AN ACT relating to electricians; requiring the Division of Industrial Relations of the Department of Business and Industry to establish minimum standards for the education, training and certification of electricians; authorizing the Division to establish a schedule of fees for the certification of electricians; prohibiting a person from working as an electrician unless he holds a certificate as an electrician issued by the Division; prohibiting the State Contractors’ Board from issuing a license to, or renewing the license of, an electrician who does not hold a certificate as an electrician issued by the Division; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. Chapter 618 of NRS is hereby amended by adding

1-2  thereto the provisions set forth as sections 2 to 7, inclusive, of this

1-3  act.

1-4  Sec. 2.  As used in sections 2 to 7, inclusive, of this act, unless

1-5  the context otherwise requires, “electrician” means any person

1-6  who engages in the connection of electrical devices for electrical

1-7  contractors and includes, without limitation, any person who holds

1-8  a contractor’s license in the specialty of electrical contracting


2-1  issued by the State Contractors’ Board, but does not include a

2-2  person who only engages in:

2-3  1.  Electrical connections under 100 volt-amperes;

2-4  2.  Electrical connections for a utility regulated by the Public

2-5  Utilities Commission of Nevada, including, without limitation,

2-6  engaging in electrical connections within and without the facility

2-7  and property of the utility in furtherance of the generation,

2-8  transmission or distribution of natural gas or electricity; or

2-9  3.  Electrical work ordinarily and customarily performed by

2-10  stationary engineers.

2-11      Sec. 3.  The Division shall adopt regulations establishing

2-12  standards for the education and training of electricians, including,

2-13  without limitation, regulations:

2-14      1.  Requiring the establishment and implementation of

2-15  programs for the education, training and certification of

2-16  electricians;

2-17      2.  Requiring the annual certification of electricians; and

2-18      3.  Establishing a schedule of reasonable fees for the issuance

2-19  and renewal of a certificate as an electrician.

2-20      Sec. 4. 1.  The Division shall issue a certificate as an

2-21  electrician to a person who:

2-22      (a) Successfully completes the required education and training

2-23  established by the Division pursuant to section 3 of this act;

2-24      (b) Pays the required fee, if any, for the issuance of the

2-25  certificate; and

2-26      (c) Complies with all other requirements established by the

2-27  Division for the issuance of the certificate.

2-28      2.  A person shall not work as an electrician in this state

2-29  unless he holds a certificate as an electrician issued by the

2-30  Division pursuant to this section.

2-31      Sec. 5. 1.  An applicant for the issuance or renewal of a

2-32  certificate as an electrician shall submit with his application the

2-33  statement prescribed by the Welfare Division of the Department of

2-34  Human Resources pursuant to NRS 425.520. The statement must

2-35  be completed and signed by the applicant.

2-36      2.  The Division of Industrial Relations shall include the

2-37  statement required pursuant to subsection 1 in:

2-38      (a) The application or any other forms that must be submitted

2-39  for the issuance or renewal of the certificate; or

2-40      (b) A separate form prescribed by the Division.

2-41      3.  The Division shall not issue or renew a certificate as an

2-42  electrician if the applicant:

2-43      (a) Fails to submit the statement required pursuant to

2-44  subsection 1; or


3-1  (b) Indicates on the statement submitted pursuant to

3-2  subsection 1 that he is subject to a court order for the support of a

3-3  child and is not in compliance with the order or a plan approved

3-4  by the district attorney or other public agency enforcing the order

3-5  for the repayment of the amount owed pursuant to the order.

3-6  4.  If an applicant indicates on the statement submitted

3-7  pursuant to subsection 1 that he is subject to a court order for the

3-8  support of a child and is not in compliance with the order or a

3-9  plan approved by the district attorney or other public agency

3-10  enforcing the order for the repayment of the amount owed

3-11  pursuant to the order, the person to whom the application was

3-12  submitted shall advise the applicant to contact the district attorney

3-13  or other public agency enforcing the order to determine the

3-14  actions that the applicant may take to satisfy the arrearage.

3-15      Sec. 6. An application for the issuance of a certificate as an

3-16  electrician pursuant to sections 2 to 7, inclusive, of this act must

3-17  include the Social Security number of the applicant.

3-18      Sec. 7. 1.  If the Division receives a copy of a court order

3-19  issued pursuant to NRS 425.540 that provides for the suspension

3-20  of all professional, occupational and recreational licenses,

3-21  certificates and permits issued to a person who holds a certificate

3-22  as an electrician, the Division shall deem the certificate issued to

3-23  that person to be suspended at the end of the 30th day after the

3-24  date on which the court order was issued unless the Division

3-25  receives a letter issued by the district attorney or other public

3-26  agency pursuant to NRS 425.550 to the person who has been

3-27  issued the certificate stating that the person has complied with the

3-28  subpoena or warrant or has satisfied the arrearage pursuant to

3-29  NRS 425.560.

3-30      2.  The Division shall reinstate a certificate as an electrician

3-31  that has been suspended by a District Court pursuant to NRS

3-32  425.540 if the Division receives a letter issued by the district

3-33  attorney or other public agency pursuant to NRS 425.550 to the

3-34  electrician whose certificate was suspended stating that

3-35  the electrician whose certificate was suspended has complied with

3-36  the subpoena or warrant or has satisfied the arrearage pursuant to

3-37  NRS 425.560.

3-38      Sec. 8.  Chapter 624 of NRS is hereby amended by adding

3-39  thereto a new section to read as follows:

3-40      The Board shall not issue or renew a specialty license in

3-41  electrical contracting to any person who does not hold a certificate

3-42  as an electrician issued by the Division of Industrial Relations of

3-43  the Department of Business and Industry pursuant to sections 2 to

3-44  7, inclusive, of this act.


4-1  Sec. 9.  1.  This section and sections 1, 2 and 3 of this act

4-2  become effective upon passage and approval.

4-3  2.  Sections 4 to 8, inclusive, of this act become effective on

4-4  July 1, 2004.

4-5  3.  The provisions of sections 5, 6 and 7 of this act expire by

4-6  limitation on the date on which the provisions of 42 U.S.C. § 666

4-7  requiring each state to establish procedures under which the State

4-8  has the authority to withhold or suspend, or to restrict the use of,

4-9  professional, occupational and recreational licenses of persons who:

4-10      (a) Have failed to comply with a subpoena or warrant relating to

4-11  a proceeding to determine the paternity of a child or to establish or

4-12  enforce an obligation for the support of a child; or

4-13      (b) Are in arrears in the payment for the support of one or more

4-14  children,

4-15  are repealed by the Congress of the United States.
