AN ACT making an appropriation to the Department of Transportation for the planning and construction of ports of entry on certain highways; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. There is hereby appropriated from the State General
1-2 Fund to the Department of Transportation for the planning and
1-3 construction of ports of entry pursuant to section 4 of this act:
1-4 For fiscal year 2003-2004 .... $2,000,000
1-5 For fiscal year 2004-2005 .... $3,000,000
1-6 Sec. 2. There is hereby appropriated from the State Highway
1-7 Fund to the Department of Transportation for the planning and
1-8 construction of ports of entry pursuant to section 4 of this act:
1-9 For fiscal year 2003-2004 .... $2,000,000
1-10 For fiscal year 2004-2005 .... $3,000,000
1-11 Sec. 3. 1. Any balance of the money appropriated by
1-12 sections 1 and 2 of this act for fiscal year 2003-2004 does not revert
1-13 to the Fund from which it was appropriated, but must be carried
1-14 forward to the next fiscal year.
2-1 2. Any balance of the money appropriated by sections 1 and 2
2-2 of this act must not be committed for expenditure after June 30,
2-3 2005, and reverts to the Fund from which it was appropriated as
2-4 soon as all payments of money committed have been made.
2-5 Sec. 4. 1. The Director of the Department of Transportation,
2-6 in consultation with the Department of Motor Vehicles, the
2-7 Department of Public Safety, the Department of Taxation, the State
2-8 Department of Agriculture, the State Department of Conservation
2-9 and Natural Resources and any other state agency directed by the
2-10 Governor to participate in this project, shall develop plans and
2-11 undertake the construction of two ports of entry on Interstate
2-12 Highway No. 15, one near each location where the Interstate
2-13 Highway crosses the state border. If financial resources are
2-14 sufficient, the Department of Transportation may, to the extent of
2-15 legislative appropriation or authorization, plan and construct similar
2-16 ports of entry on Interstate Highway No. 80.
2-17 2. The ports of entry planned and constructed pursuant to this
2-18 act must be designed to meet the needs of the Department of
2-19 Transportation, the Department of Motor Vehicles, the Department
2-20 of Public Safety, the Department of Taxation, the State Department
2-21 of Agriculture, the State Department of Conservation and Natural
2-22 Resources as these departments enforce the laws of this state and
2-23 any related regulations within their respective jurisdictions,
2-24 including, without limitation, the inspection of vehicles transporting
2-25 hazardous materials, the enforcement of laws relating to the taxation
2-26 of fuel used in motor carriers, the enforcement of vehicle
2-27 registration laws, the enforcement of traffic safety laws, the
2-28 performance of safety inspections on commercial vehicles, the
2-29 enforcement of laws restricting the importing of diseased animals,
2-30 noxious weeds and other illegal plants. The Governor may direct
2-31 additional agencies of this state to participate in the planning and
2-32 use of the ports of entry in a manner that will benefit the State.
2-33 3. The Department of Transportation may:
2-34 (a) Enter into an interstate agreement for joint operation of ports
2-35 of entry with the states that border Nevada at the location of the
2-36 ports of entry.
2-37 (b) Accept gifts and grants from federal and other governmental
2-38 sources for the construction and operation of ports of entry pursuant
2-39 to this act.
2-40 (c) Continue its use of portable ports of entry as deemed
2-41 appropriate by the Director of the Department.
2-42 Sec. 5. This act becomes effective on July 1, 2003.
