AN ACT relating to insurance; requiring the Commissioner of Insurance to prescribe a form for the use of employers when applying for health insurance under certain circumstances; requiring providers of insurance offering health insurance to accept a prescribed form from certain applicants; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section. 1. Chapter 687B of NRS is hereby amended by
1-2 adding thereto a new section to read as follows:
1-3 1. The Commissioner shall prescribe by regulation a form to
1-4 be used by an employer applying for health insurance for his
1-5 employees.
1-6 2. A provider of insurance who offers a policy of health
1-7 insurance:
1-8 (a) Shall accept the form prescribed by the Commissioner
1-9 pursuant to this section as an application for health insurance if
1-10 the form is submitted by an employer applying for health
1-11 insurance for his employees; and
1-12 (b) Shall not require an employer applying for health
1-13 insurance for his employees to submit any material other than the
1-14 form prescribed by the Commissioner pursuant to this section
2-1 when the employer is applying for health insurance for his
2-2 employees.
2-3 3. As used in this section, “material” includes, without
2-4 limitation, any documents or information other than the
2-5 information contained in the form prescribed by the
2-6 Commissioner pursuant to this section.
2-7 Sec. 2. This act becomes effective upon passage and approval
2-8 for the purpose of adopting any regulations necessary to carry out
2-9 the provisions of this act, and on October 1, 2003, for all other
2-10 purposes.
