AN ACT relating to insurance; revising provisions relating to health insurance for small employers; changing the method for determining whether the requirements for minimum participation are satisfied; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. NRS 689C.170 is hereby amended to read as

1-2  follows:

1-3  689C.170  1.  A carrier serving small employers may vary the

1-4  application of requirements for minimum participation of eligible

1-5  employees and minimum employer’s contributions only by the size

1-6  of the small employer’s group.

1-7  2.  In applying requirements for minimum participation with

1-8  respect to a small employer[, a carrier shall not consider employees

1-9  or dependents who have creditable coverage when determining] and

1-10  in calculating whether the applicable percentage of participation is

1-11  met, [but may consider] a carrier:

1-12      (a) Shall include in the calculation all employees or

1-13  dependents who have other creditable coverage [under another

1-14  health benefit plan] that is sponsored by the small employer.

1-15      (b) Shall exclude from the calculation all employees or

1-16  dependents who have other creditable coverage that is not

1-17  sponsored by the small employer.


2-1  3.  A carrier shall not deny an application for coverage solely

2-2  because the applicant works in a certain industry.

2-3  4.  After a small employer has been accepted for coverage, a

2-4  carrier shall not increase any requirement for minimum employee

2-5  participation or modify any requirement for minimum employer

2-6  contribution applicable to the small employer.
