the standards and requirements established by the Commission.
2-29 The term includes :
2-30 1. Ultra low-sulfur diesel fuel [and reformulated] ;
2-31 2. Reformulated gasoline ;
2-32 3. Diesel fuel that meets the requirements imposed by the
2-33 California Air Resources Board; and
2-34 4. Finished diesel fuel that:
2-35 (a) Meets American Society for Testing and Materials (ASTM)
2-36 specification D975; and
2-37 (b) Includes at least 5 percent but not more than 20 percent
2-38 biodiesel fuel blend stock for distillate fuels meeting ASTM
2-39 specification D6751,
2-40 which comply with the regulations adopted by the United States
2-41 Environmental Protection Agency pursuant to the standards for the
2-42 control of emissions from motor vehicles established in the Clean
2-43 Air Act Amendments of 1990 [(Pub. L. No. 101‑549, Nov. 15,
2-44 1990).] , Public Law 101-549, November 15, 1990.
3-1 Sec. 5. NRS 486A.030 is hereby amended to read as follows:
3-2 486A.030 “Alternative fuel” means any fuel which complies
3-3 with the standards and requirements established by the Commission.
3-4 The term includes:
3-5 1. [Ultra low-sulfur diesel fuel;
3-6 2.] Reformulated gasoline;
3-7 [3. Diesel fuel that meets the requirements imposed by the
3-8 California Air Resources Board; and
3-9 4.] and
3-10 2. Finished diesel fuel that:
3-11 (a) Meets American Society for Testing and Materials (ASTM)
3-12 specification D975; and
3-13 (b) Includes at least 5 percent but not more than 20 percent
3-14 biodiesel fuel blend stock for distillate fuels meeting ASTM
3-15 specification D6751,
3-16 which comply with the regulations adopted by the United States
3-17 Environmental Protection Agency pursuant to the standards for the
3-18 control of emissions from motor vehicles established in the Clean
3-19 Air Act Amendments of 1990, Public Law 101-549, November 15,
3-20 1990.
3-21 Sec. 6. NRS 486A.060 is hereby amended to read as follows:
3-22 486A.060 “Dedicated alternative fuel motor vehicle” means a
3-23 motor vehicle that [operates] :
3-24 1. Operates only on an alternative fuel [.] ; or
3-25 2. Regardless of the type of fuel on which it operates, has
3-26 been certified by the United States Environmental Protection
3-27 Agency as being in compliance with the standards for the control
3-28 of emissions from an ultra low-emission vehicle, or more stringent
3-29 standards, as set forth in 40 C.F.R. § 88.104-94 or 88.105-94.
3-30 Sec. 7. NRS 486A.150 is hereby amended to read as follows:
3-31 486A.150 The Commission shall adopt regulations necessary
3-32 to carry out the provisions of NRS 486A.010 to 486A.180,
3-33 inclusive, and section 1 of this act, including, but not limited to,
3-34 regulations concerning:
3-35 1. Standards and requirements for alternative fuel. The
3-36 Commission shall not discriminate against any product that is
3-37 petroleum based.
3-38 2. The conversion of fleets to use alternative fuels if the fleet is
3-39 operated in a county whose population is 100,000 or more.
3-40 3. Standards for alternative fuel injection systems for diesel
3-41 motor vehicles.
3-42 4. Standards for levels of emissions from motor vehicles that
3-43 are converted to use alternative fuels.
4-1 5. The establishment of a procedure for approving exemptions
4-2 to the requirements of NRS 486A.010 to 486A.180, inclusive [.] ,
4-3 and section 1 of this act.
4-4 6. Standards related to the use of dedicated alternative fuel
4-5 motor vehicles.
4-6 Sec. 8. NRS 486A.180 is hereby amended to read as follows:
4-7 486A.180 1. Except as otherwise provided in subsection 4,
4-8 any person who violates any provision of NRS 486A.010 to
4-9 486A.180, inclusive, and section 1 of this act, or any regulation
4-10 adopted pursuant thereto, is guilty of a civil offense and shall pay an
4-11 administrative fine levied by the Commission of not more than
4-12 $5,000. Each day of violation constitutes a separate offense.
4-13 2. The Commission shall by regulation establish a schedule of
4-14 administrative fines of not more than $1,000 for lesser violations of
4-15 any provision of NRS 486A.010 to 486A.180, inclusive, and
4-16 section 1 of this act or any regulation in force pursuant thereto.
4-17 3. Action pursuant to subsection 1 or 2 is not a bar to
4-18 enforcement of the provisions of NRS 486A.010 to 486A.180,
4-19 inclusive, and section 1 of this act and regulations in force pursuant
4-20 thereto, by injunction or other appropriate remedy. The Commission
4-21 or the Director of the Department may institute and maintain in the
4-22 name of the State of Nevada any such enforcement proceeding.
4-23 4. A person who fails to pay a fine levied pursuant to
4-24 subsection 1 or 2 within 30 days after the fine is imposed is guilty of
4-25 a misdemeanor. The provisions of this subsection do not apply to a
4-26 person found by the court to be indigent.
4-27 5. The Commission and the Department shall deposit all
4-28 money collected pursuant to this section in the State General Fund.
4-29 Money deposited in the State General Fund pursuant to this
4-30 subsection must be accounted for separately and may only be
4-31 expended upon legislative appropriation.
4-32 Sec. 9. As soon as practicable after July 1, 2003, the State
4-33 Environmental Commission shall review its regulations set forth in
4-34 chapter 486A of NAC and shall, pursuant to its authority to adopt
4-35 regulations set forth in NRS 445B.210 and 486A.150:
4-36 1. Revise the definition of “alternative fuel” in a manner
4-37 consistent with the provisions of this act; and
4-38 2. Revise its schedule for the conversion of fleets to use
4-39 alternative fuels, if the Commission determines that the revision is
4-40 necessary as a result of the provisions of this act.
4-41 Sec. 10. 1. This section and sections 1 to 4, inclusive, and 6
4-42 to 9, inclusive, of this act become effective on July 1, 2003.
4-43 2. Sections 1 and 4 of this act expire by limitation on
4-44 December 31, 2006.
5-1 3. Section 5 of this act becomes effective on January 1, 2007.
