AN ACT relating to public officers; increasing the compensation of certain elected county officers; providing for such increase in compensation to be paid retroactively in certain circumstances; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. NRS 245.043 is hereby amended to read as follows:
1-2 245.043 1. As used in this section:
1-3 (a) “County” includes Carson City.
1-4 (b) “County commissioner” includes the Mayor and supervisors
1-5 of Carson City.
1-6 2. Except as otherwise provided by any special law, the elected
1-7 officers of the counties of this state are entitled to receive annual
1-8 salaries in the base amounts specified in the following table. The
1-9 annual salaries are in full payment for all services required by law to
1-10 be performed by such officers. Except as otherwise provided by law,
1-11 all fees and commissions collected by such officers in the
1-12 performance of their duties must be paid into the county treasury
1-13 each month without deduction of any nature.

3-1 Sec. 2. 1. Except as otherwise provided in this section, the
3-2 increases in annual salaries of the elected officers of a county set
3-3 forth in the table of annual salaries contained in NRS 245.043, as
3-4 amended by this act, must be paid retroactively to January 6, 2003.
3-5 2. The board of county commissioners of a county may apply
3-6 to the Committee on Local Government Finance for a waiver from
3-7 the applicability of subsection 1, if the board determines that the
3-8 county did not, during the period from July 1, 2002, through
3-9 June 30, 2003, increase the annual salaries of the employees and
3-10 officers of the county who are not elected. The Committee on Local
3-11 Government Finance shall grant such a waiver if it finds that the
3-12 county did not, during the period from July 1, 2002, through
3-13 June 30, 2003, increase the annual salaries of the employees and
3-14 officers of the county who are not elected.
3-15 3. The waiver described in subsection 2 may be applied only to
3-16 the retroactive increase of annual salaries for the period from
3-17 January 6, 2003, through June 30, 2003. On and after July 1, 2003,
3-18 the increases in annual salaries of the elected officers of a county set
3-19 forth in subsection 2 of NRS 245.043, as amended by this act, must
3-20 be paid regardless of whether a county has increased the annual
3-21 salaries of the employees and officers of the county who are not
3-22 elected.
3-23 Sec. 3. The provisions of subsection 1 of NRS 354.599 do not
3-24 apply to any additional expenses of a local government that are
3-25 related to the provisions of this act.
3-26 Sec. 4. This act becomes upon passage and approval.
