AN ACT relating to state financial administration; authorizing the University and Community College System of Nevada to carry forward 50 percent of the unexpended appropriations from one fiscal year to the following fiscal year; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. NRS 353.253 is hereby amended to read as follows:
1-2 353.253 1. Every agency, department and institution of the
1-3 State of Nevada shall deposit all money received from the Federal
1-4 Government, the counties or other sources[,] in the State Treasury
1-5 as provided in NRS 353.250 unless otherwise provided by law.
1-6 These deposits must be made to work program accounts directly or
1-7 to other budget accounts.
1-8 2. Except for the balance in any proprietary fund and
1-9 appropriated or authorized reserves, any balance remaining at the
1-10 end of a fiscal year in a budget account of an agency, department or
1-11 institution of the State of Nevada, whether or not authorized for
2-1 expenditure under a work program, reverts to the source of funding
2-2 supporting the agency, department or institution. If that source of
2-3 funding is federal money or a source of revenue the use of which is
2-4 restricted by statute, then the balance may be authorized for
2-5 expenditure under a work program for the subsequent fiscal year in
2-6 accordance with the provisions of this chapter.
2-7 3. No provision of this chapter may be construed to authorize
2-8 or direct the transfer, expenditure or reversion of any money
2-9 received from the Federal Government contrary to the conditions
2-10 upon which that money was received or to any federal law or
2-11 regulation respecting the accountability therefor.
2-12 4. [This section does] Subsections 1, 2 and 3 do not apply to
2-13 the Board of Regents of the University of Nevada and the Nevada
2-14 State Museum. The Board of Regents may carry forward 50
2-15 percent of the remaining amount of any appropriation from the
2-16 State General Fund to the University and Community College
2-17 System of Nevada that was not expended in a fiscal year for
2-18 expenditure in the following fiscal year.
2-19 Sec. 2. This act becomes effective upon passage and approval.
