AN ACT relating to autism; providing for the limited licensure of persons who work with autistic children in a program established by the University and Community College System of Nevada; authorizing an application fee for such licensure; requiring the board of psychological examiners to adopt regulations concerning such licensure; and providing other matters properly relating thereto.

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1 Chapter 641 of NRS is hereby amended by adding thereto a new section to read as follows:
1. The board shall, without any examination, issue a limited license to a qualified applicant that authorizes the applicant to work with autistic children through a program of the University and Community College System of Nevada.
2. An application for a limited license must be made upon a form provided by the board and be accompanied by evidence satisfactory to the board that the applicant is or will be working with autistic children through a program of the University and Community College System of Nevada.
3. Every applicant for a limited license shall submit with his application a complete set of his fingerprints and written permission authorizing the board to forward the fingerprints to the Federal Bureau of Investigation and to the central repository for Nevada records of criminal history for their reports on the criminal history of the applicant. The board may issue a provisional limited license pending receipt of the reports if it determines that the applicant is otherwise qualified.
4. The board may charge an application fee for a limited license in an amount that does not exceed the administrative costs of the board in carrying out the provisions of this section.
5. The board shall issue a limited license to an applicant:
(a) Upon receipt of a completed application, the evidence required by subsection 2 and any application fee charged by the board; and
(b) If the reports on the criminal history of the applicant from the Federal Bureau of Investigation and the central repository for Nevada records of criminal history do not indicate that the applicant has been convicted of a felony or any offense involving moral turpitude.
6. A limited license is valid so long as the person to whom it is issued works with autistic children through a program of the University and Community College System of Nevada, and does not need to be renewed.
7. The board shall adopt:
(a) Regulations that define the scope of the activities authorized by a limited license issued pursuant to this section; and
(b) Such other regulations as are necessary to carry out the provisions of this section.
8. The provisions of NRS 641.160 to 641.370, inclusive, do not apply to a limited license issued pursuant to this section.
Sec. 2 This act becomes effective on July 1, 1997.
