AN ACT relating to intellectual property; limiting the right of an employer to own certain intellectual property developed by an employee; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. NRS 600.500 is hereby amended to read as follows:

1-2  600.500  Except as otherwise provided by express written

1-3  agreement, an employer is the sole owner of any patentable

1-4  invention or trade secret developed by his employee during the

1-5  course of the employment that relates directly to work performed

1-6  during the course of the employment [.] if the employee is

1-7  expressly:

1-8  1.  Hired to invent; or

1-9  2.  Directed to invent and the invention or trade secret is

1-10  developed pursuant to that direction.

1-11      Sec. 2.  The amendatory provisions of this act do not apply to

1-12  any patentable invention or trade secret developed before October 1,

1-13  2003.
