AN ACT relating to education; requiring at least one person who serves on the Commission on Professional Standards in Education as a teacher to hold certification issued by the National Board for Professional Teaching Standards; requiring the Department of Education to submit certain reports to the Legislature concerning the number of teachers who are certified by the National Board and the percentage of teachers on the Commission who are certified; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. NRS 391.011 is hereby amended to read as follows:

1-2  391.011  1.  The Commission on Professional Standards in

1-3  Education, consisting of nine members appointed by the Governor,

1-4  is hereby created.

1-5  2.  Four members of the Commission must be teachers who

1-6  teach in the classroom as follows:

1-7  (a) One who teaches in a secondary school.

1-8  (b) One who teaches in a middle school or junior high school.

1-9  (c) One who teaches in an elementary school.

1-10      (d) One who teaches special education.


2-1  At least one member appointed pursuant to this subsection must

2-2  hold certification issued by the National Board for Professional

2-3  Teaching Standards, to the extent that persons who hold such

2-4  certification are available and willing to serve.

2-5  3.  The remaining members of the Commission must include:

2-6  (a) One counselor or psychologist employed by a school district.

2-7  (b) Two administrators of schools, at least one of whom must be

2-8  a principal of a school.

2-9  (c) The dean of the College of Education at one of the

2-10  universities in the University and Community College System of

2-11  Nevada, or a representative of one of the Colleges of Education

2-12  nominated by such a dean for appointment by the Governor.

2-13      (d) One member who is a representative of the general public.

2-14      4.  The appointments of a counselor, the administrators and

2-15  three of the four teachers must be made from a list of names of at

2-16  least three persons for each position that is submitted to the

2-17  Governor:

2-18      (a) For the counselor and teachers, by an employee organization

2-19  representing the majority of counselors and the majority of teachers

2-20  in the State of Nevada who teach in the educational level from

2-21  which the appointment is being made; or

2-22      (b) For administrators, by an organization of administrators for

2-23  schools in which the majority of administrators of schools in this

2-24  state have membership.

2-25      5.  One member of the Commission who is a teacher,

2-26  administrator, counselor or psychologist must be employed by a

2-27  private school licensed pursuant to chapter 394 of NRS.

3-20      Sec. 3.  1.  On or before February 1, 2005, the Department of

3-21  Education shall submit a report to the Director of the Legislative

3-22  Counsel Bureau for transmission to the 73rd Session of the Nevada

3-23  Legislature that includes, for the current school year:

3-24      (a) The total number of teachers licensed pursuant to chapter

3-25  391 of NRS who hold certification issued by the National Board for

3-26  Professional Teaching Standards, reported separately for teachers

3-27  who teach:

3-28          (1) In a secondary school.

3-29          (2) In a middle school or junior high school.

3-30          (3) In an elementary school.

3-31          (4) Special education.

3-32      (b) The percentage of members who serve as teachers on the

3-33  Commission on Professional Standards in Education and are

3-34  certified by the National Board for Professional Teaching Standards.

3-35      2.  On or before February 1, 2007, the Department of Education

3-36  shall submit a report to the Director of the Legislative Counsel

3-37  Bureau for transmission to the 74th Session of the Nevada

3-38  Legislature that includes the information described in paragraphs (a)

3-39  and (b) of subsection 1 for the current school year.

3-40      Sec. 4.  1.  This section and sections 1 and 3 of this act

3-41  become effective on July 1, 2003.

3-42      2.  Section 2 of this act becomes effective on January 1, 2007.
