AN ACT relating to legislative committees; adding a representative of the general public to the membership of the Legislative Committee on Public Lands; providing the date for expiration of the Committee; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. NRS 218.5363 is hereby amended to read as

1-2  follows:

1-3  218.5363  1.  There is hereby established a Legislative

1-4  Committee on Public Lands consisting of three members of the

1-5  Senate, three members of the Assembly , [and] one elected officer

1-6  representing the governing body of a local political subdivision[,]

1-7  and one representative of the general public, appointed by the

1-8  Legislative Commission with appropriate regard for their experience

1-9  with and knowledge of matters relating to public lands. The

1-10  members who are State Legislators must be appointed to provide

1-11  representation from the various geographical regions of the State.

1-12      2.  The members of the Committee shall select a Chairman

1-13  from one house of the Legislature and a Vice Chairman from the

1-14  other. After the initial selection of a Chairman and a Vice Chairman,

1-15  each such officer shall hold office for a term of 2 years commencing


2-1  on July 1 of each odd-numbered year. If a vacancy occurs in

2-2  the Chairmanship or Vice Chairmanship, the members of the

2-3  Committee shall select a replacement for the remainder of the

2-4  unexpired term.

2-5  3.  Any member of the Committee who is not a candidate for

2-6  reelection or who is defeated for reelection continues to serve until

2-7  the convening of the next session of the Legislature.

2-8  4.  Vacancies on the Committee must be filled in the same

2-9  manner as original appointments.

2-10      Sec. 2.  NRS 218.5365 is hereby amended to read as follows:

2-11      218.5365  1.  The members of the Committee shall meet

2-12  throughout each year at the times and places specified by a call of

2-13  the Chairman or a majority of the Committee. The Research

2-14  Director of the Legislative Counsel Bureau or a person he has

2-15  designated shall act as the nonvoting recording Secretary. The

2-16  Committee shall prescribe regulations for its own management and

2-17  government. [Four] Five members of the Committee constitute a

2-18  quorum, and a quorum may exercise all the power and authority

2-19  conferred on the Committee.

2-20      2.  Except during a regular or special session of the Legislature,

2-21  the members of the Committee who are State Legislators are entitled

2-22  to receive the compensation provided for a majority of the members

2-23  of the Legislature during the first 60 days of the preceding session,

2-24  the per diem allowance provided for state officers and employees

2-25  generally and the travel expenses provided pursuant to NRS

2-26  218.2207 for each day of attendance at a meeting of the Committee

2-27  and while engaged in the business of the Committee. Per diem

2-28  allowances, compensation and travel expenses of the legislative

2-29  members of the Committee must be paid from the Legislative Fund.

2-30      3.  The member of the Committee who represents a local

2-31  political subdivision is entitled to receive the subsistence allowances

2-32  and travel expenses provided by law for his position for each day of

2-33  attendance at a meeting of the Committee and while engaged in the

2-34  business of the Committee, to be paid by his local political

2-35  subdivision.

2-36      4.  The member of the Committee who is a representative of

2-37  the general public serves without salary but is entitled to the per

2-38  diem allowance and travel expenses provided for state officers and

2-39  employees generally for each day of attendance at a meeting of the

2-40  Committee and while engaged in the business of the Committee, to

2-41  be paid from the Legislative Fund.

2-42      Sec. 3.  NRS 218.536, 218.5361, 218.5363, 218.5365,

2-43  218.5367, 218.5368, 218.5369 and 218.5371 are hereby repealed.

2-44      Sec. 4.  1.  This section and sections 1 and 2 of this act

2-45  become effective on July 1, 2003.


3-1  2.  Section 3 of this act becomes effective on July 1, 2005.
