AN ACT relating to public personnel; prohibiting false or fraudulent complaints against a public officer or employee; providing a penalty; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. Chapter 281 of NRS is hereby amended by adding

1-2  thereto a new section to read as follows:

1-3  1.  A person who knowingly files a false or fraudulent written

1-4  complaint or allegation of misconduct against a public officer or

1-5  public employee for conduct in the course and scope of the

1-6  employment of the public officer or public employee is guilty of a

1-7  misdemeanor.

1-8  2.  As used in this section, “public employee” means a person

1-9  who performs public duties for compensation paid by the State, a

1-10  county, city, local government or other political subdivision of the

1-11  State or an agency thereof.

1-12      Sec. 2.  NRS 199.325 is hereby repealed.

1-13      Sec. 3.  This act becomes effective on July 1, 2003.


 

 

2-1  TEXT OF REPEALED SECTION

 

 

2-2  199.325  Filing false or fraudulent complaint or allegation of

2-3  misconduct against peace officer.

2-4  1.  A person who knowingly files a false or fraudulent written

2-5  complaint or allegation of misconduct against a peace officer for

2-6  conduct in the course and scope of his employment is guilty of a

2-7  misdemeanor.

2-8  2.  As used in this section, “peace officer” has the meaning

2-9  ascribed to it in NRS 289.010.
