AN ACT relating to local government; requiring the governing body of certain cities and counties to adopt ordinances regarding licensure of mobile and nonpermanent vehicle wash vendors; requiring the governing body to adopt an ordinance regarding the system for continuous wastewater recovery that must be used by such licensees; providing a penalty; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 244 of NRS is hereby amended by adding
1-2 thereto a new section to read as follows:
1-3 1. The board of county commissioners of a county whose
1-4 population is 100,000 or more shall adopt an ordinance that
1-5 specifies the requirements for a person to obtain a license to
1-6 provide services as a mobile vehicle wash vendor or a
1-7 nonpermanent vehicle wash vendor.
1-8 2. The board of county commissioners of such a county shall
1-9 adopt an ordinance setting forth the type of system that must be
1-10 used by mobile vehicle wash vendors and nonpermanent vehicle
2-1 wash vendors for the continuous recovery of wastewater during
2-2 the process of washing vehicles.
2-3 3. A violation of an ordinance adopted pursuant to this
2-4 section is a misdemeanor.
2-5 4. As used in this section:
2-6 (a) “Mobile vehicle wash vendor” means a person who
2-7 performs the service of washing vehicles, which service is
2-8 performed from the person’s vehicle or at another nonstationary
2-9 facility. The term does not include a person or entity, including,
2-10 without limitation, a scholastic, religious or community
2-11 organization, that washes vehicles for charitable purposes or to
2-12 raise funds for charitable purposes.
2-13 (b) “Nonpermanent vehicle wash vendor” means a person who
2-14 performs the service of washing vehicles, which service is
2-15 performed at a stationary facility at which the primary business is
2-16 not the provision of the service of washing vehicles. The term does
2-17 not include a person or entity, including, without limitation, a
2-18 scholastic, religious or community organization, that washes
2-19 vehicles for charitable purposes or to raise funds for charitable
2-20 purposes.
2-21 (c) “Wastewater” means water which, as a result of
2-22 commercial or industrial use, contains physical, chemical or
2-23 biological impurities.
2-24 Sec. 2. NRS 244.335 is hereby amended to read as follows:
2-25 244.335 1. Except as otherwise provided in subsection 2, the
2-26 board of county commissioners may:
2-27 (a) Regulate all character of lawful trades, callings, industries,
2-28 occupations, professions and business conducted in its county
2-29 outside of the limits of incorporated cities and towns.
2-30 (b) Except as otherwise provided in NRS 244.3359 and 576.128,
2-31 fix, impose and collect a license tax for revenue or for regulation, or
2-32 for both revenue and regulation, on such trades, callings, industries,
2-33 occupations, professions and business.
2-34 2. The county license boards have the exclusive power in their
2-35 respective counties to regulate entertainers employed by an
2-36 entertainment by referral service and the business of conducting a
2-37 dancing hall, escort service, entertainment by referral service or
2-38 gambling game or device permitted by law, outside of an
2-39 incorporated city. The county license boards may fix, impose and
2-40 collect license taxes for revenue or for regulation, or for both
2-41 revenue and regulation, on such employment and businesses.
2-42 3. No license to engage in any type of business may be granted
2-43 unless the applicant for the license signs an affidavit affirming that
2-44 the business has complied with the provisions of chapter 364A of
3-1 NRS. The county license board shall provide upon request an
3-2 application for a business license pursuant to chapter 364A of NRS.
3-3 4. No license to engage in business as a seller of tangible
3-4 personal property may be granted unless the applicant for the license
3-5 presents written evidence that:
3-6 (a) The Department of Taxation has issued or will issue a permit
3-7 for this activity, and this evidence clearly identifies the business by
3-8 name; or
3-9 (b) Another regulatory agency of the State has issued or will
3-10 issue a license required for this activity.
3-11 5. In a county whose population is 100,000 or more, no
3-12 license to engage in the business of providing services as a mobile
3-13 vehicle wash vendor or a nonpermanent vehicle wash vendor may
3-14 be granted unless the applicant for the license signs an affidavit
3-15 affirming that he:
3-16 (a) Understands the applicable laws relating to the discharge
3-17 of wastewater which is generated during the process of washing
3-18 vehicles; and
3-19 (b) Will comply with the provisions of any ordinance adopted
3-20 pursuant to section 1 of this act.
3-21 6. Any license tax levied for the purposes of NRS 244.3358 or
3-22 244A.597 to 244A.655, inclusive, constitutes a lien upon the real
3-23 and personal property of the business upon which the tax was levied
3-24 until the tax is paid. The lien has the same priority as a lien for
3-25 general taxes. The lien must be enforced in the following manner:
3-26 (a) By recording in the office of the county recorder, within 6
3-27 months after the date on which the tax became delinquent or was
3-28 otherwise determined to be due and owing, a notice of the tax lien
3-29 containing the following:
3-30 (1) The amount of tax due and the appropriate year;
3-31 (2) The name of the record owner of the property;
3-32 (3) A description of the property sufficient for identification;
3-33 and
3-34 (4) A verification by the oath of any member of the board of
3-35 county commissioners or the county fair and recreation board; and
3-36 (b) By an action for foreclosure against the property in the same
3-37 manner as an action for foreclosure of any other lien, commenced
3-38 within 2 years after the date of recording of the notice of the tax
3-39 lien, and accompanied by appropriate notice to other lienholders.
3-40 [6.] 7. The board of county commissioners may delegate the
3-41 authority to enforce liens from taxes levied for the purposes of NRS
3-42 244A.597 to 244A.655, inclusive, to the county fair and recreation
3-43 board. If the authority is so delegated, the board of county
3-44 commissioners shall revoke or suspend the license of a business
3-45 upon certification by the county fair and recreation board that the
4-1 license tax has become delinquent, and shall not reinstate the license
4-2 until the tax is paid. Except as otherwise provided in NRS 244.3357,
4-3 all information concerning license taxes levied by an ordinance
4-4 authorized by this section or other information concerning the
4-5 business affairs or operation of any licensee obtained as a result of
4-6 the payment of such license taxes or as the result of any audit or
4-7 examination of the books by any authorized employee of a county
4-8 fair and recreation board of the county for any license tax levied for
4-9 the purpose of NRS 244A.597 to 244A.655, inclusive, is
4-10 confidential and must not be disclosed by any member, officer or
4-11 employee of the county fair and recreation board or the county
4-12 imposing the license tax unless the disclosure is authorized by the
4-13 affirmative action of a majority of the members of the appropriate
4-14 county fair and recreation board. Continuing disclosure may be so
4-15 authorized under an agreement with the Department of Taxation for
4-16 the exchange of information concerning taxpayers.
4-17 8. As used in this section:
4-18 (a) “Mobile vehicle wash vendor” has the meaning ascribed to
4-19 it in section 1 of this act.
4-20 (b) “Nonpermanent vehicle wash vendor” has the meaning
4-21 ascribed to it in section 1 of this act.
4-22 (c) “Wastewater” has the meaning ascribed to it in section 1 of
4-23 this act.
4-24 Sec. 3. Chapter 268 of NRS is hereby amended by adding
4-25 thereto a new section to read as follows:
4-26 1. The governing body of an incorporated city whose
4-27 population is 60,000 or more shall adopt an ordinance that
4-28 specifies the requirements for a person to obtain a license to
4-29 provide services as a mobile vehicle wash vendor or a
4-30 nonpermanent vehicle wash vendor.
4-31 2. The governing body of such a city shall adopt an ordinance
4-32 setting forth the type of system that must be used by mobile vehicle
4-33 wash vendors and nonpermanent vehicle wash vendors for the
4-34 continuous recovery of wastewater during the process of washing
4-35 vehicles.
4-36 3. A violation of an ordinance adopted pursuant to this
4-37 section is a misdemeanor.
4-38 4. As used in this section:
4-39 (a) “Mobile vehicle wash vendor” means a person who
4-40 performs the service of washing vehicles, which service is
4-41 performed from the person’s vehicle or at another nonstationary
4-42 facility. The term does not include a person or entity, including,
4-43 without limitation, a scholastic, religious or community
4-44 organization, that washes vehicles for charitable purposes or to
4-45 raise funds for charitable purposes.
5-1 (b) “Nonpermanent vehicle wash vendor” means a person who
5-2 performs the service of washing vehicles, which service is
5-3 performed at a stationary facility at which the primary business is
5-4 not the provision of the service of washing vehicles. The term does
5-5 not include a person or entity, including, without limitation, a
5-6 scholastic, religious or community organization, that washes
5-7 vehicles for charitable purposes or to raise funds for charitable
5-8 purposes.
5-9 (c) “Wastewater” means water which, as a result of
5-10 commercial or industrial use, contains physical, chemical or
5-11 biological impurities.
5-12 Sec. 4. NRS 268.095 is hereby amended to read as follows:
5-13 268.095 1. The city council or other governing body of each
5-14 incorporated city in this state, whether organized under general law
5-15 or special charter, may:
5-16 (a) Except as otherwise provided in NRS 268.0968 and 576.128,
5-17 fix, impose and collect for revenues or for regulation, or both, a
5-18 license tax on all character of lawful trades, callings, industries,
5-19 occupations, professions and businesses conducted within its
5-20 corporate limits.
5-21 (b) Assign the proceeds of any one or more of such license taxes
5-22 to the county within which the city is situated for the purpose or
5-23 purposes of making the proceeds available to the county:
5-24 (1) As a pledge as additional security for the payment of any
5-25 general obligation bonds issued pursuant to NRS 244A.597 to
5-26 244A.655, inclusive;
5-27 (2) For redeeming any general obligation bonds issued
5-28 pursuant to NRS 244A.597 to 244A.655, inclusive;
5-29 (3) For defraying the costs of collecting or otherwise
5-30 administering any such license tax so assigned, of the county fair
5-31 and recreation board and of officers, agents and employees hired
5-32 thereby, and of incidentals incurred thereby;
5-33 (4) For operating and maintaining recreational facilities
5-34 under the jurisdiction of the county fair and recreation board;
5-35 (5) For improving, extending and bettering recreational
5-36 facilities authorized by NRS 244A.597 to 244A.655, inclusive; and
5-37 (6) For constructing, purchasing or otherwise acquiring such
5-38 recreational facilities.
5-39 (c) Pledge the proceeds of any tax imposed on the revenues from
5-40 the rental of transient lodging pursuant to this section for the
5-41 payment of any general or special obligations issued by the city for
5-42 a purpose authorized by the laws of this state.
5-43 (d) Use the proceeds of any tax imposed pursuant to this section
5-44 on the revenues from the rental of transient lodging:
6-1 (1) To pay the principal, interest or any other indebtedness
6-2 on any general or special obligations issued by the city pursuant to
6-3 the laws of this state;
6-4 (2) For the expense of operating or maintaining, or both, any
6-5 facilities of the city; and
6-6 (3) For any other purpose for which other money of the city
6-7 may be used.
6-8 2. The proceeds of any tax imposed pursuant to this section
6-9 that are pledged for the repayment of general obligations may be
6-10 treated as “pledged revenues” for the purposes of NRS 350.020.
6-11 3. No license to engage in any type of business may be granted
6-12 unless the applicant for the license signs an affidavit affirming that
6-13 the business has complied with the provisions of chapter 364A of
6-14 NRS. The city licensing agency shall provide upon request an
6-15 application for a business license pursuant to chapter 364A of NRS.
6-16 4. No license to engage in business as a seller of tangible
6-17 personal property may be granted unless the applicant for the license
6-18 presents written evidence that:
6-19 (a) The Department of Taxation has issued or will issue a permit
6-20 for this activity, and this evidence clearly identifies the business by

6-37 same priority as a lien for general taxes. The lien must be enforced
6-38 in the following manner:

7-7 commenced within 2 years after the date of recording of the notice
7-8 of the tax lien, and accompanied by appropriate notice to other
7-9 lienholders.
7-10 [6.] 7. The city council or other governing body of each
7-11 incorporated city may delegate the power and authority to enforce
7-12 such liens to the county fair and recreation board. If the authority is
7-13 so delegated, the governing body shall revoke or suspend the license
7-14 of a business upon certification by the board that the license tax has
7-15 become delinquent, and shall not reinstate the license until the tax is
7-16 paid. Except as otherwise provided in NRS 268.0966, all
7-17 information concerning license taxes levied by an ordinance
7-18 authorized by this section or other information concerning the
7-19 business affairs or operation of any licensee obtained as a result of
7-20 the payment of those license taxes or as the result of any audit or
7-21 examination of the books of the city by any authorized employee of
7-22 a county fair and recreation board for any license tax levied for the
7-23 purpose of NRS 244A.597 to 244A.655, inclusive, is confidential
7-24 and must not be disclosed by any member, official or employee of
7-25 the county fair and recreation board or the city imposing the license
7-26 tax unless the disclosure is authorized by the affirmative action of a
7-27 majority of the members of the appropriate county fair and
7-28 recreation board. Continuing disclosure may be so authorized under
7-29 an agreement with the Department of Taxation for the exchange of
7-30 information concerning taxpayers.
7-31 [7.] 8. The powers conferred by this section are in addition and
7-32 supplemental to, and not in substitution for, and the limitations
7-33 imposed by this section do not affect the powers conferred by, any
7-34 other law. No part of this section repeals or affects any other law or
7-35 any part thereof, it being intended that this section provide a
7-36 separate method of accomplishing its objectives, and not an
7-37 exclusive one.
7-38 9. As used in this section:
7-39 (a) “Mobile vehicle wash vendor” has the meaning ascribed to
7-40 it in section 3 of this act.
7-41 (b) “Nonpermanent vehicle wash vendor” has the meaning
7-42 ascribed to it in section 3 of this act.
8-1 (c) “Wastewater” has the meaning ascribed to it in section 3 of
8-2 this act.
