AN ACT relating to peace officers; authorizing the governing body of a city or county to create a review board to advise the body on issues concerning peace officers or law enforcement; and providing other matters properly relating thereto.

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1 Chapter 289 of NRS is hereby amended by adding thereto the provisions set forth as sections 2 and 3 of this act.
Sec. 2. 1. The governing body of a city or county may create by ordinance a review board composed of residents of the city or county to advise the governing body on issues concerning peace officers or law enforcement that affect the city or county.
2. Such a review board may meet at such times and places within the city or county as it deems necessary to carry out the provisions of this section.
Sec. 3. 1. A review board that is created pursuant to section 2 of this act may:
(a) Administer oaths;
(b) Take testimony;
(c) Issue subpoenas to compel the attendance of witnesses to testify before the review board;
(d) Require the production of books, papers and documents; and
(e) Issue commissions to take testimony.
2. If a witness refuses to attend or testify or produce books, papers or documents as required by the subpoena, the review board may report to the district court by petition, setting forth that:
(a) Due notice has been given of the time and place of attendance of the witness or the production of the books, papers or documents;
(b) The witness has been subpoenaed by the review board pursuant to this section; and
(c) The witness has failed or refused to attend or produce the books, papers or documents required by the subpoena before the review board which is named in the subpoena, or has refused to answer questions propounded to him,
and asking for an order of the court compelling the witness to attend and testify or produce the books, papers or documents before the review board.
3. Upon receiving such a petition, the court shall enter an order directing the witness to appear before the court at a time and place to be fixed by the court in its order, the time to be not more than 10 days after the date of the order, and show cause why he has not attended or testified or produced the books, papers or documents before the review board. A certified copy of the order must be served upon the witness.
4. If it appears to the court that the subpoena was regularly issued by the review board, the court shall enter an order that the witness appear before the review board at the time and place fixed in the order and testify or produce the required books, papers or documents. Upon failure to obey the order, the witness must be dealt with as for contempt of court.
