AN ACT relating to state employees; requiring certain state agencies to allow classified employees to select their schedules of work based on the seniority of the employees; and providing other matters properly relating thereto.

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1 Chapter 284 of NRS is hereby amended by adding thereto a new section to read as follows:
1. A state agency that transacts business 24 hours a day during every day of the year shall, to the extent practicable, and in accordance with the staffing requirements necessary for the agency to carry out its duties and the limitations on the number of hours that an employee may work pursuant to federal or state law, allow its employees in the classified service of this state to select, based on the seniority of the employees, their schedules of work.
2. Such an employee who is denied his choice of a schedule of work may submit the matter for resolution under the procedure for the adjustment of grievances established pursuant to NRS 284.384.
3. For the purposes of this section, a state agency shall calculate seniority based on:
(a) The current period of continuous service of each employee with that state agency; or
(b) For employees whose current periods of continuous service with that state agency are equal, their respective total periods of state service.
4. As used in this section, "state agency" means an office, department, board, commission, bureau, agency or institution in the executive department of state government.
