AN ACT relating to education; prohibiting an employee or agent of a school district from taking certain actions relating to the use of psychotropic drugs by pupils; authorizing certain employees of a school district to suggest that a pupil be evaluated for placement in a special program; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. Chapter 392 of NRS is hereby amended by adding

1-2  thereto a new section to read as follows:

1-3  1.  A person who is an employee or agent of a school district

1-4  shall not:

1-5  (a) Suggest to a pupil or to a parent or guardian of a pupil that

1-6  the pupil should take a psychotropic drug unless the person is a

1-7  physician; or

1-8  (b) Prohibit a pupil from attending class unless the pupil takes

1-9  a psychotropic drug.

1-10      2.  A person who is an employee or agent of a school district

1-11  may suggest that a pupil be evaluated for determination of

1-12  whether the pupil should be placed in a special program pursuant

1-13  to NRS 388.470.

 

 


2-1  3.  As used in this section:

2-2  (a) “Physician” means a person who is licensed to practice

2-3  medicine as a physician pursuant to chapter 630 of NRS.

2-4  (b) “Psychotropic drug” means a controlled substance listed in

2-5  schedule II by the State Board of Pharmacy pursuant to NRS

2-6  453.146, or a neuroleptic or other psychoactive drug which

2-7  produces a mind-altering effect in a person.

2-8  Sec. 2.  This act becomes effective on July 1, 2003.
