AN ACT relating to employee leasing companies; increasing the penalty for failing to comply with the provisions relating to the operation of employee leasing companies; and providing other matters properly relating thereto.

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1 NRS 616B.673 is hereby amended to read as follows:
616B.673 1. A person shall not operate an employee leasing company in this state unless he has complied with the provisions of NRS 616.B.670 to 616B.697, inclusive. The manager shall issue a certificate of insurance to each applicant who complies with the provisions of NRS 616B.670 to 616B.697, inclusive.
2. Any person who [violates the provisions of subsection 1] operates an employee leasing company in this state in violation of any provision of NRS 616B.670 to 616B.697, inclusive, is guilty of a [misdemeanor.] category D felony and shall be punished as provided in NRS 193.130.
3. Each certificate of insurance issued by the manager pursuant to NRS 616B.670 to 616B.697, inclusive, expires 1 year after it is issued unless renewed before that date.
Sec. 2 The amendatory provisions of this act do not apply to offenses that are committed before October 1, 1997.
