AN ACT relating to industrial insurance; requiring the payment of compensation for the lost wages of certain injured employees who receive medical treatment; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. Chapter 616C of NRS is hereby amended by adding

1-2  thereto a new section to read as follows:

1-3  1.  In addition to any other benefits an injured employee is

1-4  entitled to receive pursuant to chapters 616A to 617, inclusive, of

1-5  NRS, an injured employee who receives medical treatment for his

1-6  injury after he returns to work is entitled to receive compensation

1-7  at his regular hourly rate of pay for each hour he is absent from

1-8  work for the purpose of receiving such medical treatment.

1-9  2.  An injured employee may not be required to use sick leave,

1-10  annual leave, compensatory leave or any other leave for his

1-11  absence from work for the purpose of receiving medical treatment

1-12  pursuant to subsection 1.

1-13      Sec. 2.  The act applies only to medical treatment which an

1-14  injured employee receives on or after July 1, 2003, regardless of

1-15  when the injury occurred.

1-16      Sec. 3.  This act becomes effective on July 1, 2003.
