AN ACT relating to vehicles; requiring certain trailers sold by certain persons in Nevada to be equipped with brakes that comply with the traffic laws of this state; providing a penalty; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 482 of NRS is hereby amended by adding
1-2 thereto a new section to read as follows:
1-3 1. Except as otherwise provided in subsection 2, it is unlawful
1-4 for a person to sell, offer to sell or display for sale a trailer,
1-5 semitrailer, house trailer or pole trailer that is subject to the
1-6 provisions of NRS 484.593 to 484.605, inclusive, and intended to
1-7 be operated upon a highway in this state unless such trailer is
1-8 equipped with brakes which conform to the requirements set forth
1-9 in those sections.
1-10 2. The prohibition set forth in subsection 1 applies only to a
1-11 broker, dealer, distributor, lessor, manufacturer or salesman who:
1-12 (a) Is licensed pursuant to this chapter; and
1-13 (b) In his capacity as a broker, dealer, distributor, lessor,
1-14 manufacturer or salesman, sells, offers to sell or displays for sale
1-15 a trailer, semitrailer, house trailer or pole trailer.
2-1 3. A person who violates any of the provisions of this section
2-2 is guilty of a misdemeanor.
2-3 4. As used in this section:
2-4 (a) “House trailer” has the meaning ascribed to it in
2-5 NRS 484.069.
2-6 (b) “Pole trailer” has the meaning ascribed to it in
2-7 NRS 484.116.
2-8 (c) “Semitrailer” has the meaning ascribed to it in
2-9 NRS 484.168.
2-10 (d) “Trailer” has the meaning ascribed to it in NRS 484.207.
2-11 Sec. 2. NRS 482.544 is hereby amended to read as follows:
2-12 482.544 As used in NRS 482.544 to 482.553, inclusive, and
2-13 section 1 of this act, unless the context otherwise requires,
2-14 “identification number or mark” means:
2-15 1. The motor number, other distinguishing number or
2-16 identification mark of a vehicle required or employed for purposes
2-17 of registration; or
2-18 2. The identification number or other distinguishing number or
2-19 identification mark of a vehicle or part of a motor vehicle that was
2-20 placed or stamped on that vehicle or part by the manufacturer
2-21 pursuant to federal law or regulations.
