AN ACT relating to industrial insurance; providing for an increase in the compensation paid for a permanent total disability to adjust for past increases in the average monthly wage; providing for an annual increase in the compensation paid for a permanent total disability to adjust for future increases in the average monthly wage on an ongoing basis; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 616C of NRS is hereby amended by adding
1-2 thereto the provisions set forth as sections 2 and 3 of this act.
1-3 Sec. 2. 1. Any claimant or dependent of a claimant who, on
1-4 July 1, 2003, is receiving compensation pursuant to chapters 616A
1-5 to 616D, inclusive, of NRS for a permanent total disability is
1-6 entitled, for payments made on and after July 1, 2003, to an
1-7 increase in that compensation by a percentage that is equal to the
1-8 percentage that the average monthly wage increased over the
1-9 period from the date of the claimant’s disabling accident or
1-10 disease to July 1, 2003.
1-11 2. A claimant or dependent of a claimant is entitled to be paid
1-12 the increase provided by this section on a prospective basis only
1-13 and is not entitled to be paid any additional compensation based
2-1 on payments made to the claimant or dependent of the claimant
2-2 before July 1, 2003.
2-3 Sec. 3. 1. Beginning on July 1, 2004, and on July 1 of each
2-4 year thereafter, any claimant or dependent of a claimant who is
2-5 receiving compensation pursuant to chapters 616A to 616D,
2-6 inclusive, of NRS for a permanent total disability is entitled to an
2-7 annual increase in that compensation by a percentage that is
2-8 equal to the percentage that the average monthly wage increases
2-9 on an annual basis.
2-10 2. A claimant or dependent of a claimant is entitled to be paid
2-11 the increase provided by this section on a prospective basis only
2-12 and is not entitled to be paid any additional compensation based
2-13 on payments made to the claimant or dependent of the claimant
2-14 before the effective date of the increase.
2-15 Sec. 4. This act becomes effective on July 1, 2003.
