AN ACT relating to public officers; increasing the compensation of elected county officers; authorizing a county to request and receive a waiver from the increases in compensation in the event of insufficient financial resources; providing that a waiver may not be applied for in certain circumstances; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. NRS 245.043 is hereby amended to read as follows:

1-2  245.043  1.  As used in this section:

1-3  (a) “County” includes Carson City.

1-4  (b) “County commissioner” includes the Mayor and supervisors

1-5  of Carson City.

1-6  2.  Except as otherwise provided by any special law, the elected

1-7  officers of the counties of this state are entitled to receive annual

1-8  salaries in the base amounts specified in the following table. The

1-9  annual salaries are in full payment for all services required by law to

1-10  be performed by such officers. Except as otherwise provided by law,

1-11  all fees and commissions collected by such officers in the


2-1  performance of their duties must be paid into the county treasury

2-2  each month without deduction of any nature.

2-40      Sec. 2.  Except as otherwise provided in section 3 of this act,

2-41  each county shall commence payment of the increased annual


3-1  salaries of the elected officers of the county set forth in the table of

3-2  annual salaries contained in NRS 245.043, as amended by section 1

3-3  of this act, on July 1, 2003.

3-4  Sec. 3.  1.  Except as otherwise provided in subsection 3, a

3-5  board of county commissioners may apply to the Committee on

3-6  Local Government Finance for a waiver from the requirement to

3-7  increase the annual salaries of elected officers of the county to the

3-8  annual salaries set forth in the table contained in NRS 245.043, as

3-9  amended by section 1 of this act, if the board determines that the

3-10  financial resources of the county are insufficient to pay those

3-11  increased annual salaries in Fiscal Year 2003-2004. The Committee

3-12  on Local Government Finance shall grant such a waiver if it finds

3-13  that the financial resources of the county are insufficient to pay

3-14  those increased annual salaries in Fiscal Year 2003-2004.

3-15      2.  A board of county commissioners that has been granted a

3-16  waiver for a fiscal year may apply to the Committee on Local

3-17  Government Finance for an additional waiver for the next

3-18  consecutive fiscal year if it finds that the financial resources of the

3-19  county continue to be insufficient to pay the increased annual

3-20  salaries of the elected officers of the county set forth in the table

3-21  contained in NRS 245.043, as amended by section 1 of this act.

3-22  There is no limitation on the number of waivers for consecutive

3-23  fiscal years that the board of county commissioners may be granted

3-24  if the board of county commissioners finds that the financial

3-25  resources of the county continue to be insufficient to pay the

3-26  increased annual salaries of the elected officers of the county set

3-27  forth in the table contained in NRS 245.043, as amended by section

3-28  1 of this act, in that fiscal year.

3-29      3.  After commencing payment of the increased annual salaries

3-30  of the elected officers of the county set forth in the table contained

3-31  in NRS 245.043, as amended by section 1 of this act, a board of

3-32  county commissioners may not apply for a waiver in any subsequent

3-33  fiscal year.

3-34      4.  The increased annual salaries of the elected officers of the

3-35  county set forth in the table contained in NRS 245.043, as amended

3-36  by section 1 of this act, must not be paid retroactively for a period to

3-37  which a waiver granted pursuant to subsection 1 is applicable.

3-38      Sec. 4.  The provisions of subsection 1 of NRS 354.599 do not

3-39  apply to any additional expenses of a local government that are

3-40  related to the provisions of this act.

3-41      Sec. 5.  This act becomes effective upon July 1, 2003.

 

3-42  H
