AN ACT relating to motor vehicles; requiring the Department of Motor Vehicles to establish a pilot program to contract with persons to provide certain services relating to the registration of motor vehicles otherwise required to be provided by the Department; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. 1.  The Department of Motor Vehicles shall

1-2  establish a pilot program to authorize a person to provide services of

1-3  registration pursuant to this section.

1-4  2.  Upon request, the Department may authorize a person to:

1-5  (a) Accept applications for the registration and renewal of

1-6  registration of motor vehicles, and collect related fees and taxes;

1-7  (b) Issue certificates of registration to applicants who satisfy the

1-8  requirements of chapter 482 of NRS; and

1-9  (c) Accept applications for the transfer of registration pursuant

1-10  to NRS 482.399.

1-11      3.  A person who is authorized to register motor vehicles, issue

1-12  certificates of registration and renew the registration of a motor

1-13  vehicle pursuant to subsection 2 shall:


2-1  (a) Transmit the applications he receives to the Department

2-2  within the period prescribed by the Department;

2-3  (b) Except with respect to a fee authorized by subsection 4,

2-4  transmit any fees or taxes he collects from the applicants and

2-5  properly account for them within the period prescribed by the

2-6  Department;

2-7  (c) Comply with the regulations adopted pursuant to

2-8  subsection 6;

2-9  (d) Bear any cost of equipment which is necessary to issue

2-10  certificates of registration or renew the registration of a motor

2-11  vehicle, including, without limitation, any computer hardware or

2-12  software; and

2-13      (e) Provide for any fee, bond or insurance which is necessary to

2-14  carry out the provisions of this section.

2-15      4.  In addition to any fees or taxes collected pursuant to this

2-16  section, a person who is authorized to register motor vehicles, issue

2-17  certificates of registration and renew the registration of a motor

2-18  vehicle pursuant to subsection 2 may charge and collect a fee for the

2-19  performance of services pursuant to this section.

2-20      5.  A person who is authorized to register motor vehicles, issue

2-21  certificates of registration and renew the registration of a motor

2-22  vehicle pursuant to subsection 2 may not receive compensation from

2-23  the Department for the performance of services pursuant to this

2-24  section.

2-25      6.  The Director of the Department shall adopt such regulations

2-26  as the Director determines are necessary to carry out the provisions

2-27  of this section.

2-28      Sec. 2.  On or before January 1, 2004, the Director of the

2-29  Department of Motor Vehicles shall adopt the regulations required

2-30  by section 1 of this act.

2-31      Sec. 3.  On or before February 1, 2007, the Director of the

2-32  Department of Motor Vehicles shall submit to the Director of the

2-33  Legislative Counsel Bureau for transmission to the 74th Session of

2-34  the Nevada Legislature an interim report regarding the pilot program

2-35  established pursuant to section 1 of this act.

2-36      Sec. 4.  This act becomes effective on July 1, 2003, and expires

2-37  by limitation on June 30, 2007.
