AN ACT relating to firearms; authorizing certain governing bodies to regulate the carrying of unconcealed firearms upon public property at special events; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. NRS 244.364 is hereby amended to read as follows:

1-2  244.364  1.  Except as otherwise provided by specific statute,

1-3  the Legislature reserves for itself such rights and powers as are

1-4  necessary to regulate the transfer, sale, purchase, possession,

1-5  ownership, transportation, registration and licensing of firearms and

1-6  ammunition in Nevada, and no county may infringe upon those

1-7  rights and powers.

1-8  2.  A board of county commissioners may proscribe by

1-9  ordinance or regulation the unsafe discharge of firearms.

1-10      3.  A board of county commissioners may proscribe by

1-11  ordinance or regulation the carrying of an unconcealed firearm

1-12  by any person, other than a peace officer who is performing his

1-13  official duties, upon any public property at which a special event is

1-14  being held.

1-15      4.  As used in this section[, “firearm”] :

1-16      (a) “Firearm” means any weapon from which a projectile is

1-17  discharged by means of an explosive, spring, gas, air or other force.


2-1  (b) “Peace officer” includes any person upon whom some or

2-2  all of the powers of a peace officer are conferred pursuant to NRS

2-3  289.150 to 289.360, inclusive.

2-4  (c) “Special event” means any scheduled activity or event that:

2-5       (1) Is attended or observed by more than 500 persons; or

2-6       (2) Substantially increases or disrupts the normal flow of

2-7  traffic on any street or highway.

2-8  Sec. 2.  NRS 268.418 is hereby amended to read as follows:

2-9  268.418  1.  Except as otherwise provided by specific statute,

2-10  the Legislature reserves for itself such rights and powers as are

2-11  necessary to regulate the transfer, sale, purchase, possession,

2-12  ownership, transportation, registration and licensing of firearms and

2-13  ammunition in Nevada, and no city may infringe upon those rights

2-14  and powers.

2-15      2.  The governing body of a city may proscribe by ordinance or

2-16  regulation the unsafe discharge of firearms.

2-17      3.  The governing body of a city may proscribe by ordinance

2-18  or regulation the carrying of an unconcealed firearm by any

2-19  person, other than a peace officer who is performing his official

2-20  duties, upon any public property at which a special event is being

2-21  held.

2-22      4.  As used in this section[, “firearm”] :
