AN ACT relating to the State Public Works Board: requiring the Board to contract with a private person or business to perform certain duties in regard to certain projects for new construction or major repairs that are approved for the 2003-2005 biennium; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. 1.  Notwithstanding any other provision of law to

1-2  the contrary, the State Public Works Board shall, with respect to two

1-3  separate projects for new construction or major repairs that are

1-4  approved by the Legislature for the 2003-2005 biennium, solicit

1-5  bids for a contract for a private person or business to perform the

1-6  duties described in subsection 3. In carrying out the provisions of

1-7  this subsection, the Board may select one private person or business

1-8  to perform the duties described in subsection 3 in regard to both

1-9  such projects or the Board may select different private persons or

1-10  businesses to perform the duties described in subsection 3 in regard

1-11  to each such project.

1-12      2.  The Board shall award and execute each contract for which

1-13  bids are required to be solicited pursuant to subsection 1 as soon as

1-14  practicable after the projects for new construction or major repairs

1-15  are approved by the Legislature and selected by the Board. The cost

1-16  of each contract awarded and executed pursuant to this section must


2-1  be financed from the capital construction program approved by the

2-2  Legislature.

2-3  3.  The private person or business with whom the Board

2-4  contracts pursuant to subsections 1 and 2 shall:

2-5  (a) Before the letting of contracts for the applicable project,

2-6  assist and make recommendations to the Board with regard to, as

2-7  appropriate:

2-8       (1) The choosing of an architect for the project;

2-9       (2) The determination of the scope of the project;

2-10          (3) The determination of the design of the project;

2-11          (4) The handling and management of documents relating to

2-12  the construction of the project;

2-13          (5) The soliciting and acceptance of bids for the construction

2-14  of the project;

2-15          (6) If necessary, the revision of bids for the construction of

2-16  the project; and

2-17          (7) The letting of contracts for the construction of the

2-18  project; and

2-19      (b) After the letting of contracts for the applicable project:

2-20          (1) Supervise the work performed on the project;

2-21          (2) Inspect the work performed on the project; and

2-22          (3) Manage the work performed on the project.

2-23      Sec. 2.  This act becomes effective on July 1, 2003, and expires

2-24  by limitation on June 30, 2007.
