AN ACT relating to education; providing for the adjustment of state funding to school districts when pupils drop out of school after the count of pupils is calculated; requiring the State Board of Education to adopt certain regulations; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 387 of NRS is hereby amended by adding
1-2 thereto a new section to read as follows:
1-3 1. The board of trustees of each school district and the
1-4 governing body of each charter school in this state shall, in
1-5 accordance with the regulations of the State Board, report to the
1-6 Department the number of pupils who were included in the count
1-7 of pupils for apportionment purposes pursuant to NRS 387.123 for
1-8 that school year but who dropped out of school after the count was
1-9 calculated. An adjustment to the computation of apportionments
1-10 to the school district or charter school must be made in
1-11 accordance with NRS 387.1243 with respect to such pupils in an
1-12 amount that is proportionate to the portion of the school year for
1-13 which the pupils dropped out of school.
2-1 2. The State Board:
2-2 (a) Shall adopt regulations establishing the dates by which the
2-3 board of trustees of a school district or the governing body of a
2-4 charter school must report the number of its pupils who have
2-5 dropped out; and
2-6 (b) May adopt such other regulations as necessary to carry out
2-7 the provisions of this section.
2-8 Sec. 2. NRS 387.1211 is hereby amended to read as follows:
2-9 387.1211 As used in NRS 387.121 to 387.126, inclusive[:] ,
2-10 and section 1 of this act:
2-11 1. “Average daily attendance” means the total number of pupils
2-12 attending a particular school each day during a period of reporting
2-13 divided by the number of days school is in session during that
2-14 period.
2-15 2. “Enrollment” means the count of pupils enrolled in and
2-16 scheduled to attend programs of instruction of a school district or a
2-17 charter school at a specified time during the school year.
2-18 3. “Special education program unit” means an organized unit
2-19 of special education and related services which includes full-time
2-20 services of persons licensed by the Superintendent of Public
2-21 Instruction or other appropriate licensing body, providing a program
2-22 of instruction in accordance with minimum standards prescribed by
2-23 the State Board.
2-24 Sec. 3. This act becomes effective on July 1, 2003.
