AN ACT relating to the State Forester Firewarden; authorizing the State Forester Firewarden to carry forward certain unexpended revenue and expend the money to purchase, repair and maintain certain equipment and vehicles; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 472 of NRS is hereby amended by adding
1-2 thereto the provisions set forth as sections 2 and 3 of this act.
1-3 Sec. 2. 1. Any revenue collected by the State Forester
1-4 Firewarden from the Federal Government, local governments and
1-5 other state governments for expenses incurred in the suppression
1-6 of fire or response to emergencies in a fiscal year, which is in
1-7 excess of the amounts authorized for expenditure from that
1-8 revenue source in the budgets of the State Forester Firewarden for
1-9 that fiscal year, does not lapse to the State General Fund but must
1-10 be carried forward to the next fiscal year.
1-11 2. The money carried forward pursuant to subsection 1 may
1-12 be expended or carried forward for an additional 2 fiscal years to
1-13 allow a sufficient amount of money to accumulate to carry out the
1-14 provisions of this section. The money may be carried forward for
2-1 more than 2 fiscal years upon request by the State Forester
2-2 Firewarden and approval by the Director of the Department of
2-3 Administration and the Interim Finance Committee.
2-4 3. The money carried forward pursuant to subsections 1 and
2-5 2 must only be used to purchase, repair and maintain equipment
2-6 and vehicles used by the Division of Forestry of the State
2-7 Department of Conservation and Natural Resources.
2-8 4. Before the State Forester Firewarden may commit money
2-9 for expenditure pursuant to subsection 3, a schedule of proposed
2-10 purchases, repairs and maintenance of equipment or vehicles
2-11 must be approved by the Interim Finance Committee upon
2-12 recommendation by the Director of the Department of
2-13 Administration.
2-14 Sec. 3. 1. Any money deposited in the Division of Forestry
2-15 Account pursuant to NRS 209.231 for the Conservation Camps
2-16 Budget in a fiscal year, which is in excess of the amounts
2-17 authorized for expenditure from that source in the Conservation
2-18 Camps Budget of the Division of Forestry for that fiscal year, does
2-19 not lapse to the State General Fund but must be carried forward to
2-20 the next fiscal year.
2-21 2. The money carried forward pursuant to subsection 1 may
2-22 be expended or carried forward for an additional 2 fiscal years to
2-23 allow a sufficient amount of money to accumulate to carry out the
2-24 provisions of this section. The money may be carried forward for
2-25 more than 2 fiscal years upon request by the State Forester
2-26 Firewarden and approval by the Director of the Department of
2-27 Administration and the Interim Finance Committee.
2-28 3. The money carried forward pursuant to subsections 1 and
2-29 2 must only be used to purchase, repair and maintain equipment
2-30 and vehicles used in the operation of conservation camps.
2-31 4. Before the State Forester Firewarden may commit money
2-32 for expenditure pursuant to subsection 3, a schedule of proposed
2-33 purchases, repairs and maintenance of equipment or vehicles
2-34 must be approved by the Interim Finance Committee upon
2-35 recommendation by the Director of the Department of
2-36 Administration.
2-37 Sec. 4. NRS 209.231 is hereby amended to read as follows:
2-38 209.231 1. Any money received from the operation of any
2-39 conservation camp established under this chapter or from the
2-40 assignment of any crew of a conservation camp to the extent that the
2-41 money is not used for salaries, overhead or operating expenses of
2-42 any camp or crew, must be placed in the Division of Forestry
2-43 Account.
2-44 2. [The] Except as otherwise provided in section 3 of this act,
2-45 the State Forester Firewarden, as Executive Head of the Division of
3-1 Forestry of the State Department of Conservation and Natural
3-2 Resources, may:
3-3 (a) Expend the money received pursuant to subsection 1 for:
3-4 (1) The renovation, repair or improvement of buildings and
3-5 real property for any conservation camp.
3-6 (2) The acquisition of special clothing, tools and equipment
3-7 and payment of expenses directly related to work projects performed
3-8 by a crew of a conservation camp such as, but not limited to, the
3-9 costs of utilities and operation of equipment.
3-10 (b) Direct all activities in connection with any renovation, repair
3-11 or improvement of buildings and real property for any conservation
3-12 camp or work project of a conservation camp.
3-13 Sec. 5. NRS 218.6827 is hereby amended to read as follows:
3-14 218.6827 1. Except as otherwise provided in subsections 2
3-15 and 3, the Interim Finance Committee may exercise the powers
3-16 conferred upon it by law only when the Legislature is not in regular
3-17 or special session.
3-18 2. During a regular session, the Interim Finance Committee
3-19 may also perform the duties imposed on it by subsection 5 of NRS
3-20 284.115, subsection 2 of NRS 321.335, NRS 322.007, subsection 2
3-21 of NRS 323.020, NRS 323.050, subsection 1 of NRS 323.100, NRS
3-22 353.220, 353.224, 353.2705 to 353.2771, inclusive, and 353.335,
3-23 paragraph (b) of subsection 4 of NRS 407.0762 and NRS 428.375,
3-24 439.620, 439.630, 445B.830 and 538.650[.] , and sections 2 and 3
3-25 of this act. In performing those duties, the Senate Standing
3-26 Committee on Finance and the Assembly Standing Committee on
3-27 Ways and Means may meet separately and transmit the results of
3-28 their respective votes to the Chairman of the Interim Finance
3-29 Committee to determine the action of the Interim Finance
3-30 Committee as a whole.
3-31 3. During a regular or special session, the Interim Finance
3-32 Committee may exercise the powers and duties conferred upon it
3-33 pursuant to the provisions of NRS 353.2705 to 353.2771, inclusive.
3-34 4. If the Interim Finance Committee determines that a
3-35 fundamental review of the base budget of a state agency is
3-36 necessary, it shall, by resolution, notify the Legislative Commission
3-37 of that finding for assignment of the review to a legislative
3-38 committee for the fundamental review of the base budgets of state
3-39 agencies established pursuant to NRS 218.5382.
3-40 Sec. 6. This act becomes effective upon passage and approval.
