AN ACT relating to correctional officers; requiring certain correctional officers employed by the Department of Corrections to be certified by the Peace Officers’ Standards and Training Commission before performing certain responsibilities; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. NRS 289.550 is hereby amended to read as follows:
1-2 289.550 1. Except as otherwise provided in [subsection 2,]
1-3 subsections 2 and 3, a person upon whom some or all of the powers
1-4 of a peace officer are conferred pursuant to NRS 289.150 to
1-5 289.360, inclusive, must be certified by the Commission within 1
1-6 year after the date on which the person commences employment as a
1-7 peace officer unless the Commission, for good cause shown, grants
1-8 in writing an extension of time, which must not exceed 6 months, by
1-9 which the person must become certified. A person who fails to
1-10 become certified within the required time shall not exercise any of
1-11 the powers of a peace officer after the time for becoming certified
1-12 has expired.
1-13 2. The following persons are not required to be certified by the
1-14 Commission:
2-1 (a) The Chief Parole and Probation Officer;
2-2 (b) The Director of the Department of Corrections;
2-3 (c) The State Fire Marshal;
2-4 (d) The Director of the Department of Public Safety, the deputy
2-5 directors of the Department, the chiefs of the divisions of the
2-6 Department other than the Investigation Division, and the members
2-7 of the State Disaster Identification Team of the Division of
2-8 Emergency Management of the Department;
2-9 (e) The Commissioner of Insurance and his chief deputy;
2-10 (f) Railroad policemen; and
2-11 (g) California correctional officers.
2-12 3. A correctional officer employed by the Department of
2-13 Corrections who is assigned the responsibilities set forth in
2-14 subsection 5 of NRS 209.131 must be certified by the Commission
2-15 before performing any of those responsibilities.
2-16 Sec. 2. This act becomes effective on July 1, 2003.
