AN ACT relating to the justice system; requiring the attorney general to represent a justice of the peace or a municipal judge in an action against the justice or judge in his official capacity; requiring the attorney general to conduct certain investigations; authorizing the attorney general to represent a justice of the peace or a municipal judge in certain actions against a county, a city, or a county or city officer or employee; prohibiting the investigation division of the department of motor vehicles and public safety from disclosing to a district attorney or a member of his staff any information concerning investigations relating to such actions under certain circumstances; and providing other matters properly relating thereto.

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1 Chapter 228 of NRS is hereby amended by adding thereto a new section to read as follows:
The attorney general shall:
1. Provide legal representation to a justice of the peace or a municipal judge in an action against the justice of the peace or the municipal judge in his official capacity.
2. Conduct an investigation into each suspected violation of a provision of NRS, a county or city ordinance or a rule of the supreme court upon the request of a justice of the peace or a municipal judge who wishes to bring or maintain an action against a county, a city, or a county or city officer or employee for the purpose of enforcing the provision, ordinance or rule. In any such action, the attorney general may provide legal representation to the justice of the peace or the municipal judge. If the attorney general declines to provide such representation, the attorney general shall provide a written statement that sets forth his reasons for declining to provide the representation.
Sec. 2 Chapter 481 of NRS is hereby amended by adding thereto a new section to read as follows:
The investigation division shall not furnish to a district attorney or a member of his staff any information concerning an investigation initiated by the attorney general in connection with his representation of a justice of the peace or a municipal judge pursuant to section 1 of this act in which the district attorney or a member of his staff is a subject of the investigation.
