SUMMARY--Prohibits horse tripping. (BDR 50-34)

AN ACT relating to cruelty to animals; making it unlawful to trip or fell a horse for entertainment or sport under certain circumstances; providing a penalty; and providing other matters properly relating thereto.

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1 Chapter 574 of NRS is hereby amended by adding thereto a new section to read as follows:
1. It is unlawful for a person who:
(a) Participates in a public exhibition intentionally to trip or fell a horse by the legs, by any means, for the purpose of entertainment or sport.
(b) Presents a public exhibition to permit a participant to engage in the conduct prohibited by paragraph (a).
2. As used in this section:
(a) "Horse" means an animal of the equine species.
(b) "Trip or fell" means to cause a horse to fall or lose its balance with the use of a wire, pole, stick, rope or other object. The term does not include the lawful laying down of a horse for medical purposes or for the purposes of identification.
Sec. 2. NRS 574.050 is hereby amended to read as follows:
574.050 As used in NRS 574.050 to 574.200, inclusive [:] , and section 1 of this act, unless the context otherwise requires:
1. "Animal" does not include the human race, but includes every other living creature.
2. "Torture" or "cruelty" includes every act, omission or neglect [,] whereby unjustifiable physical pain, suffering or death is caused or permitted.
Sec. 3. The provisions of subsection 1 of NRS 354.599 do not apply to any additional expenses of a local government that are related to the provisions of this act.
Sec. 4. The provisions of section 1 of this act do not apply to offenses that are committed before October 1, 1997.
