AN ACT relating to employees; requiring employers to ensure that their employees comply with laws governing the registration of motor vehicles and obtaining drivers’ licenses; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 613 of NRS is hereby amended by adding
1-2 thereto a new section to read as follows:
1-3 1. Each employer shall confirm in the manner provided in
1-4 this section that all of its employees are in compliance with
1-5 chapter 482 of NRS concerning the registration of motor vehicles
1-6 and chapter 483 of NRS concerning drivers’ licenses.
1-7 2. Within 30 days after a person begins employment, the
1-8 person must provide evidence to his employer that he has:
1-9 (a) In the manner required pursuant to chapter 482 of NRS,
1-10 registered any motor vehicle that he owns and that will be used in
1-11 performing his duties of employment; and
1-12 (b) If he possesses a driver’s license, obtained a driver’s
1-13 license pursuant to chapter 483 of NRS,
2-1 or evidence that he is not required by law to register such a motor
2-2 vehicle or obtain such a license. An employer shall maintain the
2-3 evidence provided pursuant to this subsection.
2-4 3. The Department of Motor Vehicles may, upon request,
2-5 assist an employer in confirming that its employees have complied
2-6 with the requirements of this section.
2-7 4. As used in this section, “employer” means a private or
2-8 public employer in this state, including, without limitation, the
2-9 State of Nevada, an agency of this state or a county, city, township,
2-10 district or quasi-municipal corporation.
2-11 Sec. 2. Each person who is employed on October 1, 2003, by
2-12 an employer, as that term is defined in section 1 of this act, shall
2-13 provide the evidence prescribed in subsection 2 of that section on or
2-14 before January 1, 2004, to his employer.
