AN ACT relating to motor vehicles; eliminating the requirement that the driver and passenger of a motorcycle being driven on a highway wear protective headgear; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. NRS 486.231 is hereby amended to read as follows:

1-2  486.231  1.  The Department shall adopt standards for

1-3  [protective headgear and] protective glasses, goggles or face shields

1-4  to be worn by the drivers and passengers of motorcycles and

1-5  transparent windscreens for motorcycles.

1-6  2.  Except as otherwise provided in this section, when any

1-7  motorcycle[, except a trimobile or moped,] is being driven on a

1-8  highway, the driver and passenger shall wear [protective headgear

1-9  securely fastened on the head and] protective glasses, goggles or

1-10  face shields meeting those standards. [Drivers and passengers of

1-11  trimobiles shall wear protective glasses, goggles or face shields

1-12  which meet those standards.]

1-13      3.  When a motorcycle [or a trimobile] is equipped with a

1-14  transparent windscreen meeting those standards, the driver and

1-15  passenger are not required to wear protective glasses, goggles or

1-16  face shields.


2-1  4.  When a motorcycle is being driven in a parade authorized by

2-2  a local authority, the driver and passenger are not required to wear

2-3  the protective devices provided for in this section.

2-4  5.  When a three-wheel motorcycle[,] on which the driver and

2-5  passengers ride within an enclosed cab[,] is being driven on a

2-6  highway, the driver and passengers are not required to wear the

2-7  protective devices required by this section.

2-8  Sec. 2.  NRS 486.241 is hereby amended to read as follows:

2-9  486.241  1.  A person shall not sell, offer for sale or distribute

2-10  any protective [headgear,] glasses, goggles or face shields for use by

2-11  any drivers or passengers of motorcycles or transparent windscreens

2-12  for motorcycles unless the equipment is of a type and specification

2-13  meeting the standards therefor adopted by the Department.

2-14      2.  The provisions of this section do not prohibit the sale of

2-15  protective [headgear,] glasses, goggles or face shields which comply

2-16  with the rules and regulations adopted by the United States

2-17  Department of Transportation.
