AN ACT making an appropriation to the Department of Education for the support of charter schools; and providing other matters properly relating thereto.

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1 1. There is hereby appropriated from the state general fund to the Department of Education the sum of $100,000 for distribution to applicants for charter schools who have each been granted a written charter pursuant to the provisions of Senate Bill No. 220 of this session. The amount of money distributed to the applicant must be based upon the projected enrollment of pupils in the charter school, as determined by the State Board of Education and the applicant. The money granted to an applicant must be used for the costs incurred by the applicant in forming the charter school.
2. If an applicant who receives a grant of money pursuant to subsection 1 fails to form a charter school, he shall, as soon as is practicable, return the total amount of money distributed to him to the Department of Education.
3. Any remaining balance of the appropriation made by subsection 1 must not be committed for expenditure after June 30, 1999, and reverts to the state general fund as soon as all payments of money committed have been made.
Sec. 2 This act becomes effective upon passage and approval of Senate Bill No. 220 of this session.
