AN ACT relating to administrative assessments; providing for an additional administrative assessment to be collected in cases involving a misdemeanor to pay for certain programs established by district courts; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 176 of NRS is hereby amended to read as
1-2 follows:
1-3 1. The justices or judges of the justices’ or municipal courts
1-4 shall impose, in addition to an administrative assessment imposed
1-5 pursuant to NRS 176.059 and 176.0611, an administrative
1-6 assessment for the provision of specialty court programs.
1-7 2. Except as otherwise provided in subsection 3, when a
1-8 defendant pleads guilty or is found guilty of a misdemeanor,
1-9 including the violation of any municipal ordinance, the justice or
1-10 judge shall include in the sentence the sum of $15 as an
1-11 administrative assessment for the provision of specialty court
1-12 programs and render a judgment against the defendant for the
1-13 assessment.
2-1 3. The provisions of subsection 2 do not apply to:
2-2 (a) An ordinance regulating metered parking; or
2-3 (b) An ordinance which is specifically designated as imposing
2-4 a civil penalty or liability pursuant to NRS 244.3575 or 268.019.
2-5 4. The money collected for an administrative assessment for
2-6 the provision of specialty court programs must not be deducted
2-7 from the fine imposed by the justice or judge but must be taxed
2-8 against the defendant in addition to the fine. The money collected
2-9 for such an administrative assessment must be stated separately on
2-10 the court’s docket and must be included in the amount posted for
2-11 bail. If the defendant is found not guilty or the charges are
2-12 dismissed, the money deposited with the court must be returned to
2-13 the defendant. If the justice or judge cancels a fine because the
2-14 fine has been determined to be uncollectible, any balance of the
2-15 fine and the administrative assessment remaining unpaid shall be
2-16 deemed to be uncollectible and the defendant is not required to
2-17 pay it. If a fine is determined to be uncollectible, the defendant is
2-18 not entitled to a refund of the fine or administrative assessment he
2-19 has paid and the justice or judge shall not recalculate the
2-20 administrative assessment.
2-21 5. If the justice or judge permits the fine and administrative
2-22 assessment for the provision of specialty court programs to be paid
2-23 in installments, the payments must be applied in the following
2-24 order:
2-25 (a) To pay the unpaid balance of an administrative assessment
2-26 imposed pursuant to NRS 176.059;
2-27 (b) To pay the unpaid balance of an administrative assessment
2-28 for the provision of court facilities pursuant to NRS 176.0611;
2-29 (c) To pay the unpaid balance of an administrative assessment
2-30 for the provision of specialty court programs; and
2-31 (d) To pay the fine.
2-32 6. The money collected for an administrative assessment for
2-33 the provision of specialty court programs in municipal court must
2-34 be paid by the clerk of the court to the city treasurer on or before
2-35 the fifth day of each month for the preceding month. On or before
2-36 the 15th day of that month, the city treasurer shall:
2-37 (a) If a specialty court program has been established by a
2-38 district court within the county in which the municipal court that
2-39 collected the assessment is located, credit the money received to a
2-40 special account in the county general fund to pay for any such
2-41 program. Any money remaining in the special account after 2
2-42 fiscal years must be deposited in the county general fund if it has
2-43 not been committed for expenditure. The county treasurer shall
2-44 provide, upon request of a district court that has established a
3-1 specialty court program, monthly reports of the revenue credited to
3-2 and expenditures made from the special account.
3-3 (b) If a specialty court program has not been established by a
3-4 district court within the county in which the municipal court that
3-5 collected the assessment is located, deposit the money received
3-6 with the State Controller for credit to a special account in the State
3-7 General Fund for allocation to courts that have established such a
3-8 program. Upon a determination of the need for additional funds, a
3-9 district court that has established a specialty court program may
3-10 submit a proposal to the Interim Finance Committee, or the
3-11 Senate Standing Committee on Finance and the Assembly
3-12 Standing Committee on Ways and Means when the Legislature is
3-13 in general session. Upon approval of the proposal by the
3-14 appropriate committee or committees, the money may be so
3-15 expended. Money that remains in the account at the end of the
3-16 fiscal year does not revert to the State General Fund, and the
3-17 balance in the account must be carried forward to the next fiscal
3-18 year.
3-19 7. The money collected for administrative assessments in
3-20 justices’ courts must be paid by the clerk of the court to the county
3-21 treasurer on or before the fifth day of each month for the
3-22 preceding month. On or before the 15th day of that month, the
3-23 county treasurer shall:
3-24 (a) If a specialty court program has been established by a
3-25 district court within the county in which the justice court that
3-26 collected the assessment is located, credit the money received to a
3-27 special account in the county general fund to pay for any such
3-28 program. Any money remaining in the special account after 2
3-29 fiscal years must be deposited in the county general fund if it has
3-30 not been committed for expenditure. The county treasurer shall
3-31 provide, upon request of a district court that has established a
3-32 specialty court program, monthly reports of the revenue credited to
3-33 and expenditures made from the special account.
3-34 (b) If a specialty court program has not been established
3-35 within the county in which the justice court that collected the
3-36 assessment is located, deposit the money received with the State
3-37 Controller for credit to a special account in the State General
3-38 Fund for allocation to courts that have established such a
3-39 program. Upon a determination of the need for additional funds, a
3-40 district court that has established a specialty court program may

4-5 8. Money that is apportioned to a district court from
4-6 administrative assessments for the provision of specialty court
4-7 programs must be used by the court to:
4-8 (a) Pay for the treatment and testing of persons who
4-9 participate in the program; and
4-10 (b) Improve the operations of the specialty court program by
4-11 any combination of:
4-12 (1) Acquiring necessary capital goods;
4-13 (2) Providing training and education to personnel;
4-14 (3) Studying the management and operation of the
4-15 program;
4-16 (4) Conducting audits of the program;
4-17 (5) Supplementing the funds used to pay for judges to
4-18 oversee a specialty court program; or
4-19 (6) Acquiring or using appropriate technology.
4-20 9. As used in this section, “specialty court program” means a
4-21 program established by a district court to facilitate testing,
4-22 treatment and oversight of certain persons over whom the court
4-23 has jurisdiction and who the court has determined suffers from a
4-24 mental illness or abuses alcohol or drugs. Such a program
4-25 includes, without limitation, a program established pursuant to
4-26 NRS 176A.250 or 453.580.
4-27 Sec. 2. NRS 176.0611 is hereby amended to read as follows:
4-28 176.0611 1. A county or a city, upon recommendation of the
4-29 appropriate court, may, by ordinance, authorize the justices or
4-30 judges of the justices’ or municipal courts within its jurisdiction to
4-31 impose for not longer than 25 years, in addition to [an
4-32 administrative assessment] the administrative assessments imposed
4-33 pursuant to NRS 176.059[,] and section 1 of this act, an
4-34 administrative assessment for the provision of court facilities.
4-35 2. Except as otherwise provided in subsection 3, in any
4-36 jurisdiction in which an administrative assessment for the provision
4-37 of court facilities has been authorized, when a defendant pleads
4-38 guilty or guilty but mentally ill or is found guilty of a misdemeanor,
4-39 including the violation of any municipal ordinance, the justice or
4-40 judge shall include in the sentence the sum of $10 as an
4-41 administrative assessment for the provision of court facilities and
4-42 render a judgment against the defendant for the assessment.
4-43 3. The provisions of subsection 2 do not apply to:
4-44 (a) An ordinance regulating metered parking; or
5-1 (b) An ordinance that is specifically designated as imposing a
5-2 civil penalty or liability pursuant to NRS 244.3575 or 268.019.
5-3 4. The money collected for an administrative assessment for
5-4 the provision of court facilities must not be deducted from the fine
5-5 imposed by the justice or judge but must be taxed against the
5-6 defendant in addition to the fine. The money collected for such an
5-7 administrative assessment must be stated separately on the court’s
5-8 docket and must be included in the amount posted for bail. If the
5-9 defendant is found not guilty or the charges are dismissed, the
5-10 money deposited with the court must be returned to the defendant. If
5-11 the justice or judge cancels a fine because the fine has been
5-12 determined to be uncollectible, any balance of the fine and the
5-13 administrative assessment remaining unpaid shall be deemed to be
5-14 uncollectible and the defendant is not required to pay it. If a fine is
5-15 determined to be uncollectible, the defendant is not entitled to a
5-16 refund of the fine or administrative assessment he has paid and the
5-17 justice or judge shall not recalculate the administrative assessment.
5-18 5. If the justice or judge permits the fine and administrative
5-19 assessment for the provision of court facilities to be paid in
5-20 installments, the payments must be applied in the following order:
5-21 (a) To pay the unpaid balance of an administrative assessment
5-22 imposed pursuant to NRS 176.059;
5-23 (b) To pay the unpaid balance of an administrative assessment
5-24 for the provision of court facilities pursuant to this section; [and]
5-25 (c) To pay the unpaid balance of an administrative assessment
5-26 for the provision of specialty court programs pursuant to section 1
5-27 of this act; and
5-28 (d) To pay the fine.
5-29 6. The money collected for administrative assessments for the
5-30 provision of court facilities in municipal courts must be paid by the
5-31 clerk of the court to the city treasurer on or before the fifth day of
5-32 each month for the preceding month. The city treasurer shall deposit
5-33 the money received in a special revenue fund. The city may use the
5-34 money in the special revenue fund only to:
5-35 (a) Acquire land on which to construct additional facilities for
5-36 the municipal courts or a regional justice center that includes the
5-37 municipal courts.
5-38 (b) Construct or acquire additional facilities for the municipal
5-39 courts or a regional justice center that includes the municipal courts.
5-40 (c) Renovate or remodel existing facilities for the municipal
5-41 courts.
5-42 (d) Acquire furniture, fixtures and equipment necessitated by the
5-43 construction or acquisition of additional facilities or the renovation
5-44 of an existing facility for the municipal courts or a regional justice
5-45 center that includes the municipal courts. This paragraph does not
6-1 authorize the expenditure of money from the fund for furniture,
6-2 fixtures or equipment for judicial chambers.
6-3 (e) Acquire advanced technology for use in the additional or
6-4 renovated facilities.
6-5 (f) Pay debt service on any bonds issued pursuant to subsection
6-6 3 of NRS 350.020 for the acquisition of land or facilities or the
6-7 construction or renovation of facilities for the municipal courts or a
6-8 regional justice center that includes the municipal courts.
6-9 Any money remaining in the special revenue fund after 5 fiscal
6-10 years must be deposited in the municipal general fund for the
6-11 continued maintenance of court facilities if it has not been
6-12 committed for expenditure pursuant to a plan for the construction or
6-13 acquisition of court facilities or improvements to court facilities.
6-14 The city treasurer shall provide, upon request by a municipal court,
6-15 monthly reports of the revenue credited to and expenditures made
6-16 from the special revenue fund.
6-17 7. The money collected for administrative assessments for the
6-18 provision of court facilities in justices’ courts must be paid by the
6-19 clerk of the court to the county treasurer on or before the fifth day of
6-20 each month for the preceding month. The county treasurer shall
6-21 deposit the money received to a special revenue fund. The county
6-22 may use the money in the special revenue fund only to:
6-23 (a) Acquire land on which to construct additional facilities for
6-24 the justices’ courts or a regional justice center that includes the
6-25 justices’ courts.
6-26 (b) Construct or acquire additional facilities for the justices’
6-27 courts or a regional justice center that includes the justices’ courts.
6-28 (c) Renovate or remodel existing facilities for the justices’
6-29 courts.
6-30 (d) Acquire furniture, fixtures and equipment necessitated by the
6-31 construction or acquisition of additional facilities or the renovation
6-32 of an existing facility for the justices’ courts or a regional justice
6-33 center that includes the justices’ courts. This paragraph does not
6-34 authorize the expenditure of money from the fund for furniture,
6-35 fixtures or equipment for judicial chambers.
6-36 (e) Acquire advanced technology for use in the additional or
6-37 renovated facilities.
6-38 (f) Pay debt service on any bonds issued pursuant to subsection
6-39 3 of NRS 350.020 for the acquisition of land or facilities or the
6-40 construction or renovation of facilities for the justices’ courts or a
6-41 regional justice center that includes the justices’ courts.
6-42 Any money remaining in the special revenue fund after 5 fiscal
6-43 years must be deposited in the county general fund for the continued
6-44 maintenance of court facilities if it has not been committed for
6-45 expenditure pursuant to a plan for the construction or acquisition of
7-1 court facilities or improvements to court facilities. The county
7-2 treasurer shall provide, upon request by a justice’s court, monthly
7-3 reports of the revenue credited to and expenditures made from the
7-4 special revenue fund.
7-5 8. If money collected pursuant to this section is to be used to
7-6 acquire land on which to construct a regional justice center, to
7-7 construct a regional justice center or to pay debt service on bonds
7-8 issued for these purposes, the county and the participating cities
7-9 shall, by interlocal agreement, determine such issues as the size of
7-10 the regional justice center, the manner in which the center will be
7-11 used and the apportionment of fiscal responsibility for the center.
7-12 Sec. 3. NRS 179.225 is hereby amended to read as follows:
7-13 179.225 1. If the punishment of the crime is the confinement
7-14 of the criminal in prison, the expenses must be paid from money
7-15 appropriated to the Office of the Attorney General for that purpose,
7-16 upon approval by the State Board of Examiners. After the
7-17 appropriation is exhausted, the expenses must be paid from the
7-18 Reserve for Statutory Contingency Account upon approval by the
7-19 State Board of Examiners. In all other cases, they must be paid out
7-20 of the county treasury in the county wherein the crime is alleged to
7-21 have been committed. The expenses are:
7-22 (a) If the prisoner is returned to this state from another state, the
7-23 fees paid to the officers of the state on whose governor the
7-24 requisition is made;
7-25 (b) If the prisoner is returned to this state from a foreign country
7-26 or jurisdiction, the fees paid to the officers and agents of this state or
7-27 the United States; or
7-28 (c) If the prisoner is temporarily returned for prosecution to this
7-29 state from another state pursuant to this chapter or chapter 178 of
7-30 NRS and is then returned to the sending state upon completion
7-31 of the prosecution, the fees paid to the officers and agents of
7-32 this state,
7-33 and the necessary traveling expenses and subsistence allowances in
7-34 the amounts authorized by NRS 281.160 incurred in returning the
7-35 prisoner.
7-36 2. If a person is returned to this state pursuant to this chapter or
7-37 chapter 178 of NRS and is convicted of, or pleads guilty, guilty but
7-38 mentally ill or nolo contendere to the criminal charge for which he
7-39 was returned or a lesser criminal charge, the court shall conduct an
7-40 investigation of the financial status of the person to determine his
7-41 ability to make restitution. In conducting the investigation, the court
7-42 shall determine if the person is able to pay any existing obligations
7-43 for:
7-44 (a) Child support;
7-45 (b) Restitution to victims of crimes; and
8-1 (c) Any administrative assessment required to be paid pursuant
8-2 to NRS 62.2175, 176.059 , 176.0611 and 176.062[.] and section 1
8-3 of this act.
8-4 3. If the court determines that the person is financially able to
8-5 pay the obligations described in subsection 2, it shall, in addition to
8-6 any other sentence it may impose, order the person to make
8-7 restitution for the expenses incurred by the Attorney General or
8-8 other governmental entity in returning him to this state. The court
8-9 shall not order the person to make restitution if payment of
8-10 restitution will prevent him from paying any existing obligations
8-11 described in subsection 2. Any amount of restitution remaining
8-12 unpaid constitutes a civil liability arising upon the date of the
8-13 completion of his sentence.
8-14 4. The Attorney General may adopt regulations to carry out the
8-15 provisions of this section.
8-16 Sec. 4. NRS 211.245 is hereby amended to read as follows:
8-17 211.245 1. If a prisoner fails to make a payment within 10
8-18 days after it is due, the district attorney for a county or the city
8-19 attorney for an incorporated city may file a civil action in any court
8-20 of competent jurisdiction within this state seeking recovery of:
8-21 (a) The amount of reimbursement due;
8-22 (b) Costs incurred in conducting an investigation of the financial
8-23 status of the prisoner; and
8-24 (c) Attorney’s fees and costs.
8-25 2. A civil action brought pursuant to this section must:
8-26 (a) Be instituted in the name of the county or city in which the
8-27 jail, detention facility or alternative program is located;
8-28 (b) Indicate the date and place of sentencing, including, without
8-29 limitation, the name of the court which imposed the sentence;
8-30 (c) Include the record of judgment of conviction, if available;
8-31 (d) Indicate the length of time served by the prisoner and, if he
8-32 has been released, the date of his release; and
8-33 (e) Indicate the amount of reimbursement that the prisoner owes
8-34 to the county or city.
8-35 3. The county or city treasurer of the county or incorporated
8-36 city in which a prisoner is or was confined shall determine the
8-37 amount of reimbursement that the prisoner owes to the city or
8-38 county. The county or city treasurer may render a sworn statement
8-39 indicating the amount of reimbursement that the prisoner owes and
8-40 submit the statement in support of a civil action brought pursuant to
8-41 this section. Such a statement is prima facie evidence of the amount
8-42 due.
8-43 4. A court in a civil action brought pursuant to this section may
8-44 award a money judgment in favor of the county or city in whose
8-45 name the action was brought.
9-1 5. If necessary to prevent the disposition of the prisoner’s
9-2 property by the prisoner, or his spouse or agent, a county or city
9-3 may file a motion for a temporary restraining order. The court may,
9-4 without a hearing, issue ex parte orders restraining any person from
9-5 transferring, encumbering, hypothecating, concealing or in any way
9-6 disposing of any property of the prisoner, real or personal, whether
9-7 community or separate, except for necessary living expenses.
9-8 6. The payment, pursuant to a judicial order, of existing
9-9 obligations for:
9-10 (a) Child support or alimony;
9-11 (b) Restitution to victims of crimes; and
9-12 (c) Any administrative assessment required to be paid pursuant
9-13 to NRS 62.2175, 176.059 , 176.0611 and 176.062[,] and section 1
9-14 of this act,
9-15 has priority over the payment of a judgment entered pursuant to this
9-16 section.
9-17 Sec. 5. NRS 249.085 is hereby amended to read as follows:
9-18 249.085 On or before the 15th day of each month, the county
9-19 treasurer shall report to the State Controller the amount of the
9-20 administrative assessments paid by each justices’ court for the
9-21 preceding month pursuant to NRS 176.059[.] and section 1 of this
9-22 act.
9-23 Sec. 6. This act becomes effective on July 1, 2003.
