AN ACT relating to the control of mold; directing the Legislative Commission to appoint a subcommittee to conduct a study relating to mold in structures; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. 1. The Legislative Commission shall appoint a
1-2 subcommittee to conduct a study relating to mold in structures. The
1-3 subcommittee must consist of three members of the Senate and three
1-4 members of the Assembly. At least one member appointed from
1-5 each House must be appointed from the membership of the
1-6 respective standing committees on Commerce and Labor during the
1-7 immediately preceding session of the Legislature.
1-8 2. The study must include, but is not limited to:
1-9 (a) Standards, procedures, and techniques for the inspection and
1-10 testing for mold, including, but not limited to, visual inspection,
1-11 surface sampling, air monitoring and laboratory analysis;
1-12 (b) Standards, procedures and techniques for the remediation of
1-13 mold, including, but not limited to, procedures and techniques for
1-14 the enclosure or removal of mold or material containing mold from
1-15 a building or structure, including any associated mechanical systems
1-16 inside or outside the building or structure;
2-1 (c) Standards, procedures and techniques for the disposal of
2-2 mold and material containing mold;
2-3 (d) Standards for the assessment of the exposure of occupants of
2-4 a building or structure to mold, including, but not limited to,
2-5 assessing the need to respond to the presence of mold, and to
2-6 determine which buildings or structures are most in need of such a
2-7 response;
2-8 (e) Standards and qualifications for the licensing of persons
2-9 engaged in the control of mold, including testing and inspecting for
2-10 mold, and remediation of mold; and
2-11 (f) Standards and qualifications for trainers and courses of
2-12 education for licensees engaged in inspecting and testing for mold
2-13 and in remediation of mold.
2-14 3. The subcommittee shall seek information from various
2-15 representatives of persons who inspect and test for mold, contractors
2-16 who engage in the remediation of mold, insurers who cover damage
2-17 to structures caused by water intrusion, health experts with
2-18 experience in studying, detecting and eliminating mold and in
2-19 treating patients with mold-related health problems, and public
2-20 agencies involved with regulating mold control projects, contractors
2-21 and public health.
2-22 4. Any legislation recommended by the subcommittee must be
2-23 approved by a majority of the members of the Assembly and by a
2-24 majority of the members of the Senate appointed to the
2-25 subcommittee.
2-26 5. The Legislative Commission shall submit a report of the
2-27 results of the study and any recommendations for legislation to the
2-28 73rd Session of the Nevada Legislature.
2-29 Sec. 2. This act becomes effective on July 1, 2003.
